  1  1    Amend House File 637, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 5, by inserting after line 2, the
  1  4 following:
  1  5    "Sec.    .  NEW SECTION.  256.57  ENRICH IOWA
  1  6 PROGRAM FUNDS DISTRIBUTION.
  1  7    1.  An enrich Iowa program is established to
  1  8 provide direct state assistance to eligible public
  1  9 libraries as an incentive to improve library services
  1 10 and reduce inequities among communities in the
  1 11 delivery of library services based on recognized and
  1 12 adopted performance measures.  Funds appropriated by
  1 13 the general assembly for purposes of the enrich Iowa
  1 14 program shall be distributed by the division of
  1 15 libraries and information services to eligible public
  1 16 libraries that are in compliance with performance
  1 17 measures adopted by rule by the commission.  The
  1 18 amount distributed to each eligible public library
  1 19 shall be based upon the following:
  1 20    a.  The level of compliance by the eligible public
  1 21 library with the performance measures adopted by rule
  1 22 by the commission.
  1 23    b.  The number of people residing within an
  1 24 eligible public library's geographic service area for
  1 25 whom the library provides services.
  1 26    c.  The amount of other funding the eligible public
  1 27 library received in the previous fiscal year for
  1 28 providing services to rural residents and to
  1 29 contracting communities.
  1 30    2.  For purposes of this section, "eligible public
  1 31 library" means a public library that meets all of the
  1 32 following requirements:
  1 33    a.  Submits to the division a report in accordance
  1 34 with section 256.51, subsection 1, paragraph "h", an
  1 35 application and accreditation report, in a format
  1 36 approved by the commission, that provides evidence of
  1 37 the library's compliance with at least one level of
  1 38 the standards established in accordance with section
  1 39 256.51, subsection 1, paragraph "k", and any other
  1 40 application or report the division deems necessary for
  1 41 the implementation of the enrich Iowa program.
  1 42    b.  Participates in the library resource and
  1 43 information sharing programs established by the state
  1 44 library.
  1 45    c.  Is a public library established by city
  1 46 ordinance or a library as provided in chapter 336.
  1 47    d.  Has an internet use policy in place, which may
  1 48 or may not include internet filtering, and submits a
  1 49 report describing the library's internet use efforts
  1 50 to the division.
  2  1    3.  Funds appropriated for purposes of the enrich
  2  2 Iowa program shall not be used for the costs of
  2  3 administration by the division.
  2  4    4.  Moneys received by an eligible public library
  2  5 pursuant to this section shall be used to supplement,
  2  6 not supplant, any other funding received by the
  2  7 library.  Each eligible public library shall maintain
  2  8 a separate listing within its budget for payments
  2  9 received and expenditures made pursuant to this
  2 10 section, and shall annually submit the listing to the
  2 11 division."
  2 12    #2.  Page 5, by striking line 7, and inserting the
  2 13 following:  "A regional library system is Library
  2 14 service areas are".
  2 15    #3.  Page 8, by inserting after line 9, the
  2 16 following:
  2 17    "Sec.    .  Section 256.66, Code 2001, is amended
  2 18 by adding the following new subsection:
  2 19    NEW SUBSECTION.  14.  Shall assume all of the
  2 20 outstanding obligations of the regional library and be
  2 21 liable for and recognize, assume, and carry out all
  2 22 valid contracts and obligations of the regional
  2 23 library that the library service area replaces.  Each
  2 24 regional library in existence prior to July 1, 2001,
  2 25 shall transfer its assets and title to any real estate
  2 26 owned by the regional library to the library service
  2 27 area that replaces the regional library."
  2 28    #4.  Page 16, by inserting after line 11, the
  2 29 following:
  2 30    "Sec.    .  Section 669.2, subsection 5, Code 2001,
  2 31 is amended to read as follows:
  2 32    5.  "State agency" includes all executive
  2 33 departments, agencies, boards, bureaus, and
  2 34 commissions of the state of Iowa, and corporations
  2 35 whose primary function is to act as, and while acting
  2 36 as, instrumentalities or agencies of the state of
  2 37 Iowa, whether or not authorized to sue and be sued in
  2 38 their own names.  This definition does not include a
  2 39 contractor with the state of Iowa.  Soil and water
  2 40 conservation districts as defined in section 161A.3,
  2 41 subsection 6, judicial district departments of
  2 42 correctional services as established in section 905.2,
  2 43 and regional library service area boards of library
  2 44 trustees as defined established in chapter 256, are
  2 45 state agencies for purposes of this chapter.
  2 46    Sec.    .  DEPARTMENT OF MANAGEMENT STUDY.  The
  2 47 department of management shall coordinate a study of
  2 48 city and county support of public library funding.
  2 49 The department, in cooperation with the commission of
  2 50 libraries, the Iowa league of cities, and the Iowa
  3  1 state association of counties, shall determine whether
  3  2 cities and counties are in compliance with section
  3  3 256.69 requirements for support of public libraries,
  3  4 identify inequities between city and county funding,
  3  5 and determine the adequacy of the current minimum
  3  6 levy.  The department shall develop a plan to provide
  3  7 those support functions and services more effectively
  3  8 and efficiently.  The department shall submit a report
  3  9 of its findings and recommendations to the
  3 10 chairpersons and ranking members of the senate and
  3 11 house standing committees on education and the joint
  3 12 appropriations subcommittee on education."
