PAG LIN 1 1 Amend House File 643, as amended, passed, and 1 2 reprinted by the House, as follows: 1 3 #1. Page 8, by inserting after line 14 the 1 4 following: 1 5 "Sec. 100. Section 403.19, subsections 2 and 5, 1 6 Code 2001, are amended to read as follows: 1 7 2. That portion of the taxes each year in excess 1 8 of such amount shall be allocated to and when 1 9 collected be paid into a special fund of the 1 10 municipality to pay the principal of and interest on 1 11 loans, moneys advanced to, or indebtedness, whether 1 12 funded, refunded, assumed, or otherwise, including 1 13 bonds issued under the authority of section 403.9, 1 14 subsection 1, incurred by the municipality to finance 1 15 or refinance, in whole or in part, an urban renewal 1 16 project within the area, and to provide assistance for 1 17 low and moderate income family housing as provided in 1 18 section 403.22, except that taxes for the regular and 1 19 voter-approved physical plant and equipment levy of a 1 20 school district imposed pursuant to section 298.2 and 1 21 taxes for the payment of bonds and interest of each 1 22 taxing district must be collected against all taxable 1 23 property within the taxing district without limitation 1 24 by the provisions of this subsection. However, all or 1 25 a portion of the taxes for the physical plant and 1 26 equipment levy shall be paid by the school district to 1 27 the municipality if themunicipalityauditor 1 28 certifies, as provided in subsection 5, paragraph "b", 1 29 to the school district by July 1 the amount of such 1 30 levy that is necessary to pay the principal and 1 31 interest onindebtedness incurredbonds issued by the 1 32 municipality to finance an urban renewal project, 1 33 whichindebtedness was incurredbonds were issued 1 34 before July 1, 2000. Such school district shall pay 1 35 over the amount certified by November 1 following 1 36 certification to the school district. Unless and 1 37 until the total assessed valuation of the taxable 1 38 property in an urban renewal area exceeds the total 1 39 assessed value of the taxable property in such area as 1 40 shown by the last equalized assessment roll referred 1 41 to in subsection 1, all of the taxes levied and 1 42 collected upon the taxable property in the urban 1 43 renewal area shall be paid into the funds for the 1 44 respective taxing districts as taxes by or for the 1 45 taxing districts in the same manner as all other 1 46 property taxes. When such loans, advances, 1 47 indebtedness, and bonds, if any, and interest thereon, 1 48 have been paid, all moneys thereafter received from 1 49 taxes upon the taxable property in such urban renewal 1 50 area shall be paid into the funds for the respective 2 1 taxing districts in the same manner as taxes on all 2 2 other property. 2 3 5. a. A municipality shall certify to the county 2 4 auditor on or before December 1 the following amounts: 2 5 (1) The amount of loans, advances, indebtedness, 2 6 or bonds which qualify for payment from the special 2 7 fund referred to in subsection 2, and theand 2 8 including the amount certified in subparagraph 2. 2 9 (2) The amount of principal and interest payments 2 10 to be made during the fiscal year on bonds issued 2 11 prior to July 1, 2000, that qualify for payment from 2 12 taxes received from the physical plant and equipment 2 13 levy. Indebtedness issued to refund the bonds issued 2 14 prior to July 1, 2000, shall not be included in this 2 15 separate certification. 2 16 b. The auditor shall certify to the school 2 17 district by July 1 the amount of tax from the physical 2 18 plant and equipment levy that shall be paid to the 2 19 municipality as follows: 2 20 (1) If the amount in the special fund referred to 2 21 in subsection 2, is less than the amount certified by 2 22 the municipality in paragraph "a", subparagraph (2), 2 23 determined before any other payments for loans, 2 24 advances, indebtedness, or bonds are to be made, the 2 25 amount to be certified by the auditor to the school 2 26 district is the difference. 2 27 (2) If the amount in the special fund referred to 2 28 in subsection 2, is equal to or greater than the 2 29 amount certified by the municipality in paragraph "a", 2 30 subparagraph (2), determined before any other payments 2 31 for loans, advances, indebtedness, or bonds are to be 2 32 made, the amount to be certified by the auditor to the 2 33 school district is zero. 2 34 c. The filing of the certificate in paragraph "a", 2 35 subparagraph (1), shall make it a duty of the auditor 2 36 to provide for the division of taxes in each 2 37 subsequent year until the amount of the loans, 2 38 advances, indebtedness, or bonds is paid to the 2 39 special fund. In any year, the county auditor shall, 2 40 upon receipt of a certified request from a 2 41 municipality filed on or before December 1, increase 2 42 the amount to be allocated under subsection 1 in order 2 43 to reduce the amount to be allocated in the following 2 44 fiscal year to the special fund, to the extent that 2 45 the municipality does not request allocation to the 2 46 special fund of the full portion of taxes which could 2 47 be collected. Upon receipt of a certificate from a 2 48 municipality, the auditor shall mail a copy of the 2 49 certificate to each affected taxing district." 2 50 #2. EFFECTIVE AND APPLICABILITY DATES. 3 3 Section 100 of this Act, relating to the physical 3 4 plant and equipment levy, being deemed of immediate 3 5 importance, takes effect upon enactment and applies to 3 6 physical plant and equipment taxes collected on or 3 7 after July 1, 2001." 3 8 #3.
