PAG LIN 1 1 SENATE FILE 525 1 2 1 3 AN ACT 1 4 APPROPRIATING FEDERAL FUNDS MADE AVAILABLE FROM FEDERAL BLOCK 1 5 GRANTS AND OTHER FEDERAL GRANTS, ALLOCATING PORTIONS OF FEDERAL 1 6 BLOCK GRANTS, AND PROVIDING PROCEDURES IF FEDERAL FUNDS ARE 1 7 MORE OR LESS THAN ANTICIPATED OR IF FEDERAL BLOCK GRANTS ARE 1 8 MORE OR LESS THAN ANTICIPATED. 1 9 1 10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 11 1 12 Section 1. SUBSTANCE ABUSE APPROPRIATION. 1 13 1. There is appropriated from the fund created by section 1 14 8.41 to the Iowa department of public health for the federal 1 15 fiscal year beginning October 1, 2001, and ending September 1 16 30, 2002, the following amount: 1 17 .................................................. $ 12,698,390 1 18 a. Funds appropriated in this subsection are the 1 19 anticipated funds to be received from the federal government 1 20 for the designated federal fiscal year under 42 U.S.C., 1 21 chapter 6A, subchapter XVII, which provides for the substance 1 22 abuse prevention and treatment block grant. The department 1 23 shall expend the funds appropriated in this subsection as 1 24 provided in the federal law making the funds available and in 1 25 conformance with chapter 17A. 1 26 b. Of the funds appropriated in this subsection, an amount 1 27 not exceeding 5 percent shall be used by the department for 1 28 administrative expenses. 1 29 c. The department shall expend no less than an amount 1 30 equal to the amount expended for treatment services in the 1 31 state fiscal year beginning July 1, 2000, for pregnant women 1 32 and women with dependent children. 1 33 d. Of the funds appropriated in this subsection, an amount 1 34 not exceeding $24,585 shall be used for audits. 1 35 2. The funds remaining from the appropriation made in 2 1 subsection 1 shall be allocated as follows: 2 2 a. At least 20 percent of the allocation shall be for 2 3 prevention programs. 2 4 b. At least 35 percent of the allocation shall be spent on 2 5 drug treatment and prevention activities. 2 6 c. At least 35 percent of the allocation shall be spent on 2 7 alcohol treatment and prevention activities. 2 8 3. The substance abuse block grant funds received from the 2 9 federal government in excess of the amount of the anticipated 2 10 federal fiscal year 2001-2002 award appropriated in subsection 2 11 1 shall be distributed at least 50 percent to treatment 2 12 programs and 50 percent to prevention programs except that, 2 13 based upon federal guidelines, the total amount of the excess 2 14 awarded to prevention programs shall not exceed $1,000,000. 2 15 Sec. 2. COMMUNITY MENTAL HEALTH SERVICES APPROPRIATION. 2 16 1. a. There is appropriated from the fund created by 2 17 section 8.41 to the Iowa department of human services for the 2 18 federal fiscal year beginning October 1, 2001, and ending 2 19 September 30, 2002, the following amount: 2 20 .................................................. $ 2,740,750 2 21 b. Funds appropriated in this subsection are the 2 22 anticipated funds to be received from the federal government 2 23 for the designated federal fiscal year under 42 U.S.C., 2 24 chapter 6A, subchapter XVII, which provides for the community 2 25 mental health services block grant. The department shall 2 26 expend the funds appropriated in this subsection as provided 2 27 in the federal law making the funds available and in 2 28 conformance with chapter 17A. 2 29 c. The administrator of the division of mental health and 2 30 developmental disabilities of the department of human services 2 31 shall allocate not less than 95 percent of the amount of the 2 32 block grant to eligible community mental health services 2 33 providers for carrying out the plan submitted to and approved 2 34 by the federal substance abuse and mental health services 2 35 administration for the fiscal year involved. 3 1 2. An amount not exceeding 5 percent of the funds 3 2 appropriated in subsection 1 shall be used by the department 3 3 of human services for administrative expenses. From the funds 3 4 set aside by this subsection for administrative expenses, the 3 5 division of mental health and developmental disabilities shall 3 6 pay to the auditor of state an amount sufficient to pay the 3 7 cost of auditing the use and administration of the state's 3 8 portion of the funds appropriated in subsection 1. The 3 9 auditor of state shall bill the division of mental health and 3 10 developmental disabilities for the costs of the audits. 3 11 Sec. 3. MATERNAL AND CHILD HEALTH SERVICES APPROPRIATIONS. 