1 4 AUTHORIZING THE DEPARTMENT OF HUMAN SERVICES TO DISCLOSE
1 5 INFORMATION REGARDING THE LISTING OF AN INDIVIDUAL IN THE
1 6 CHILD OR DEPENDENT ABUSE REGISTRY OR THE SEX OFFENDER
1 7 REGISTRY WHEN IT IS NECESSARY FOR THE PROTECTION OF A CHILD
1 8 OR A DEPENDENT ADULT.

1 10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 12 Section 1. Section 232.71B, Code 2003, is amended by
1 13 adding the following new subsection:
1 14 NEW SUBSECTION. 7A. PROTECTIVE DISCLOSURE. If the
1 15 department determines that disclosure is necessary for the
1 16 protection of a child, the department may disclose to a
1 17 subject of a child abuse report referred to in section
1 18 235A.15, subsection 2, paragraph "a", that an individual is
1 19 listed in the child or dependent abuse registry or is required
1 20 to register with the sex offender registry in accordance with
1 21 chapter 692A.
1 22 Sec. 2. Section 235B.3, Code 2003, is amended by adding
1 23 the following new subsection:
1 24 NEW SUBSECTION. 6A. If the department determines that
1 25 disclosure is necessary for the protection of a dependent
1 26 adult, the department may disclose to a subject of a dependent
1 27 adult abuse report referred to in section 235B.6, subsection
1 28 2, paragraph "a", that an individual is listed in the child or
1 29 dependent abuse registry or is required to register with the
1 30 sex offender registry in accordance with chapter 692A.
1 31 Sec. 3. Section 692A.13, Code 2003, is amended by adding
1 32 the following new subsection:
1 33 NEW SUBSECTION. 9. If the department of human services
1 34 determines that disclosure is necessary for the protection of
1 35 a child or a dependent adult, the department may disclose to a
2 1 subject of a child abuse report referred to in section
2 2 235A.15, subsection 2, paragraph "a", or to a subject of a
2 3 dependent adult abuse report referred to in section 235B.6,
2 4 subsection 2, paragraph "a", that an individual is listed in
2 5 the child or dependent abuse registry or is required to
2 6 register under this chapter.
