  1  3 A Concurrent Resolution requesting that the President
  1  4    of the United States, the United States Congress,
  1  5    and the United States Department of Agriculture
  1  6    reconsider and revise proposed rule exceptions to the
  1  7    Livestock Mandatory Reporting Act of 1999.
  1  8    WHEREAS, enactment of the federal Livestock
  1  9 Mandatory Reporting Act of 1999 represents one of the
  1 10 most important livestock market reforms since passage
  1 11 of the Packers and Stockyard Act of 1921; and
  1 12    WHEREAS, implementation of mandatory price
  1 13 reporting is necessary to restore transparency to
  1 14 livestock markets increasingly dominated by direct
  1 15 marketing and integrated production systems; and
  1 16    WHEREAS, a rule proposed by the United States
  1 17 Department of Agriculture whereby the department would
  1 18 not publish prices in reporting regions where three or
  1 19 fewer packers report prices on any given day or where
  1 20 a single packer represents 60 percent or more of
  1 21 purchases reported in a given region would seriously
  1 22 undermine both the intent and effectiveness of
  1 23 mandatory price reporting; and
  1 24    WHEREAS, implementation of this rule will likely
  1 25 result in large gaps in market price information,
  1 26 contrary to one of the primary purposes of the
  1 27 Livestock Mandatory Reporting Act, which is intended
  1 28 to check the monopolistic opportunities of packers
  1 29 which dominate regional markets; and
  1 30    WHEREAS, the United States Department of
  2  1 Agriculture's proposed rule fails to disclose the
  2  2 extent of volume premiums paid by packers to large
  2  3 volume producers and such price discrimination
  2  4 threatens the survival of moderate-size independent
  2  5 producers; and
  2  6    WHEREAS, moderate-size independent producers need
  2  7 information on the extent of such premiums to
  2  8 strengthen their marketing position and policymakers
  2  9 need information on such premiums to determine an
  2 10 appropriate policy response; NOW THEREFORE,
  2 11    BE IT RESOLVED BY THE SENATE, THE HOUSE OF
  2 12 REPRESENTATIVES CONCURRING, That the Iowa General
  2 13 Assembly urges the President of the United States, the
  2 14 Congress of the United States, and the United States
  2 15 Department of Agriculture to reconsider and revise the
  2 16 department's proposed rule, with the purpose of making
  2 17 available the most market information possible, and to
  2 18 provide for public reporting of volume premiums
  2 19 offered to large producers.
  2 20    BE IT FURTHER RESOLVED, That a copy of this
  2 21 Resolution be sent by the Secretary of the Senate to
  2 22 the President of the United States, the President of
  2 23 the United States Senate, the Speaker of the United
  2 24 States House of Representatives, and members of Iowa's
  2 25 congressional delegation.
