  1  1    Amend House File 519 as follows:
  1  2    #1.  Page 5, by inserting after line 31 the
  1  3 following:
  1  4    "Sec.    .  Section 414.23, unnumbered paragraph 1,
  1  5 Code 1995, is amended to read as follows:
  1  6    The powers granted by this chapter may be extended
  1  7 by ordinance by any city to the unincorporated area up
  1  8 to two miles beyond the limits of such city, except
  1  9 for those areas within a county where a county zoning
  1 10 ordinance exists.  The ordinance shall describe in
  1 11 general terms the area to be included.  The exemption
  1 12 from regulation granted by section 335.2 to property
  1 13 used for agricultural purposes shall apply to such
  1 14 unincorporated area, unless the person holding an
  1 15 interest in the property establishes an agricultural
  1 16 feeding operation, as defined in section 455B.161 on
  1 17 the property, and the person is classified as a type
  1 18 of corporation, limited liability company, limited
  1 19 partnership, or trust, regulated under chapter 9H.  If
  1 20 the property is so held, the exemption shall apply,
  1 21 only if the natural person who is a shareholder of the
  1 22 corporation, member of the limited liability company,
  1 23 limited partner of the limited partnership, or
  1 24 beneficiary of the trust, holds a minimum interest in
  1 25 the corporation, limited liability company, limited
  1 26 partnership, or trust, and resides in closer proximity
  1 27 to the operation than any other person.  The minimum
  1 28 interest may be either an equity position in the
  1 29 corporation, limited liability company, limited
  1 30 partnership, or trust which is at least equal to any
  1 31 other stockholder of the corporation, member of the
  1 32 limited liability company, limited partner of the
  1 33 limited partnership, or beneficiary of the trust; or
  1 34 an equity position which is at least twenty-five
  1 35 percent of the total equity position held by all
  1 36 shareholders of the corporation, members of the
  1 37 limited liability company, limited partners of the
  1 38 limited partnership, or beneficiaries of the trust.
  1 39 If the limits of any such city are at any place less
  1 40 than four miles distant from the limits of any other
  1 41 city which has extended or thereafter extends its
  1 42 zoning jurisdiction under this section, then at such
  1 43 time the powers herein granted by this chapter shall
  1 44 extend to a line equidistant between the limits of
  1 45 said the cities."
