  1  1    Section 1.  Section 256.7, Code 2001, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  25.  Prescribe standards and procedures
  1  4 for the approval of six-week and twelve-week nontraditional
  1  5 practitioner preparation instruction programs offered by
  1  6 practitioner preparation institutions and area education
  1  7 agencies in this state in accordance with section 272.2,
  1  8 subsection 13.
  1  9    Sec. 2.  Section 256.16, Code 2001, is amended by adding
  1 10 the following new subsection:
  1 11    NEW SUBSECTION.  3.  Pursuant to section 256.7, subsection
  1 12 25, the state board shall adopt rules requiring all higher
  1 13 education institutions providing practitioner preparation to
  1 14 offer six-week and twelve-week nontraditional practitioner
  1 15 preparation instruction programs that, at a minimum, meet the
  1 16 requirements of subsection 1, paragraphs "b" and "c".
  1 17    Sec. 3.  Section 272.1, Code 2001, is amended by adding the
  1 18 following new subsection:
  1 19    NEW SUBSECTION.  3A.  "Conditional license" means the
  1 20 authority that is given to allow a person to legally serve as
  1 21 a practitioner on a temporary basis or while the person
  1 22 completes a practitioner preparation program.
  1 23    Sec. 4.  Section 272.2, subsection 13, Code 2001, is
  1 24 amended to read as follows:
  1 25    13.  Adopt rules to provide for nontraditional preparation
  1 26 and licensing options for licensing persons who hold, at a
  1 27 minimum, a bachelor's degree from an accredited college or
  1 28 university, but who do not meet other requirements for
  1 29 licensure.  The rules shall provide for the following:
  1 30    a.  An individual who possesses a master's or doctorate
  1 31 degree may be issued a conditional license to teach at the
  1 32 secondary level in the field or subject area for which the
  1 33 degree was issued if the individual successfully completes a
  1 34 six-week nontraditional practitioner preparation instruction
  1 35 in accordance with section 256.7, subsection 25.
  2  1    b.  An individual who possesses a bachelor's degree may be
  2  2 issued a conditional license to teach at the secondary level
  2  3 in the field or subject area for which the degree was issued
  2  4 if the individual successfully completes a twelve-week
  2  5 nontraditional practitioner preparation instruction in
  2  6 accordance with section 256.7, subsection 25.
  2  7    c.  An individual who is a skilled technician may be issued
  2  8 a conditional license or endorsement to teach at the secondary
  2  9 level in the field or subject area for which the individual
  2 10 has received a certificate, diploma, associate of science, or
  2 11 associate of applied science degree.  However, the individual
  2 12 shall successfully complete a twelve-week nontraditional
  2 13 practitioner preparation instruction in accordance with
  2 14 section 256.7, subsection 25, prior to teaching, and shall
  2 15 meet or exceed the requirements contained in rules adopted
  2 16 under this chapter for an unconditional license or endorsement
  2 17 within two years.  For purposes of this paragraph, "skilled
  2 18 technician" means a person who has successfully completed a
  2 19 credit career, vocational, or technical education program
  2 20 resulting in the conferring of a certificate, diploma,
  2 21 associate of science degree, or associate of applied science
  2 22 degree from a community college.
  2 23    Sec. 5.  Section 272.8, unnumbered paragraph 1, Code 2001,
  2 24 is amended to read as follows:
  2 25    The Notwithstanding section 272.6, subsection 3, the board
  2 26 may issue a license to an applicant from another state or
  2 27 country if the applicant files evidence of that the possession
  2 28 of the required or equivalent requirements with the board
  2 29 applicant has a record of a minimum of one year of successful,
  2 30 nonprobationary teaching practice at a public school or an
  2 31 accredited nonpublic school.  The executive director of the
  2 32 board may, subject to board approval, enter into reciprocity
  2 33 agreements with another state or country for the licensing of
  2 34 practitioners on an equitable basis of mutual exchange, when
  2 35 the action is in conformity with law.
  3  1    Sec. 6.  Section 280.14, Code 2001, is amended to read as
  3  2 follows:
  3  3    280.14  SCHOOL REQUIREMENTS.
  3  4    1.  The board or governing authority of each school or
  3  5 school district subject to the provisions of this chapter
  3  6 shall establish and maintain adequate administration, school
  3  7 staffing, personnel assignment policies, teacher
  3  8 qualifications, certification requirements, facilities,
  3  9 equipment, grounds, graduation requirements, instructional
  3 10 requirements, instructional materials, maintenance procedures
  3 11 and policies on extracurricular activities.  In addition the
  3 12 board or governing authority of each school or school district
  3 13 shall provide such principals as it finds necessary to provide
  3 14 effective supervision and administration for each school and
  3 15 its faculty and student body.  An individual who is employed
  3 16 or contracted as a superintendent by a school or school
  3 17 district may also serve as an elementary principal in the same
  3 18 school or school district.
  3 19    2.  The board of directors of a school district and the
  3 20 governing authority of an accredited nonpublic school shall
  3 21 employ an individual licensed under the provisions of section
  3 22 272.2, subsection 13, paragraphs "a" through "c", only if the
  3 23 board or the authorities have made a good faith effort to
  3 24 employ in the position a teacher who possesses an
  3 25 unconditional license or an endorsement in accordance with
  3 26 chapter 272.  
  3 27                           EXPLANATION 
  3 28    This bill directs the state board of education to prescribe
  3 29 standards and procedures for the approval of six-week and 12-
  3 30 week nontraditional practitioner preparation instruction
  3 31 programs, allows the conditional licensure of individuals who
  3 32 have not completed a practitioner preparation program, allows
  3 33 licensure of an out-of-state teacher if the teacher has a
  3 34 record of one year of successful teaching experience, and
  3 35 permits a school to hire a conditionally licensed individual
  4  1 if the school has made a good faith effort to hire an
  4  2 unconditionally licensed teacher.
  4  3    The bill defines "conditional license" as the authority
  4  4 given to allow a person to serve as a practitioner on a
  4  5 temporary basis or while the person completes a practitioner
  4  6 preparation program.
  4  7    The bill also directs the board of educational examiners to
  4  8 adopt rules to provide for nontraditional licensing options
  4  9 that provide a means of conditionally licensing an individual
  4 10 who possesses a master's degree, a bachelor's degree, or who
  4 11 is a skilled technician who possesses a certificate, diploma,
  4 12 or associate degree from a community college.  Such a person
  4 13 can only teach at the secondary level in the field or subject
  4 14 area for which the degree was issued.  A person holding a
  4 15 master's degree must successfully complete a six-week approved
  4 16 nontraditional practitioner preparation instruction program;
  4 17 while a person with a bachelor's degree, associate degree,
  4 18 certificate, or diploma must complete a 12-week program.  A
  4 19 skilled technician must also meet or exceed the requirements
  4 20 for an unconditional license or endorsement within two years.
