  1  1    Section 1.  Section 708.1, subsection 2, Code 2001, is
  1  2 amended to read as follows:
  1  3    2.  Any act which is intended to place another in fear of
  1  4 immediate imminent physical contact which will be painful,
  1  5 injurious, insulting, or offensive, coupled with the apparent
  1  6 ability to execute the act.  
  1  7                           EXPLANATION
  1  8    This bill amends the definition of assault contained in
  1  9 Code section 708.1 by changing the phrase "place another in
  1 10 fear of immediate physical contact" to "place another in fear
  1 11 of imminent physical contact".