3 12 1. There is appropriated from the fund created by section 3 13 8.41 to the Iowa department of public health for the federal 3 14 fiscal year beginning October 1, 2001, and ending September 3 15 30, 2002, the following amount: 3 16 .................................................. $ 7,022,990 3 17 The funds appropriated in this subsection are the funds 3 18 anticipated to be received from the federal government for the 3 19 designated federal fiscal year under 42 U.S.C., chapter 7, 3 20 subchapter V, which provides for the maternal and child health 3 21 services block grant. The department shall expend the funds 3 22 appropriated in this subsection as provided in the federal law 3 23 making the funds available and in conformance with chapter 3 24 17A. 3 25 Of the funds appropriated in this subsection, an amount not 3 26 exceeding $45,700 shall be used for audits. 3 27 Funds appropriated in this subsection shall not be used by 3 28 the university of Iowa hospitals and clinics for indirect 3 29 costs. 3 30 2. An amount not exceeding $150,000 of the funds 3 31 appropriated in subsection 1 to the Iowa department of public 3 32 health shall be used by the Iowa department of public health 3 33 for administrative expenses in addition to the amount to be 3 34 used for audits in subsection 1. 3 35 The departments of public health, human services, and 4 1 education and the university of Iowa's mobile and regional 4 2 child health specialty clinics shall continue to pursue to the 4 3 maximum extent feasible the coordination and integration of 4 4 services to women and children. 4 5 3. a. Sixty-three percent of the remaining funds 4 6 appropriated in subsection 1 shall be allocated to supplement 4 7 appropriations for maternal and child health programs within 4 8 the Iowa department of public health. Of these funds, 4 9 $284,548 shall be set aside for the statewide perinatal care 4 10 program. 4 11 b. Thirty-seven percent of the remaining funds 4 12 appropriated in subsection 1 shall be allocated to the 4 13 university of Iowa hospitals and clinics under the control of 4 14 the state board of regents for mobile and regional child 4 15 health specialty clinics. The university of Iowa hospitals 4 16 and clinics shall not receive an allocation for indirect costs 4 17 from the funds for this program. Priority shall be given to 4 18 establishment and maintenance of a statewide system of mobile 4 19 and regional child health specialty clinics. 4 20 4. The Iowa department of public health shall administer 4 21 the statewide maternal and child health program and the 4 22 crippled children's program by conducting mobile and regional 4 23 child health specialty clinics and conducting other activities 4 24 to improve the health of low-income women and children and to 4 25 promote the welfare of children with actual or potential 4 26 handicapping conditions and chronic illnesses in accordance 4 27 with the requirements of Title V of the federal Social 4 28 Security Act. 4 29 Sec. 4. PREVENTIVE HEALTH AND HEALTH SERVICES 4 30 APPROPRIATIONS. 4 31 1. There is appropriated from the fund created by section 4 32 8.41 to the Iowa department of public health for the federal 4 33 fiscal year beginning October 1, 2001, and ending September 4 34 30, 2002, the following amount: 4 35 .................................................. $ 1,941,706 5 1 Funds appropriated in this subsection are the funds 5 2 anticipated to be received from the federal government for the 5 3 designated federal fiscal year under 42 U.S.C., chapter 6A, 5 4 subchapter XVII, which provides for the preventive health and 5 5 health services block grant. The department shall expend the 5 6 funds appropriated in this subsection as provided in the 5 7 federal law making the funds available and in conformance with 5 8 chapter 17A. 5 9 Of the funds appropriated in this subsection, an amount not 5 10 exceeding $5,522 shall be used for audits. 5 11 2. Of the funds appropriated in subsection 1, the specific 5 12 amount of funds stipulated by the notice of the block grant 5 13 award shall be allocated for services to victims of sex 5 14 offenses and for rape prevention education. 5 15 3. After deducting the funds allocated in subsections 1 5 16 and 2, an amount not exceeding $94,670 of the remaining funds 5 17 appropriated in subsection 1 shall be used by the Iowa 5 18 department of public health for administrative expenses in 5 19 addition to the amount to be used for audits in subsection 1. 5 20 4. After deducting the funds allocated in subsections 1, 5 21 2, and 3, the remaining funds appropriated in subsection 1 5 22 shall be used by the department for healthy people 5 23 2010/healthy Iowans 2010 program objectives, preventive health 5 24 advisory committee, and risk reduction services, including 5 25 nutrition programs, health incentive programs, chronic disease 5 26 services, emergency medical services, monitoring of the 5 27 fluoridation program and start-up fluoridation grants, and 5 28 acquired immune deficiency syndrome services. The moneys 5 29 specified in this subsection shall not be used by the 5 30 university of Iowa hospitals and clinics or by the state 5 31 hygienic laboratory for the funding of indirect costs. Of the 5 32 funds used by the department under this subsection, an amount 5 33 not exceeding $90,000 shall be used for the monitoring of the 5 34 fluoridation program and for start-up fluoridation grants to 5 35 public water systems, and an amount not exceeding $50,000 6 1 shall be used to provide chlamydia testing. 