1 1 Section 1. Section 8D.3, subsection 3, paragraph a, Code
1 2 2001, is amended to read as follows:
1 3 a. Enter into agreements pursuant to chapter 28E as
1 4 necessary and appropriate for the purposes of the commission.
1 5 However, the commission shall not enter into an agreement with
1 6 an unauthorized user or any other person pursuant to chapter
1 7 28E for the purpose of providing such user or person access to
1 8 the network, unless the sole purpose of providing such access
1 9 is to establish backup or redundant service. The commission
1 10 may enter into a chapter 28E agreement strictly for the
1 11 purpose of supplying redundant service in place of a private
1 12 provider when the private provider's service fails. The
1 13 redundant service shall only be supplied during that time in
1 14 which the private provider's service is not operating.
1 15 EXPLANATION
1 16 This bill authorizes the telecommunications and technology
1 17 commission to enter into a Code chapter 28E agreement with an
1 18 unauthorized user of the Iowa communications network or any
1 19 other person strictly for the purpose of supplying backup or
1 20 redundant service to the unauthorized user or other person
1 21 when a private provider's service fails. This facilitates
1 22 maintaining two alternative service providers for agencies or
1 23 organizations that are utilized by both authorized and
1 24 nonauthorized users of the Iowa communications network.
