  1  4 CREATING A NEW CATEGORY OF CONFIDENTIAL PUBLIC RECORDS IN
  1  5    THE CUSTODY OF CERTAIN AIRPORTS, MUNICIPAL CORPORATIONS,
  1  6    UTILITIES, OR WATER DISTRICTS, AND ALLOWING A GOVERNMENTAL
  1  7    BODY TO HOLD A CLOSED SESSION TO DISCUSS SUCH CONFIDENTIAL
  1  8    RECORDS.

  1 10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 11 
  1 12    Section 1.  Section 21.5, subsection 1, Code 2001, is
  1 13 amended by adding the following new paragraph:
  1 14    NEW PARAGRAPH.  k.  To discuss information contained in
  1 15 records in the custody of a public airport, municipal
  1 16 corporation, municipal utility, jointly owned municipal
  1 17 utility, or rural water district organized under chapter 357A,
  1 18 that are confidential records pursuant to section 22.7,
  1 19 subsection 43.  This paragraph is repealed effective June 30,
  1 20 2007.
  1 21    Sec. 2.  Section 22.7, Code Supplement 2001, is amended by
  1 22 adding the following new subsection:
  1 23    NEW SUBSECTION.  43.  Records of a public airport,
  1 24 municipal corporation, municipal utility, jointly owned
  1 25 municipal utility, or rural water district organized under
  1 26 chapter 357A, where disclosure could reasonably be expected to
  1 27 jeopardize the security or the public health and safety of the
  1 28 citizens served by a public airport, municipal corporation,
  1 29 municipal utility, jointly owned municipal utility, or rural
  1 30 water district organized under chapter 357A.  Such records
  1 31 include but are not limited to vulnerability assessments and
  1 32 information included within such vulnerability assessments;
  1 33 architectural, engineering, or construction diagrams;
  1 34 drawings, plans, or records pertaining to security measures
  1 35 such as security and response plans, security codes and
  2  1 combinations, passwords, passes, keys, or security or response
  2  2 procedures; emergency response protocols; and records
  2  3 disclosing the configuration of critical systems or
  2  4 infrastructures of a public airport, municipal corporation,
  2  5 municipal utility, jointly owned municipal utility, or rural
  2  6 water district organized under chapter 357A.  This subsection
  2  7 is repealed effective June 30, 2007.
