  1  4 RELATING TO THE AUTHORITY OF THE STATE BOARD OF EDUCATIONAL 
  1  5    EXAMINERS TO DEVELOP A CODE OF PROFESSIONAL RIGHTS AND 
  1  6    RESPONSIBILITIES, PRACTICES, AND ETHICS FOR PRACTITIONERS.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 272.2, subsection 1, Code 2001, is
  1 11 amended to read as follows:
  1 12    1.  License practitioners, who do not hold or receive a
  1 13 license from another professional licensing board, and
  1 14 professional development programs, except for programs
  1 15 developed and offered by practitioner preparation institutions
  1 16 or area education agencies and approved by the state board of
  1 17 education.  Licensing authority includes the authority to
  1 18 establish criteria for the licenses, including but not limited
  1 19 to, issuance and renewal requirements,; creation of
  1 20 application and renewal forms,; creation of licenses that
  1 21 authorize different instructional functions or specialties,;
  1 22 development of a code of professional rights and
  1 23 responsibilities, practice practices, and ethics, which shall,
  1 24 among other things, address the failure of a practitioner to
  1 25 fulfill contractual obligations under section 279.13; and the
  1 26 authority to develop any other classifications, distinctions,
  1 27 and procedures which may be necessary to exercise licensing
  1 28 duties.  A code of professional rights and responsibilities,
  1 29 practice, and ethics shall address but not be limited to the
  1 30 habitual failure of a practitioner to fulfill contractual
  1 31 obligations under section 279.13.  In addressing the failure
  1 32 of a practitioner to fulfill contractual obligations, the
  1 33 board shall consider factors beyond the practitioner's
  1 34 control.
