  1  1    Amend the House amendment, S-5272, to Senate File
  1  2 2190, as amended, passed, and reprinted by the Senate,
  1  3 as follows:
  1  4    #1.  Page 2, by inserting after line 45 the
  1  5 following:
  1  6    "#   .  Page 3, by inserting before line 7 the
  1  7 following:
  1  8    "Sec.    .  Section 85.39, unnumbered paragraph 2,
  1  9 Code 2001, is amended to read as follows:
  1 10    If an evaluation of permanent disability
  1 11 examination has been made by a physician retained by
  1 12 the employer and the employee believes this evaluation
  1 13 to be too low that any opinion rendered as the result
  1 14 of the examination and affecting benefits entitlement
  1 15 is incorrect, the employee shall, upon application to
  1 16 the commissioner and upon delivery of a copy of the
  1 17 application to the employer and its insurance carrier,
  1 18 be reimbursed by the employer the reasonable fee for a
  1 19 subsequent examination by a physician of the
  1 20 employee's own choice, and reasonably necessary
  1 21 transportation expenses incurred for the examination.
  1 22 The physician chosen by the employee has the right to
  1 23 confer with and obtain from the employer-retained
  1 24 physician sufficient history of the injury to make a
  1 25 proper examination.  This paragraph applies regardless
  1 26 of whether or not the employer denies or accepts
  1 27 liability for benefits.""
