  1  1    Section 1.  Section 43.2, Code 2001, is amended to read as
  1  2 follows:
  1  3    43.2  DEFINITIONS.
  1  4    The term "political party" shall mean a party which, at the
  1  5 last preceding general election, cast for its candidate for
  1  6 president of the United States or for governor, as the case
  1  7 may be any statewide office, at least two percent of the total
  1  8 vote cast for all candidates for that office at that election.
  1  9 It shall be the responsibility of the state commissioner to
  1 10 determine whether any organization claiming to be a political
  1 11 party qualifies as such under the foregoing definition.
  1 12    In order to maintain its ballot status, a political party
  1 13 must continue to meet the percentage of the vote requirement
  1 14 in the foregoing definition, or must maintain registrations
  1 15 with that party in a number equal to or greater than one-half
  1 16 of one percent of the total number of voters who cast ballots
  1 17 in the last preceding general election.  The state
  1 18 commissioner shall determine whether a political party
  1 19 continues to maintain ballot status under this paragraph.
  1 20    A political organization which is not a "political party"
  1 21 within the meaning of this section may nominate candidates and
  1 22 have the names of such candidates placed upon the official
  1 23 ballot by proceeding under chapters 44 and 45.
  1 24    As used in this chapter, unless the context otherwise
  1 25 requires, "book", "list", "record", or "schedule" kept by a
  1 26 county auditor, assessor, treasurer, recorder, sheriff, or
  1 27 other county officer means the county system as defined in
  1 28 section 445.1.  
  1 29                           EXPLANATION
  1 30    This bill provides that a party that receives 2 percent of
  1 31 the vote for any statewide office will qualify as a political
  1 32 party.  Current law requires that the party's candidate for
  1 33 United States president or governor receive at least 2 percent
  1 34 of the votes cast in order to qualify as a political party.
  1 35 The bill also allows a party to maintain its status as a
  2  1 political party either by continuing to meet the stipulated
  2  2 percentage vote or by maintaining registrations to the party
  2  3 of 0.5 percent of the total number of persons who voted in the
  2  4 last preceding general election.
