PAG LIN 1 1 Section 1. Section 92.5, Code 2001, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 10A. As an aide for, including, but not 1 4 limited to, dietary, environmental, housekeeping, or laundry 1 5 services, in a hospital, health care facility, or assisted 1 6 living program so long as the employee receives the minimum 1 7 hours of training set forth in the guidelines for isolation 1 8 precautions in hospitals promulgated by the centers for 1 9 disease control and prevention of the United States department 1 10 of health and human services, PB 96-138102, regarding 1 11 potential exposure to biological materials and biohazards and 1 12 applicable precautions necessary to be taken in connection 1 13 with the employment. 1 14 Sec. 2. Section 92.8, Code 2001, is amended by adding the 1 15 following new subsection: 1 16 NEW SUBSECTION. 20A. Nothing in this section shall be 1 17 construed as prohibiting work as an aide for, including, but 1 18 not limited to, dietary, environmental, housekeeping, or 1 19 laundry services, in a hospital, health care facility, or 1 20 assisted living program so long as the employee receives the 1 21 minimum hours of training set forth in the guidelines for 1 22 isolation precautions in hospitals promulgated by the centers 1 23 for disease control and prevention of the United States 1 24 department of health and human services, PB 96-138102, 1 25 regarding potential exposure to biological materials and 1 26 biohazards and applicable precautions necessary to be taken in 1 27 connection with the employment. 1 28 Sec. 3. Section 92.9, Code 2001, is amended to read as 1 29 follows: 1 30 92.9 INSTRUCTION AND TRAINING PERMITTED. 1 31 1. The provisions of sections 92.8 and 92.10 shall not 1 32 apply to pupils working under an instructor in an industrial 1 33 arts department in the public schools of the state or under an 1 34 instructor in a school shop, or industrial plant, or in a 1 35 course of vocational education approved by the board for 2 1 vocational education, or to apprentices provided they are 2 2 employed under all of the following conditions: 2 31.a. The apprentice is employed in a craft recognized as 2 4 an apprenticeable trade. 2 52.b. The work of the apprentice in the occupations 2 6 declared particularly hazardous is incidental to the 2 7 apprentice's training. 2 83.c. The work is intermittent and for short periods of 2 9 time and is under the direct and close supervision of a 2 10 journeyperson as a necessary part of apprentice training. 2 114.d. The apprentice is registered by the bureau of 2 12 apprenticeship and training of the United States department of 2 13 labor as employed in accordance with the standards established 2 14 by that department. 2 15 2. The provisions of section 92.8 shall not apply to any 2 16 person currently enrolled in a training program for nurses or 2 17 a training program for certified nursing assistants or aides 2 18 or to any person who has successfully completed such training. 2 19 EXPLANATION 2 20 This bill amends Code chapter 92 by providing that a person 2 21 who is 14 or 15 years of age can be employed as an aide in a 2 22 hospital, health care facility, or assisted living program so 2 23 long as that person receives training regarding potential 2 24 exposure to biological materials and biohazards and the 2 25 applicable precautions necessary in connection with the 2 26 person's employment as an aide. 2 27 The bill also amends Code section 92.9 to allow persons who 2 28 are under 18 years of age to enroll in a training program for 2 29 nurses, certified nursing assistants, or aides and to be 2 30 employed in those positions following successful completion of 2 31 the training program. 2 32 LSB 2235SC 79 2 33 av/cls/14
