PAG LIN 1 1 Section 1. NEW SECTION. 730.6 BROADCASTING INDUSTRY 1 2 NONCOMPETE CONTRACTS VOID. 1 3 Any contract which establishes the terms of employment for 1 4 an employee in the broadcasting industry, including television 1 5 stations, television networks, radio stations, radio networks, 1 6 or any affiliated entities, and which restricts the right of 1 7 such employee to obtain employment in a specified geographic 1 8 area for a specified period of time after termination of 1 9 employment of the employee by the employer or by termination 1 10 of the employment relationship by mutual agreement of the 1 11 employer and the employee or by termination of the employment 1 12 relationship by the expiration of the contract, shall be void 1 13 and unenforceable with respect to such provision. A person 1 14 who attempts to enforce a contract provision in violation of 1 15 this section shall be liable for reasonable attorney fees and 1 16 costs associated with litigation of an affected employee to 1 17 enforce the employee's rights under this section. 1 18 EXPLANATION 1 19 This bill provides that a contract limiting the right of an 1 20 employee in the broadcasting industry to obtain other 1 21 employment in a specific geographic area for a specified time 1 22 after terminating employment under the contract is void. The 1 23 bill provides that a person attempting to enforce a void 1 24 contract provision is liable to the affected employee for 1 25 reasonable attorney fees and costs in any litigation to 1 26 enforce the employee's rights under this new Code section. 1 27 LSB 5069SC 79 1 28 ec/cls/14
