  1  1    Section 1.  Section 260C.12, unnumbered paragraph 2, Code
  1  2 2001, is amended to read as follows:
  1  3    Members of the board, other than the secretary and the
  1  4 treasurer, shall be allowed their actual expenses incurred in
  1  5 the performance of their duties and may be eligible to receive
  1  6 per diem compensation.  A member of the board, upon written
  1  7 application to the person's employer, shall be granted leaves
  1  8 of absence from regular employment to perform the official
  1  9 duties of the board, except if leaves of absence are
  1 10 prohibited by federal law.  The leaves of absence shall be
  1 11 granted with pay and shall be granted without loss of net
  1 12 accredited service and benefits earned.
  1 13    Sec. 2.  Section 273.8, Code 2001, is amended by adding the
  1 14 following new subsection:
  1 15    NEW SUBSECTION.  8.  DIRECTORS – PAID LEAVE.  A director
  1 16 of the board of the area education agency, upon written
  1 17 application to the person's employer, shall be granted leaves
  1 18 of absence from regular employment to perform the official
  1 19 duties of a director of the board, except if leaves of absence
  1 20 are prohibited by federal law.  The leaves of absence shall be
  1 21 granted with pay and shall be granted without loss of net
  1 22 accredited service and benefits earned.
  1 23    Sec. 3.  Section 279.32, unnumbered paragraph 2, Code 2001,
  1 24 is amended to read as follows:
  1 25    Actual and necessary expenses, including travel, incurred
  1 26 by the board or individual members thereof in the performance
  1 27 of official duties may be paid or reimbursed.  A member of the
  1 28 board, upon written application to the person's employer,
  1 29 shall be granted leaves of absence from regular employment to
  1 30 perform the official duties of a member of the board, except
  1 31 if leaves of absence are prohibited by federal law.  The
  1 32 leaves of absence shall be granted with pay and shall be
  1 33 granted without loss of net accredited service and benefits
  1 34 earned.  
  1 35                           EXPLANATION
  2  1    This bill provides that members of local school boards,
  2  2 area education agency boards, or community college boards must
  2  3 be granted paid leaves of absence by their employers upon
  2  4 written application for the time that they are absent from
  2  5 work while performing the official duties of a board member,
  2  6 unless leaves of absence are prohibited by federal law.
  2  7 Currently, members of some boards are entitled to leaves of
  2  8 absence which may be without pay, upon application to that
  2  9 person's employer, pursuant to Code chapter 55.