6 2 Sec. 5. DRUG CONTROL AND SYSTEM IMPROVEMENT GRANT PROGRAM 6 3 APPROPRIATION. 6 4 1. There is appropriated from the fund created in section 6 5 8.41 to the office of the governor for the drug policy 6 6 coordinator for the federal fiscal year beginning October 1, 6 7 2001, and ending September 30, 2002, the following amount: 6 8 .................................................. $ 5,658,361 6 9 Funds appropriated in this subsection are the anticipated 6 10 funds to be received from the federal government for the 6 11 designated fiscal year under 42 U.S.C., chapter 46, subchapter 6 12 V, which provides for the drug control and system improvement 6 13 grant program. The drug policy coordinator shall expend the 6 14 funds appropriated in this subsection as provided in the 6 15 federal law making the funds available and in conformance with 6 16 chapter 17A. 6 17 2. An amount not exceeding 10 percent of the funds 6 18 appropriated in subsection 1 shall be used by the drug policy 6 19 coordinator for administrative expenses. From the funds set 6 20 aside by this subsection for administrative expenses, the drug 6 21 policy coordinator shall pay to the auditor of state an amount 6 22 sufficient to pay the cost of auditing the use and 6 23 administration of the state's portion of the funds 6 24 appropriated in subsection 1. 6 25 Sec. 6. STOP VIOLENCE AGAINST WOMEN GRANT PROGRAM 6 26 APPROPRIATION. 6 27 1. There is appropriated from the fund created in section 6 28 8.41 to the office of the governor for the drug policy 6 29 coordinator for the federal fiscal year beginning October 1, 6 30 2001, and ending September 30, 2002, the following amount: 6 31 .................................................. $ 1,592,000 6 32 Funds appropriated in this subsection are the anticipated 6 33 funds to be received from the federal government for the 6 34 designated fiscal year under 42 U.S.C., chapter 46, subchapter 6 35 XII-H, which provides for grants to combat violent crimes 7 1 against women. The drug policy coordinator shall expend the 7 2 funds appropriated in this subsection as provided in the 7 3 federal law making the funds available and in conformance with 7 4 chapter 17A. 7 5 2. An amount not exceeding 5 percent of the funds 7 6 appropriated in subsection 1 shall be used by the drug policy 7 7 coordinator for administrative expenses. From the funds set 7 8 aside by this subsection for administrative expenses, the drug 7 9 policy coordinator shall pay to the auditor of the state an 7 10 amount sufficient to pay the cost of auditing the use and 7 11 administration of the state's portion of the funds 7 12 appropriated in subsection 1. 7 13 Sec. 7. LOCAL LAW ENFORCEMENT BLOCK GRANT APPROPRIATION. 7 14 1. There is appropriated from the fund created in section 7 15 8.41 to the office of the governor for the drug policy 7 16 coordinator for the federal fiscal year beginning October 1, 7 17 2001, and ending September 30, 2002, the following amount: 7 18 .................................................. $ 299,867 7 19 Funds appropriated in this subsection are the funds 7 20 anticipated to be received from the federal government for the 7 21 designated federal fiscal year under annual federal 7 22 appropriations which provide for grants to reduce crime and 7 23 improve public safety. The drug policy coordinator shall 7 24 expend the funds appropriated in this subsection as provided 7 25 in the federal law making the funds available and in 7 26 conformance with chapter 17A. 7 27 2. An amount not exceeding 3 percent of the funds 7 28 appropriated in subsection 1 shall be used by the drug policy 7 29 coordinator for administrative expenses. From the funds set 7 30 aside by this subsection for administrative expenses, the drug 7 31 policy coordinator shall pay to the auditor of state an amount 7 32 sufficient to pay the cost of auditing the use and 7 33 administration of the state's portion of the funds 7 34 appropriated in subsection 1. 