  1  4 APPROPRIATING FEDERAL FUNDS MADE AVAILABLE FROM FEDERAL BLOCK
  1  5    GRANTS AND OTHER FEDERAL GRANTS, ALLOCATING PORTIONS OF
  1  6    FEDERAL BLOCK GRANTS, AND PROVIDING PROCEDURES IF FEDERAL
  1  7    FUNDS ARE MORE OR LESS THAN ANTICIPATED OR IF FEDERAL BLOCK
  1  8    GRANTS ARE MORE OR LESS THAN ANTICIPATED.  
  1  9 
  1 10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 11 
  1 12    Section 1.  SUBSTANCE ABUSE APPROPRIATION.
  1 13    1.  There is appropriated from the fund created by section
  1 14 8.41 to the Iowa department of public health for the federal
  1 15 fiscal year beginning October 1, 2002, and ending September
  1 16 30, 2003, the following amount:  
  1 17 .................................................. $ 12,698,390
  1 18    a.  Funds appropriated in this subsection are the
  1 19 anticipated funds to be received from the federal government
  1 20 for the designated federal fiscal year under 42 U.S.C.,
  1 21 chapter 6A, subchapter XVII, which provides for the substance
  1 22 abuse prevention and treatment block grant.  The department
  1 23 shall expend the funds appropriated in this subsection as
  1 24 provided in the federal law making the funds available and in
  1 25 conformance with chapter 17A.
  1 26    b.  Of the funds appropriated in this subsection, an amount
  1 27 not exceeding 5 percent shall be used by the department for
  1 28 administrative expenses.
  1 29    c.  The department shall expend no less than an amount
  1 30 equal to the amount expended for treatment services in the
  1 31 state fiscal year beginning July 1, 2001, for pregnant women
  1 32 and women with dependent children.
  1 33    d.  Of the funds appropriated in this subsection, an amount
  1 34 not exceeding $24,585 shall be used for audits.
  1 35    2.  The funds remaining from the appropriation made in
  2  1 subsection 1 shall be allocated as follows:
  2  2    a.  At least 20 percent of the allocation shall be for
  2  3 prevention programs.
  2  4    b.  At least 35 percent of the allocation shall be spent on
  2  5 drug treatment and prevention activities.
  2  6    c.  At least 35 percent of the allocation shall be spent on
  2  7 alcohol treatment and prevention activities.
  2  8    3.  The substance abuse block grant funds received from the
  2  9 federal government in excess of the amount of the anticipated
  2 10 federal fiscal year 2002-2003 award appropriated in subsection
  2 11 1 shall be distributed at least 50 percent to treatment
  2 12 programs and 50 percent to prevention programs except that,
  2 13 based upon federal guidelines, the total amount of the excess
  2 14 awarded to prevention programs shall not exceed $1,000,000.
  2 15    4.  In implementing the federal substance abuse prevention
  2 16 and treatment block grant under 42 U.S.C., chapter 6A,
  2 17 subchapter XVII, and any other applicable provisions of the
  2 18 federal Public Health Service Act under 42 U.S.C., chapter 6A,
  2 19 subchapter III-A, the department shall apply the provisions of
  2 20 Pub. L. No.  106-310, } 3305, as codified in 42 U.S.C. } 300x-
  2 21 65, relating to services under such federal law being provided
  2 22 by religious and other nongovernmental organizations.
  2 23    Sec. 2.  COMMUNITY MENTAL HEALTH SERVICES APPROPRIATION.
  2 24    1.  a.  There is appropriated from the fund created by
  2 25 section 8.41 to the Iowa department of human services for the
  2 26 federal fiscal year beginning October 1, 2002, and ending
  2 27 September 30, 2003, the following amount:  
  2 28 .................................................. $  3,587,827
  2 29    b.  Funds appropriated in this subsection are the
  2 30 anticipated funds to be received from the federal government
  2 31 for the designated federal fiscal year under 42 U.S.C.,
  2 32 chapter 6A, subchapter XVII, which provides for the community
  2 33 mental health services block grant.  The department shall
  2 34 expend the funds appropriated in this subsection as provided
  2 35 in the federal law making the funds available and in
  3  1 conformance with chapter 17A.
  3  2    c.  The administrator of the division of mental health and
  3  3 developmental disabilities of the department of human services
  3  4 shall allocate not less than 95 percent of the amount of the
  3  5 block grant to eligible community mental health services
  3  6 providers for carrying out the plan submitted to and approved
  3  7 by the federal substance abuse and mental health services
  3  8 administration for the fiscal year involved.
  3  9    2.  An amount not exceeding 5 percent of the funds
  3 10 appropriated in subsection 1 shall be used by the department
  3 11 of human services for administrative expenses.  From the funds
  3 12 set aside by this subsection for administrative expenses, the
  3 13 division of mental health and developmental disabilities shall
  3 14 pay to the auditor of state an amount sufficient to pay the
  3 15 cost of auditing the use and administration of the state's
  3 16 portion of the funds appropriated in subsection 1.  The
  3 17 auditor of state shall bill the division of mental health and
  3 18 developmental disabilities for the costs of the audits.
  3 19    Sec. 3.  MATERNAL AND CHILD HEALTH SERVICES APPROPRIATIONS.
  3 20    1.  There is appropriated from the fund created by section
  3 21 8.41 to the Iowa department of public health for the federal
  3 22 fiscal year beginning October 1, 2002, and ending September
  3 23 30, 2003, the following amount:  
  3 24 .................................................. $  7,016,116
  3 25    The funds appropriated in this subsection are the funds
  3 26 anticipated to be received from the federal government for the
  3 27 designated federal fiscal year under 42 U.S.C., chapter 7,
  3 28 subchapter V, which provides for the maternal and child health
  3 29 services block grant.  The department shall expend the funds
  3 30 appropriated in this subsection as provided in the federal law
  3 31 making the funds available and in conformance with chapter
  3 32 17A.
