Senate Study Bill 3115

  1  1    Section 1.  Section 298.3, subsection 3, Code 2001, is
  1  2 amended to read as follows:
  1  3    3.  The purchase of buildings and the purchase of a single
  1  4 unit of equipment or a technology system exceeding one
  1  5 thousand five hundred dollars in value equipment or
  1  6 technology.
  1  7    Sec. 2.  Section 298.3, Code 2001, is amended by adding the
  1  8 following new unnumbered paragraph:
  1  9    NEW UNNUMBERED PARAGRAPH.  Imposition of the regular and
  1 10 voter-approved physical plant and equipment levies shall not
  1 11 limit or impact the ability of a school district to utilize
  1 12 general fund moneys for the purposes authorized in this
  1 13 section.  
  1 14                           EXPLANATION
  1 15    This bill relates to the use of school district moneys for
  1 16 physical plant and equipment levy purposes.
  1 17    The bill eliminates a requirement that a school district's
  1 18 purchase of a single unit of equipment or a technology system
  1 19 must exceed $1,500 in value in order to use physical plant and
  1 20 equipment levy revenue.  The elimination of the minimum value
  1 21 requirement would permit use of physical plant and equipment
  1 22 levy revenue for equipment or technology without limitation on
  1 23 monetary value.  The bill also deletes the word "system" with
  1 24 reference to the purchase of equipment or technology.
  1 25    The bill additionally provides that imposition of the
  1 26 regular and voter-approved physical plant and equipment levies
  1 27 shall not limit or impact the ability of a school district to
  1 28 utilize general fund moneys for the purposes authorized in
  1 29 Code section 298.3, relating to use of revenues from the
  1 30 levies.
