  1  1    Amend House File 324, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 23, by inserting after line 23 the
  1  4 following:
  1  5    "Sec.    .  Section 314.2, Code 2001, is amended to
  1  6 read as follows:
  1  7    314.2  INTEREST IN CONTRACT PROHIBITED.
  1  8    No A state or county official or employee, elective
  1  9 or appointive, shall be directly or indirectly
  1 10 interested not have an interest in any a contract for
  1 11 the construction, reconstruction, improvement or
  1 12 maintenance of any highway, bridge, or culvert, or the
  1 13 furnishing of materials therefore under such a
  1 14 contract, at any level of the supply chain.  The
  1 15 letting of a contract in violation of the foregoing
  1 16 provisions this section shall invalidate the contract
  1 17 and such violation shall be a complete defense to any
  1 18 action to recover any consideration due or earned
  1 19 under the contract at the time of its termination.
  1 20 The contracting agency shall take action to recover
  1 21 any moneys paid to a state or county official or
  1 22 employee for services or materials provided in
  1 23 violation of this section.  For purposes of this
  1 24 section, "an interest in a contract" includes a
  1 25 direct, indirect, or any other type of interest in a
  1 26 contract, including the provision of materials for a
  1 27 project that is the subject of a contract, whether
  1 28 such provision is pursuant to subcontract or
  1 29 otherwise."
