1 1 Amend the amendment, H-3607, to House File 519 as
1 2 follows:
1 3 #1. Page 1, by inserting after line 3 the
1 4 following:
1 5 "Sec. . Section 335.2, Code 1995, is amended to
1 6 read as follows:
1 7 335.2 FARMS EXEMPT.
1 8 1. Except to the extent required to implement
1 9 section 335.27, no ordinance adopted under this
1 10 chapter applies to land, farm houses, farm barns, farm
1 11 outbuildings or other buildings or structures which
1 12 are primarily adapted, by reason of nature and area,
1 13 for use for agricultural purposes, while so used.
1 14 However, the ordinances may apply to any structure,
1 15 building, dam, obstruction, deposit or excavation in
1 16 or on the flood plains of any river or stream.
1 17 2. This section shall not apply to the
1 18 unincorporated area up to two miles beyond the limits
1 19 of a city, if the person holding an interest in the
1 20 property within the area establishes an agricultural
1 21 feeding operation, as defined in section 455B.161 on
1 22 the property, and the person is classified as a type
1 23 of corporation, limited liability company, limited
1 24 partnership, or trust, regulated under chapter 9H.
1 25 However, if the property is so held, the exemption in
1 26 subsection 1 shall continue to apply if the natural
1 27 person who is a shareholder of the corporation, member
1 28 of the limited liability company, limited partner of
1 29 the limited partnership, or beneficiary of the trust,
1 30 holds a minimum interest in the corporation, limited
1 31 liability company, limited partnership, or trust, and
1 32 resides in closer proximity to the operation than any
1 33 other person. The minimum interest may be either an
1 34 equity position in the corporation, limited liability
1 35 company, limited partnership, or trust which is at
1 36 least equal to any other stockholder of the
1 37 corporation, member of the limited liability company,
1 38 limited partner of the limited partnership, or
1 39 beneficiary of the trust; or an equity position which
1 40 is at least twenty-five percent of the total equity
1 41 position held by all shareholders of the corporation,
1 42 members of the limited liability company, limited
1 43 partners of the limited partnership, or beneficiaries
1 44 of the trust."
