PAG LIN 1 1 SENATE CONCURRENT RESOLUTION NO. ____ 1 2 BY KING, McKINLEY, BEHN, VEENSTRA, RITTMER, JENSEN, 1 3 DRAKE, ZIEMAN, REHBERG, ANGELO, JOHNSON, LAMBERTI, 1 4 FREEMAN, McKEAN, MILLER, McKIBBEN, SEXTON, GASKILL, 1 5 REDWINE, SCHUERER, IVERSON, KRAMER, McLAREN, BOETTGER, 1 6 MADDOX, and KIBBIE 1 7 A Concurrent Resolution to call upon the President and 1 8 the Congress of the United States to intervene on 1 9 behalf of the cattle industry in Iowa prior to the 1 10 United States Environmental Protection Agency's 1 11 implementation of the agency's interpretation of the 1 12 1972 Clean Water Act. 1 13 WHEREAS, the United States Environmental Protection 1 14 Agency has aggressively interpreted the provisions of 1 15 the 1972 Clean Water Act; and 1 16 WHEREAS, input at the public hearings held by the 1 17 Environmental Protection Agency on the agency's 1 18 proposed interpretation and implementation of the 1972 1 19 Clean Water Act makes it clear that the Iowa cattle 1 20 industry is threatened by the agency's proposed 1 21 interpretation and implementation of the 1972 Clean 1 22 Water Act; and 1 23 WHEREAS, enforcement of total containment 1 24 provisions of the 1972 Clean Water Act for open 1 25 feedlots in Iowa is causing a tremendous amount of 1 26 fear and uncertainty among Iowa's 13,300 feedlot 1 27 owners as to whether their operations can afford to 1 28 comply either physically or financially with the law; 1 29 and 1 30 WHEREAS, this uncertainty is causing feedlot owners 2 1 to halt the purchase of feedlot equipment and 2 2 improvements, creating an immediate impact on Iowa's 2 3 economy; and 2 4 WHEREAS, enforcement of total containment 2 5 provisions of the 1972 Clean Water Act for open 2 6 feedlots discriminates against the feedlot industry in 2 7 Iowa and other states with higher average rainfall, 2 8 placing a severe economic burden on feedlots trying to 2 9 come in compliance with the Act; and 2 10 WHEREAS, these provisions will demand the creation 2 11 of hundreds of new lagoons in Iowa along with the 2 12 expensive equipment required to dewater these lagoons; 2 13 and 2 14 WHEREAS, the uncertainty of the future of many Iowa 2 15 feedlots due to these regulations will affect the 2 16 plans for promoting and advancing value-added 2 17 agriculture related to the beef industry; and 2 18 WHEREAS, there are currently no cost-share programs 2 19 available for feedlots over 1,000 head and limited 2 20 funds available for smaller feedlots, therefore 2 21 placing undue hardship on Iowa feedlot operators to 2 22 make the necessary changes to comply with the 2 23 Environmental Protection Agency's zero discharge 2 24 standard; and 2 25 WHEREAS, the Environmental Protection Agency's 2 26 proposed interpretation and implementation of the 1972 2 27 Clean Water Act also threatens and impacts wet-mill 2 28 ethanol plants that are currently being planned and 2 29 constructed; and 2 30 WHEREAS, the cattle industry is vital to the food 3 1 supply of America; and 3 2 WHEREAS, the cattle industry is vital to the 3 3 economic well-being of Iowans; NOW THEREFORE, 3 4 BE IT RESOLVED BY THE SENATE, THE HOUSE OF 3 5 REPRESENTATIVES CONCURRING, That the Iowa General 3 6 Assembly calls upon the President of the United 3 7 States, the Director of the United States 3 8 Environmental Protection Agency, and the Congress of 3 9 the United States to intervene on behalf of the cattle 3 10 industry in Iowa to allow alternative technologies to 3 11 be used, instead of the total containment requirement 3 12 of the Environmental Protection Agency's open feedlot 3 13 regulations, as well as to provide cost-share programs 3 14 available for construction related to compliance. 3 15 BE IT FURTHER RESOLVED, That the Secretary of the 3 16 Senate, upon passage of this resolution, shall send 3 17 copies of the resolution to the President of the 3 18 United States, the President of the United States 3 19 Senate, the Speaker of the United States House of 3 20 Representatives, the Director of the United States 3 21 Environmental Protection Agency, and all members of 3 22 Iowa's congressional delegation. 3 23 LSB 3415XS 79 3 24 av/cls/14.1
