PAG LIN 1 1 SENATE FILE 198 1 2 1 3 AN ACT 1 4 RELATING TO FAMILY INVESTMENT PROGRAM REQUIREMENTS REGARDING 1 5 THE TIME PERIOD ALLOWED FOR SUPPORTED POSTSECONDARY EDUCATION 1 6 ASSISTANCE AND INCLUDING AN APPLICABILITY PROVISION. 1 7 1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 9 1 10 Section 1. Section 239B.8, Code 2001, is amended by adding 1 11 the following new subsection: 1 12 NEW SUBSECTION. 7. POSTSECONDARY EDUCATION. For family 1 13 investment agreements entered into on or after July 1, 1996, 1 14 the maximum allowable time period for supported postsecondary 1 15 education is limited to a total of twenty-four months. The 1 16 twenty-four-month allowance shall only be available for a 1 17 period of forty-eight consecutive months. 1 18 Sec. 2. AGREEMENTS IN EFFECT. This Act applies 1 19 prospectively to family investment agreements entered into on 1 20 or after July 1, 2001, and retrospectively to family 1 21 investment agreements containing postsecondary education 1 22 provisions in effect on July 1, 2001, that were entered into 1 23 before that date. The department of human services shall 1 24 amend those agreements subject to retrospective applicability 1 25 as necessary to apply the twenty-four-month maximum allowance 1 26 within a period of forty-eight consecutive months as 1 27 authorized by this Act. 1 28 1 29 1 30 1 31 MARY E.
