  1  1    Amend the amendment, H-3985, to Senate File 481, as
  1  2 amended, passed, and reprinted by the Senate, as
  1  3 follows:
  1  4    #1.  Page 4, by inserting after line 7 the
  1  5 following:
  1  6    Sec.    .  INTENT.  It is the intent of the general
  1  7 assembly that the fees imposed in sections 200 through
  1  8 205 of this Act be remitted monthly by the state
  1  9 department of transportation to the treasurer of state
  1 10 and appropriated to the road use tax fund.
  1 11    Sec. 200.  NEW SECTION.  325.9A  COMPLIANCE REVIEW.
  1 12    When a certificate is awarded to a motor carrier of
  1 13 property who has applied to transport hazardous
  1 14 materials requiring placarding as provided by federal
  1 15 hazardous materials regulations and the carrier does
  1 16 not have a safety rating issued by the United States
  1 17 department of transportation, the department shall
  1 18 award the certificate subject to completion of a motor
  1 19 carrier education program.  A compliance review shall
  1 20 be conducted by the department within one hundred
  1 21 eighty days of the issuance of the certificate and
  1 22 shall determine the carrier's compliance with sections
  1 23 321.449 and 321.450.  If the department determines
  1 24 that the carrier's safety rating is unsatisfactory,
  1 25 the department shall suspend the carrier from
  1 26 intrastate transportation of hazardous materials.
  1 27    Sec. 201.  NEW SECTION.  325.9B  MOTOR CARRIER
  1 28 EDUCATION COURSE.
  1 29    1.  An applicant for a certificate issued pursuant
  1 30 to this chapter to transport hazardous materials
  1 31 requiring placarding as provided by federal hazardous
  1 32 materials regulations shall be required to
  1 33 successfully complete a motor carrier education course
  1 34 established and provided by the department before the
  1 35 certificate will be issued.  The education course
  1 36 shall require instruction concerning, at a minimum,
  1 37 safety and insurance regulations, hazardous materials
  1 38 regulations, and size and weight regulations.  The
  1 39 applicant shall designate at least one person employed
  1 40 by the applicant, who has a substantial interest in or
  1 41 control over the operations to be conducted by the
  1 42 applicant, to complete the course.
  1 43    The department may require a motor carrier of
  1 44 property to complete a motor carrier education course
  1 45 if the carrier receives a citation for being ten
  1 46 thousand or more pounds over the legal maximum gross
  1 47 weight for a vehicle operated by the motor carrier.
  1 48    An applicant shall pay a fee, determined by the
  1 49 department to defray the cost of the course but in no
  1 50 event more than two hundred fifty dollars, into the
  2  1 road use tax fund as provided in section 325.36.
  2  2    2.  The requirement that an applicant complete a
  2  3 motor carrier education course prior to issuance of a
  2  4 certificate under this chapter does not apply to the
  2  5 following:
  2  6    a.  A motor carrier of hazardous materials
  2  7 requiring placarding as provided by federal hazardous
  2  8 materials regulations issued a certificate prior to
  2  9 January 1, 1995.
  2 10    b.  A successor in interest to a motor carrier of
  2 11 hazardous materials requiring placarding as provided
  2 12 by federal hazardous materials regulations issued a
  2 13 certificate prior to January 1, 1995.
  2 14    Sec. 202.  Section 325.12, Code 1995, is amended by
  2 15 adding the following new subsection:
  2 16    NEW SUBSECTION.  8.  A filing fee of five hundred
  2 17 dollars for motor carriers of property that transport
  2 18 hazardous materials requiring placarding as provided
  2 19 by federal hazardous materials regulations.
  2 20    Sec. 203.  Section 327.7, Code 1995, is amended by
  2 21 adding the following new subsection:
  2 22    NEW SUBSECTION.  5.  A filing fee of five hundred
  2 23 dollars for contract carriers and truck operators that
  2 24 transport hazardous materials requiring placarding as
  2 25 provided by federal hazardous materials regulations.
  2 26    Sec. 204.  Section 327.8, Code 1995, is amended to
  2 27 read as follows:
  2 28    327.8  ISSUANCE.
  2 29    Upon the filing of the application and if the
  2 30 applicant shall otherwise comply with the terms and
  2 31 conditions of this chapter and sections 325.9A and
  2 32 325.9B, the department shall issue to the applicant a
  2 33 permit as herein defined.  The actual operation of
  2 34 such motor vehicle or vehicles shall not begin without
  2 35 the written approval of the state department, stating
  2 36 that the applicant has complied with the prescribed
  2 37 safety regulations.
  2 38    Sec. 205.  Section 327A.3, Code 1995, is amended by
  2 39 adding the following new unnumbered paragraph:
  2 40    NEW UNNUMBERED PARAGRAPH.  The provisions of
  2 41 sections 325.9A and 325.9B and section 325.12,
  2 42 subsection 8, concerning payment of fees, apply to
  2 43 liquid transport carriers for hire that transport
  2 44 hazardous materials requiring placarding as provided
  2 45 by federal hazardous materials regulations."