7 35 Sec. 8. RESIDENTIAL SUBSTANCE ABUSE TREATMENT FOR STATE 8 1 PRISONERS FORMULA GRANT PROGRAM. There is appropriated from 8 2 the fund created in section 8.41 to the office of the governor 8 3 for the drug policy coordinator for the federal fiscal year 8 4 beginning October 1, 2001, and ending September 30, 2002, the 8 5 following amount: 8 6 .................................................. $ 501,966 8 7 Funds appropriated in this section are the funds 8 8 anticipated to be received from the federal government for the 8 9 designated federal fiscal year under 42 U.S.C., chapter 136, 8 10 which provides grants for substance abuse treatment programs 8 11 in state and local correctional facilities. The drug policy 8 12 coordinator shall expend the funds appropriated in this 8 13 section as provided in the federal law making the funds 8 14 available and in conformance with chapter 17A. 8 15 Sec. 9. COMMUNITY SERVICES APPROPRIATIONS. 8 16 1. a. There is appropriated from the fund created by 8 17 section 8.41 to the division of community action agencies of 8 18 the department of human rights for the federal fiscal year 8 19 beginning October 1, 2001, and ending September 30, 2002, the 8 20 following amount: 8 21 .................................................. $ 6,454,776 8 22 Funds appropriated in this subsection are the funds 8 23 anticipated to be received from the federal government for the 8 24 designated federal fiscal year under 42 U.S.C., chapter 106, 8 25 which provides for the community services block grant. The 8 26 division of community action agencies of the department of 8 27 human rights shall expend the funds appropriated in this 8 28 subsection as provided in the federal law making the funds 8 29 available and in conformance with chapter 17A. 8 30 b. The administrator of the division of community action 8 31 agencies of the department of human rights shall allocate not 8 32 less than 96 percent of the amount of the block grant to 8 33 eligible community action agencies for programs benefiting 8 34 low-income persons. Each eligible agency shall receive a 8 35 minimum allocation of not less than $100,000. The minimum 9 1 allocation shall be achieved by redistributing increased funds 9 2 from agencies experiencing a greater share of available funds. 9 3 The funds shall be distributed on the basis of the poverty- 9 4 level population in the area represented by the community 9 5 action areas compared to the size of the poverty-level 9 6 population in the state. 9 7 2. An amount not exceeding 4 percent of the funds 9 8 appropriated in subsection 1 shall be used by the division of 9 9 community action agencies of the department of human rights 9 10 for administrative expenses. From the funds set aside by this 9 11 subsection for administrative expenses, the division of 9 12 community action agencies of the department of human rights 9 13 shall pay to the auditor of state an amount sufficient to pay 9 14 the cost of auditing the use and administration of the state's 9 15 portion of the funds appropriated in subsection 1. The 9 16 auditor of state shall bill the division of community action 9 17 agencies for the costs of the audits. 9 18 Sec. 10. COMMUNITY DEVELOPMENT APPROPRIATIONS. 9 19 1. There is appropriated from the fund created by section 9 20 8.41 to the department of economic development for the federal 9 21 fiscal year beginning October 1, 2001, and ending September 9 22 30, 2002, the following amount: 9 23 .................................................. $ 31,306,000 9 24 Funds appropriated in this subsection are the funds 9 25 anticipated to be received from the federal government for the 9 26 designated federal fiscal year under 42 U.S.C., chapter 69, 9 27 which provides for community development block grants. The 9 28 department of economic development shall expend the funds 9 29 appropriated in this subsection as provided in the federal law 9 30 making the funds available and in conformance with chapter 9 31 17A. 9 32 2. An amount not exceeding $1,452,240 for the federal 9 33 fiscal year beginning October 1, 2001, shall be used by the 9 34 department of economic development for administrative expenses 9 35 for the community development block grant. The total amount 10 1 used for administrative expenses includes $726,120 for the 10 2 federal fiscal year beginning October 1, 2001, of funds 10 3 appropriated in subsection 1 and a matching contribution from 10 4 the state equal to $726,120 from the appropriation of state 10 5 funds for the community development block grant and state 10 6 appropriations for related activities of the department of 10 7 economic development. From the funds set aside for 10 8 administrative expenses by this subsection, the department of 10 9 economic development shall pay to the auditor of state an 10 10 amount sufficient to pay the cost of auditing the use and 10 11 administration of the state's portion of the funds 10 12 appropriated in subsection 1. The auditor of state shall bill 10 13 the department for the costs of the audit. 10 14 Sec. 11. LOW-INCOME HOME ENERGY ASSISTANCE APPROPRIATIONS. 