PAG LIN 1 1 Section 1. Section 135.25, Code 2001, is amended to read 1 2 as follows: 1 3 135.25 EMERGENCY MEDICAL SERVICES FUND. 1 4 An emergency medical services fund is created in the state 1 5 treasury under the control of the department. The fund 1 6 includes, but is not limited to, amounts appropriated by the 1 7 general assembly, and other moneys available from federal or 1 8 private sourceswhichthat are to be used for purposes of this 1 9 section. Funds remaining in the fund at the end of each 1 10 fiscal year shall not revert to the general fund of the state 1 11 but shall remain in the emergency medical services fund, 1 12 notwithstanding section 8.33. The fund is established to 1 13 assist counties by matching, on a dollar-for-dollar basis, 1 14 moneys spent by a county for the acquisition of equipment for 1 15 the provision of emergency medical services and by providing 1 16 grants to counties for education and training in the delivery 1 17 of emergency medical services, as provided in this section and 1 18 section 422D.6. A county seeking matching funds under this 1 19 section shall apply to the emergency medical services division 1 20 of the department. The department shall adopt rules 1 21 concerning the application and awarding process for the 1 22 matching fundsand the criteria for the allocation of moneys1 23in the fund if. If the moneys available in the fund for a 1 24 fiscal year are insufficient to meet the amount of the 1 25 emergency medical servicesneeds of theequipment acquisition 1 26 and education and training grants applied for by counties, the 1 27 department shall prorate the grant awards based upon a 1 28 county's proportion of the total dollar value of the grant 1 29 applications. Moneys allocated by the department to a county 1 30 for emergency medical services purposes may be used for 1 31 equipment or training and education as determined by the board 1 32 of supervisors pursuant to section 422D.6. 1 33 EXPLANATION 1 34 This bill relates to distribution of moneys to counties 1 35 from the emergency medical services fund created in Code 2 1 section 135.25 under the control of the Iowa department of 2 2 public health. 2 3 Current law authorizes the department to adopt rules 2 4 applying criteria in the event moneys in the fund are 2 5 insufficient to meet the need for the acquisition of equipment 2 6 for the provision of emergency medical services and for 2 7 education and training in the delivery of emergency medical 2 8 services. The bill eliminates the department's authority to 2 9 adopt rules to apply such criteria and instead directs the 2 10 department to prorate the moneys among the counties applying 2 11 for the funding based upon a county's portion of the total 2 12 dollar value of the grant applications. 2 13 LSB 6174SS 79 2 14 jp/cf/24
