  1  1    Amend the amendment, S-5437, to Senate File 2293,
  1  2 as follows:
  1  3    #1.  Page 36, by striking lines 10 through 12, and
  1  4 inserting the following:  "the plan shall not be
  1  5 subject to an enforcement action other than limited to
  1  6 one of the following:
  1  7    a.  The assessment of a civil penalty pursuant to
  1  8 section 455B.191.
  1  9    b.  The invalidity of the manure management plan or
  1 10 the imposition of any probationary term required as a
  1 11 condition for the continued validity of the manure
  1 12 management plan.  The department may require that the
  1 13 person amend the manure management plan in a manner
  1 14 that is more stringent than otherwise required under
  1 15 this section, for the duration of the probationary
  1 16 period."
  1 17    #2.  By renumbering as necessary.