10 15 1. There is appropriated from the fund created by section 10 16 8.41 to the division of community action agencies of the 10 17 department of human rights for the federal fiscal year 10 18 beginning October 1, 2001, and ending September 30, 2002, the 10 19 following amount: 10 20 .................................................. $ 25,541,963 10 21 The funds appropriated in this subsection are the funds 10 22 anticipated to be received from the federal government for the 10 23 designated federal fiscal year under 42 U.S.C., chapter 94, 10 24 subchapter II, which provides for the low-income home energy 10 25 assistance block grants. The division of community action 10 26 agencies of the department of human rights shall expend the 10 27 funds appropriated in this subsection as provided in the 10 28 federal law making the funds available and in conformance with 10 29 chapter 17A. 10 30 2. Up to 15 percent of the amount appropriated in this 10 31 section that is actually received shall be used for 10 32 residential weatherization or other related home repairs for 10 33 low-income households. Of this allocation amount, not more 10 34 than 10 percent may be used for administrative expenses. In 10 35 order to receive low-income home energy assistance program 11 1 funding, the head of an eligible household must be willing to 11 2 allow residential weatherization or other related home 11 3 repairs. However, if the eligible household is located in 11 4 rental property, the unwillingness of the property owner to 11 5 allow residential weatherization or other related home repairs 11 6 shall not prevent the eligible household from receiving low- 11 7 income home energy assistance program funding. 11 8 3. After subtracting the allocation in subsection 2, up to 11 9 $2,663,921 is allocated for administrative expenses of the 11 10 low-income home energy assistance program of which $290,000 is 11 11 allocated for administrative expenses of the division. The 11 12 costs of auditing the use and administration of the portion of 11 13 the appropriation in this section that is retained by the 11 14 state shall be paid from the amount allocated in this 11 15 subsection to the division. The auditor of state shall bill 11 16 the division for the audit costs. 11 17 4. The remainder of the appropriation in this section 11 18 following the allocations made in subsections 2 and 3, shall 11 19 be used to help eligible households as defined in 42 U.S.C., 11 20 chapter 94, subchapter II, to meet home energy costs. 11 21 5. Not more than 10 percent of the amount appropriated in 11 22 this section that is actually received, may be carried forward 11 23 for use in the succeeding federal fiscal year. 11 24 6. Expenditures for assessment and resolution of energy 11 25 problems shall be limited to 5 percent of the amount 11 26 appropriated in this section that is actually received. 11 27 Sec. 12. SOCIAL SERVICES APPROPRIATIONS. 11 28 1. There is appropriated from the fund created by section 11 29 8.41 to the department of human services for the federal 11 30 fiscal year beginning October 1, 2001, and ending September 11 31 30, 2002, the following amount: 11 32 .................................................. $ 18,531,000 11 33 Funds appropriated in this subsection are the funds 11 34 anticipated to be received from the federal government for the 11 35 designated federal fiscal year under 42 U.S.C., chapter 7, 12 1 subchapter XX, which provides for the social services block 12 2 grant. The department of human services shall expend the 12 3 funds appropriated in this subsection as provided in the 12 4 federal law making the funds available and in conformance with 12 5 chapter 17A. 12 6 2. Not more than $1,178,341 of the funds appropriated in 12 7 subsection 1 shall be used by the department of human services 12 8 for general administration. From the funds set aside in this 12 9 subsection for general administration, the department of human 12 10 services shall pay to the auditor of state an amount 12 11 sufficient to pay the cost of auditing the use and 12 12 administration of the state's portion of the funds 12 13 appropriated in subsection 1. 