  1  1    Section 1.  Section 455B.310, subsection 5, Code 2003, is
  1  2 amended to read as follows:
  1  3    5.  Solid waste disposal facilities with special provisions
  1  4 which limit the site to disposal of construction and
  1  5 demolition waste, landscape waste, coal combustion waste,
  1  6 cement kiln dust, foundry sand, and solid waste materials
  1  7 approved by the department for lining or capping, or for
  1  8 construction berms, dikes, or roads in a sanitary disposal
  1  9 project or sanitary landfill are exempt from the tonnage fees
  1 10 imposed under this section.  However, solid waste disposal
  1 11 facilities under this subsection are subject to the fees
  1 12 imposed pursuant to section 455B.105, subsection 11, paragraph
  1 13 "a".  Notwithstanding the provisions of section 455B.105,
  1 14 subsection 11, paragraph "b", the fees collected pursuant to
  1 15 this subsection shall be deposited in the solid waste account
  1 16 as established in section 455E.11, subsection 2, paragraph
  1 17 "a", to be used by the department for the regulation of these
  1 18 solid waste disposal facilities.
  1 19    Sec. 2.  NEW SECTION.  455D.22  DILAPIDATED BUILDING TRUST
  1 20 FUND.
  1 21    1.  A dilapidated building trust fund is created in the
  1 22 state treasury under the control of the department of natural
  1 23 resources.  Moneys in the fund shall consist of moneys
  1 24 received by the department pursuant to section 455E.11,
  1 25 subsection 2, paragraph "a", subparagraph (1), subparagraph
  1 26 subdivision (bb), and any moneys appropriated by the general
  1 27 assembly and any other moneys available to and obtained or
  1 28 accepted by the department for placement in the fund.  Moneys
  1 29 in the fund are not subject to section 8.33.  Notwithstanding
  1 30 section 12C.7, interest or earnings on moneys in the fund
  1 31 shall be credited to the fund.
  1 32    2.  Moneys in the fund are appropriated to the department
  1 33 for purposes of providing financial assistance in the form of
  1 34 grants, loans, forgivable loans, and other forms of assistance
  1 35 to persons for purposes of projects related to renovation of
  2  1 dilapidated buildings or the demolition and materials recovery
  2  2 of dilapidated buildings.
  2  3    Sec. 3.  Section 455E.11, subsection 2, paragraph a,
  2  4 subparagraph (1), Code 2003, is amended by adding the
  2  5 following new subparagraph subdivision after subparagraph
  2  6 subdivision (b):
  2  7    NEW SUBPARAGRAPH SUBDIVISION.  (bb)  Five hundred thousand
  2  8 dollars to the department to be deposited in the dilapidated
  2  9 building trust fund established in section 455D.22.
  2 10    Sec. 4.  PILOT PROJECT.  The department of natural
  2 11 resources shall establish a mobile demolition debris
  2 12 processing system pilot project to demonstrate viability of
  2 13 materials recovery from demolition waste associated with the
  2 14 demolition of dilapidated buildings.  
  2 15                           EXPLANATION
  2 16    This bill relates to the tonnage fees for construction and
  2 17 demolition waste and creates a dilapidated building trust
  2 18 fund.
  2 19    Currently, solid waste disposal facilities with special
  2 20 provisions which limit the site to disposal of construction
  2 21 and demolition waste, landscape waste, coal combustion waste,
  2 22 cement kiln dust, foundry sand, and solid waste materials
  2 23 approved by the department for lining or capping, or for
  2 24 construction berms, dikes, or roads in a sanitary disposal
  2 25 project or sanitary landfill are exempt from the tonnage fees.
  2 26 The bill removes the disposal of construction and demolition
  2 27 waste from this exemption.
  2 28    The bill creates a dilapidated building trust fund under
  2 29 the control of the department of natural resources.  The bill
  2 30 provides that $500,000 of collected tonnage fees each year
  2 31 shall be deposited in the trust fund.  The bill provides that
  2 32 moneys in the fund are appropriated to the department for
  2 33 purposes of providing financial assistance in the form of
  2 34 grants, loans, forgivable loans, and other forms of assistance
  2 35 to persons for purposes of projects related to renovation of
  3  1 dilapidated buildings or the demolition and materials recovery
  3  2 of dilapidated buildings.
  3  3    The bill requires the department of natural resources to
  3  4 establish a mobile demolition debris processing system pilot
  3  5 project to demonstrate viability of materials recovery from
  3  6 demolition waste associated with the demolition of dilapidated
  3  7 buildings.
