Senate Study Bill 3134

  1  1    Section 1.  Section 124.506, Code 2001, is amended by
  1  2 adding the following new subsection:
  1  3    NEW SUBSECTION.  3A.  Upon application by any law
  1  4 enforcement agency, the board may in its discretion deliver
  1  5 any controlled substance that has come into its custody by
  1  6 authority of this section to the applicant or applicant's
  1  7 designee.  The use of the controlled substance shall be
  1  8 limited to substance abuse training for peace officers or the
  1  9 general public, or for canine drug detection training.
  1 10    a.  Any law enforcement personnel, drug detection canine
  1 11 trainer, or any other person working under the direction of
  1 12 the law enforcement agency, who delivers, possesses with
  1 13 intent to deliver, or possesses a controlled substance for
  1 14 such training purposes shall be immune from criminal
  1 15 prosecution.
  1 16    b.  A law enforcement agency shall establish a secure place
  1 17 to store a controlled substance delivered pursuant to this
  1 18 subsection, and shall keep a full and complete record of the
  1 19 custody and control of the controlled substance, including any
  1 20 loss or damage to the controlled substance while in the
  1 21 possession of the agency.
  1 22    c.  All controlled substances shall be returned to the
  1 23 board after completion of the training, or upon demand by the
  1 24 board.  
  1 25                           EXPLANATION
  1 26    This bill permits the board of pharmacy examiners to
  1 27 deliver a controlled substance to a law enforcement agency for
  1 28 training purposes.
  1 29    The bill provides that a law enforcement agency may apply
  1 30 to the board of pharmacy examiners to use a controlled
  1 31 substance for substance abuse training for peace officers or
  1 32 the general public, or for canine drug detection training.
  1 33 The bill provides that any law enforcement personnel, drug
  1 34 detection canine trainer, or any other person working under
  1 35 the direction of the law enforcement agency, who delivers,
  2  1 possesses with intent to deliver, or possesses a controlled
  2  2 substance for such training purposes shall be immune from
  2  3 criminal prosecution.
  2  4    The bill provides that a law enforcement agency shall
  2  5 establish a secure place to store a controlled substance
  2  6 delivered pursuant to the bill, and shall keep a full and
  2  7 complete record of the custody and control of the controlled
  2  8 substance.
  2  9    All controlled substances delivered pursuant to the bill
  2 10 shall be returned to the board after completion of the
  2 11 training, or upon demand by the board.