12 14 3. In addition to the allocation for general 12 15 administration in subsection 2, the remaining funds 12 16 appropriated in subsection 1 shall be allocated in the 12 17 following amounts to supplement appropriations for the federal 12 18 fiscal year beginning October 1, 2001, for the following 12 19 programs within the department of human services: 12 20 a. Child and family services: 12 23 .................................................. $ 1,054,155 12 24 c. Local administrative costs and other local services: 12 25 .................................................. $ 747,438 12 26 d. Volunteers: 12 27 .................................................. $ 81,688 12 28 e. Community-based services: 12 29 .................................................. $ 93,940 12 30 f. MH/MR/DD/BI community service (local purchase): 12 31 .................................................. $ 8,327,647 12 32 Sec. 13. SOCIAL SERVICES BLOCK GRANT PLAN. The department 12 33 of human services during each state fiscal year shall develop 12 34 a plan for the use of federal social services block grant 12 35 funds for the subsequent state fiscal year. 13 1 The proposed plan shall include all programs and services 13 2 at the state level which the department proposes to fund with 13 3 federal social services block grant funds, and shall identify 13 4 state and other funds which the department proposes to use to 13 5 fund the state programs and services. 13 6 The proposed plan shall also include all local programs and 13 7 services which are eligible to be funded with federal social 13 8 services block grant funds, the total amount of federal social 13 9 services block grant funds available for the local programs 13 10 and services, and the manner of distribution of the federal 13 11 social services block grant funds to the counties. The 13 12 proposed plan shall identify state and local funds which will 13 13 be used to fund the local programs and services. 13 14 The proposed plan shall be submitted with the department's 13 15 budget requests to the governor and the general assembly. 13 16 Sec. 14. PROJECTS FOR ASSISTANCE IN TRANSITION FROM 13 17 HOMELESSNESS. Upon receipt of the minimum formula grant from 13 18 the federal alcohol, drug abuse, and mental health 13 19 administration to provide mental health services for the 13 20 homeless, for the federal fiscal year beginning October 1, 13 21 2001, and ending September 30, 2002, the division of mental 13 22 health and developmental disabilities of the department of 13 23 human services shall assure that a project which receives 13 24 funds under the formula grant from either the federal or local 13 25 match share of 25 percent in order to provide outreach 13 26 services to persons who are chronically mentally ill and 13 27 homeless or who are subject to a significant probability of 13 28 becoming homeless shall do all of the following: 13 29 1. Provide community mental health services, diagnostic 13 30 services, crisis intervention services, and habilitation and 13 31 rehabilitation services. 13 32 2. Refer clients to medical facilities for necessary 13 33 hospital services, and to entities that provide primary health 13 34 services and substance abuse services. 13 35 3. Provide appropriate training to persons who provide 14 1 services to persons targeted by the grant. 14 2 4. Provide case management to homeless persons. 14 3 5. Provide supportive and supervisory services to certain 14 4 homeless persons living in residential settings which are not 14 5 otherwise supported. 14 6 6. Projects may expend funds for housing services 14 7 including minor renovation, expansion and repair of housing, 14 8 security deposits, planning of housing, technical assistance 14 9 in applying for housing, improving the coordination of housing 14 10 services, the costs associated with matching eligible homeless 14 11 individuals with appropriate housing, and one-time rental 14 12 payments to prevent eviction. 14 13 7. If the department has data indicating that a geographic 14 14 area has a substantial number of persons with mental illness 14 15 who are homeless and are not being served by an existing 14 16 grantee for that area under the formula grant and the existing 14 17 grantee has expressed a desire to no longer provide services 14 18 or the grantee's contract was terminated by the department for 14 19 nonperformance, the department shall issue a request for 14 20 proposals to replace the grantee. Otherwise, the department 14 21 shall maximize available funding by continuing to contract to 14 22 the extent possible with those persons who are grantees as of 14 23 the effective date of this subsection. The department shall 14 24 issue a request for proposals if additional funding becomes 14 25 available for expansion to persons who are not being served 14 26 and it is not possible to utilize existing grantees. 14 27 Sec. 15. CHILD CARE AND DEVELOPMENT APPROPRIATION. There 14 28 is appropriated from the fund created by section 8.41 to the 14 29 department of human services for the federal fiscal year 14 30 beginning October 1, 2001, and ending September 30, 2002, the 14 31 following amount: 14 32 .................................................. $ 39,478,642 14 33 Funds appropriated in this section are the funds 14 34 anticipated to be received from the federal government under 14 35 42 U.S.C., chapter 105, subchapter II-B, which provides for 15 1 the child care and development block grant. The department 15 2 shall expend the funds appropriated in this section as 15 3 provided in the federal law making the funds available and in 15 4 conformance with chapter 17A. 15 5 Sec. 16. PROCEDURE FOR REDUCED FEDERAL FUNDS. 