  1  1    Section 1.  Section 80.8, Code 2001, is amended to read as
  1  2 follows:
  1  3    80.8  PATROL MEMBERS PEACE OFFICERS AND EMPLOYEES –
  1  4 SALARIES.
  1  5    The commissioner of public safety, with the approval of the
  1  6 governor, shall appoint such deputies, inspectors, officers,
  1  7 clerical workers and other employees as may be required to
  1  8 properly discharge the duties of this department.
  1  9    The commissioner may delegate to the members of the Iowa
  1 10 state patrol peace officers of the department such additional
  1 11 duties in the enforcement of this chapter as the commissioner
  1 12 may deem proper and incidental to the duties now imposed upon
  1 13 them by law.
  1 14    The salaries of all members and employees of the department
  1 15 and the expenses of the department shall be provided for by
  1 16 the legislative appropriation therefor.  The compensation of
  1 17 the members of the Iowa state patrol peace officers of the
  1 18 department shall be fixed according to grades as to rank and
  1 19 length of service by the commissioner with the approval of the
  1 20 governor.  The members of the Iowa state patrol peace officers
  1 21 shall be paid additional compensation in accordance with the
  1 22 following formula:  When members of the Iowa state patrol
  1 23 peace officers have served for a period of five years their
  1 24 compensation then being paid shall be increased by the sum of
  1 25 twenty-five dollars per month beginning with the month
  1 26 succeeding the foregoing described five-year period; when
  1 27 members thereof peace officers have served for a period of ten
  1 28 years their compensation then being paid shall be increased by
  1 29 the sum of twenty-five dollars per month beginning with the
  1 30 month succeeding the foregoing described ten-year period, such
  1 31 sums being in addition to the increase provided herein to be
  1 32 paid after five years of service; when members thereof peace
  1 33 officers have served for a period of fifteen years their
  1 34 compensation then being paid shall be increased by the sum of
  1 35 twenty-five dollars per month beginning with the month
  2  1 succeeding the foregoing described fifteen-year period, such
  2  2 sums being in addition to the increases previously provided
  2  3 for herein; when members thereof peace officers have served
  2  4 for a period of twenty years their compensation then being
  2  5 paid shall be increased by the sum of twenty-five dollars per
  2  6 month beginning with the month succeeding the foregoing
  2  7 described twenty-year period, such sums being in addition to
  2  8 the increases previously provided for herein.  While on active
  2  9 duty each member peace officer shall also receive a flat daily
  2 10 sum as fixed by the commissioner with the approval of the
  2 11 governor for meals while away from the office to which the
  2 12 member has been assigned and within the member's district.
  2 13    A collective bargaining agreement entered into between the
  2 14 state and a state employee organization under chapter 20 made
  2 15 final after July 1, 1977, shall not include any pay adjustment
  2 16 to longevity pay authorized under this section.  
  2 17                           EXPLANATION
  2 18    This bill relates to compensation of peace officers
  2 19 employed by the department of public safety.
  2 20    The bill provides that the compensation of each peace
  2 21 officer shall be fixed according to grades as to rank and
  2 22 length of service set by the commissioner with the approval of
  2 23 the governor.  The bill also provides that all peace officers
  2 24 in the department of public safety shall receive longevity
  2 25 pay, in addition to their regular compensation.  Under Code
  2 26 section 80.8, members of the Iowa state patrol receive
  2 27 longevity pay which increases a member's compensation by $25
  2 28 per month based upon years of service.
  2 29    The bill also eliminates the prohibition on bargaining on
  2 30 adjustments to longevity pay in collective bargaining.
  2 31    The bill also provides that each peace officer shall
  2 32 receive a flat daily sum for meals as fixed by the
  2 33 commissioner and approved by the governor.  Current law
  2 34 provides that each member of the Iowa state patrol shall
  2 35 receive a flat daily sum as fixed by the commissioner and
  3  1 approved by the governor for meals while away from the office
  3  2 to which the member has been assigned and within the member's
  3  3 district.