15 6 1. If the funds received from the federal government for 15 7 the block grants specified in this Act are less than the 15 8 amounts appropriated, the funds actually received shall be 15 9 prorated by the governor for the various programs, other than 15 10 for the services to victims of sex offenses and for rape 15 11 prevention education under section 4, subsection 2, of this 15 12 Act, for which each block grant is available according to the 15 13 percentages that each program is to receive as specified in 15 14 this Act. However, if the governor determines that the funds 15 15 allocated by the percentages will not be sufficient to effect 15 16 the purposes of a particular program, or if the appropriation 15 17 is not allocated by percentage, the governor may allocate the 15 18 funds in a manner which will effect to the greatest extent 15 19 possible the purposes of the various programs for which the 15 20 block grants are available. 15 21 2. Before the governor implements the actions provided for 15 22 in subsection 1, the following procedures shall be taken: 15 23 a. The chairpersons and ranking members of the senate and 15 24 house standing committees on appropriations, the appropriate 15 25 chairpersons and ranking members of subcommittees of those 15 26 committees, the director of the legislative service bureau, 15 27 and the director of the legislative fiscal bureau shall be 15 28 notified of the proposed action. 15 29 b. The notice shall include the proposed allocations, and 15 30 information on the reasons why particular percentages or 15 31 amounts of funds are allocated to the individual programs, the 15 32 departments and programs affected, and other information 15 33 deemed useful. Chairpersons notified shall be allowed at 15 34 least two weeks to review and comment on the proposed action 15 35 before the action is taken. 16 1 3. If the amount of moneys received from the federal 16 2 government for a specific grant number specified in this Act 16 3 is less than the amount appropriated, the amount appropriated 16 4 shall be reduced accordingly. An annual report listing any 16 5 such appropriation reduction shall be submitted to the fiscal 16 6 committee of the legislative council. 16 7 Sec. 17. PROCEDURE FOR INCREASED FEDERAL FUNDS. 16 8 1. If funds received from the federal government in the 16 9 form of block grants exceed the amounts appropriated in 16 10 sections 1, 2, 3, 4, 5, 7, 10, and 12 of this Act, the excess 16 11 shall be prorated to the appropriate programs according to the 16 12 percentages specified in those sections, except additional 16 13 funds shall not be prorated for administrative expenses. 16 14 2. If actual funds received from the federal government 16 15 from block grants exceed the amount appropriated in section 11 16 16 of this Act for the low-income home energy assistance program, 16 17 not more than 15 percent of the excess may be allocated to the 16 18 low-income residential weatherization program and not more 16 19 than 5 percent of the excess may be used for administrative 16 20 costs. 16 21 3. If funds received from the federal government from 16 22 community services block grants exceed the amount appropriated 16 23 in section 9 of this Act, 100 percent of the excess is 16 24 allocated to the community services block grant program. 16 25 4. If the amount of moneys received from the federal 16 26 government for a specific grant number specified in this Act 16 27 exceeds the amount appropriated, the excess amount is 16 28 appropriated for the purpose designated in the specific 16 29 grant's appropriation. An annual report listing any such 16 30 excess appropriations shall be submitted to the fiscal 16 31 committee of the legislative council. 16 32 Sec. 18. PROCEDURE FOR EXPENDITURE OF ADDITIONAL FEDERAL 16 33 FUNDS. If other federal grants, receipts, and funds and other 16 34 nonstate grants, receipts, and funds become available or are 16 35 awarded which are not available or awarded during the period 17 1 in which the general assembly is in session, but which require 17 2 expenditure by the applicable department or agency prior to 17 3 March 15 of the fiscal year beginning July 1, 2001, and ending 17 4 June 30, 2002, these grants, receipts, and funds are 17 5 appropriated to the extent necessary, provided that the fiscal 17 6 committee of the legislative council is notified within thirty 17 7 days of receipt of the grants, receipts, or funds and the 17 8 fiscal committee of the legislative council has an opportunity 17 9 to comment on the expenditure of the grants, receipts, or 17 10 funds. 17 11 Sec. 19.