  3 33    Of the funds appropriated in this subsection, an amount not
  3 34 exceeding $45,700 shall be used for audits.
  3 35    Funds appropriated in this subsection shall not be used by
  4  1 the university of Iowa hospitals and clinics for indirect
  4  2 costs.
  4  3    2.  An amount not exceeding $150,000 of the funds
  4  4 appropriated in subsection 1 to the Iowa department of public
  4  5 health shall be used by the Iowa department of public health
  4  6 for administrative expenses in addition to the amount to be
  4  7 used for audits in subsection 1.
  4  8    The departments of public health, human services, and
  4  9 education and the university of Iowa's mobile and regional
  4 10 child health specialty clinics shall continue to pursue to the
  4 11 maximum extent feasible the coordination and integration of
  4 12 services to women and children.
  4 13    3.  a.  Sixty-three percent of the remaining funds
  4 14 appropriated in subsection 1 shall be allocated to supplement
  4 15 appropriations for maternal and child health programs within
  4 16 the Iowa department of public health.  Of these funds,
  4 17 $284,548 shall be set aside for the statewide perinatal care
  4 18 program.
  4 19    b.  Thirty-seven percent of the remaining funds
  4 20 appropriated in subsection 1 shall be allocated to the
  4 21 university of Iowa hospitals and clinics under the control of
  4 22 the state board of regents for mobile and regional child
  4 23 health specialty clinics.  The university of Iowa hospitals
  4 24 and clinics shall not receive an allocation for indirect costs
  4 25 from the funds for this program.  Priority shall be given to
  4 26 establishment and maintenance of a statewide system of mobile
  4 27 and regional child health specialty clinics.
  4 28    4.  The Iowa department of public health shall administer
  4 29 the statewide maternal and child health program and the
  4 30 crippled children's program by conducting mobile and regional
  4 31 child health specialty clinics and conducting other activities
  4 32 to improve the health of low-income women and children and to
  4 33 promote the welfare of children with actual or potential
  4 34 handicapping conditions and chronic illnesses in accordance
  4 35 with the requirements of Title V of the federal Social
  5  1 Security Act.
  5  2    Sec. 4.  PREVENTIVE HEALTH AND HEALTH SERVICES
  5  3 APPROPRIATIONS.
  5  4    1.  There is appropriated from the fund created by section
  5  5 8.41 to the Iowa department of public health for the federal
  5  6 fiscal year beginning October 1, 2002, and ending September
  5  7 30, 2003, the following amount:  
  5  8 .................................................. $  1,934,758
  5  9    Funds appropriated in this subsection are the funds
  5 10 anticipated to be received from the federal government for the
  5 11 designated federal fiscal year under 42 U.S.C., chapter 6A,
  5 12 subchapter XVII, which provides for the preventive health and
  5 13 health services block grant.  The department shall expend the
  5 14 funds appropriated in this subsection as provided in the
  5 15 federal law making the funds available and in conformance with
  5 16 chapter 17A.
  5 17    Of the funds appropriated in this subsection, an amount not
  5 18 exceeding $5,522 shall be used for audits.
  5 19    2.  Of the funds appropriated in subsection 1, the specific
  5 20 amount of funds stipulated by the notice of the block grant
  5 21 award shall be allocated for services to victims of sex
  5 22 offenses and for rape prevention education.
  5 23    3.  After deducting the funds allocated in subsections 1
  5 24 and 2, an amount not exceeding $94,670 of the remaining funds
  5 25 appropriated in subsection 1 shall be used by the Iowa
  5 26 department of public health for administrative expenses in
  5 27 addition to the amount to be used for audits in subsection 1.
  5 28    4.  After deducting the funds allocated in subsections 1,
  5 29 2, and 3, the remaining funds appropriated in subsection 1
  5 30 shall be used by the department for healthy people
  5 31 2010/healthy Iowans 2010 program objectives, preventive health
  5 32 advisory committee, and risk reduction services, including
  5 33 nutrition programs, health incentive programs, chronic disease
  5 34 services, emergency medical services, monitoring of the
  5 35 fluoridation program and start-up fluoridation grants, and
  6  1 acquired immune deficiency syndrome services.  The moneys
  6  2 specified in this subsection shall not be used by the
  6  3 university of Iowa hospitals and clinics or by the state
  6  4 hygienic laboratory for the funding of indirect costs.  Of the
  6  5 funds used by the department under this subsection, an amount
  6  6 not exceeding $90,000 shall be used for the monitoring of the
  6  7 fluoridation program and for start-up fluoridation grants to
  6  8 public water systems, and an amount not exceeding $50,000
  6  9 shall be used to provide chlamydia testing.
  6 10    Sec. 5.  DRUG CONTROL AND SYSTEM IMPROVEMENT GRANT PROGRAM
  6 11 APPROPRIATION.
  6 12    1.  There is appropriated from the fund created by section
  6 13 8.41 to the office of the governor for the drug policy
  6 14 coordinator for the federal fiscal year beginning October 1,
  6 15 2002, and ending September 30, 2003, the following amount:  
  6 16 .................................................. $  6,473,528
  6 17    Funds appropriated in this subsection are the anticipated
  6 18 funds to be received from the federal government for the
  6 19 designated fiscal year under 42 U.S.C., chapter 46, subchapter
  6 20 V, which provides for the drug control and system improvement
  6 21 grant program.  The drug policy coordinator shall expend the
  6 22 funds appropriated in this subsection as provided in the
  6 23 federal law making the funds available and in conformance with
  6 24 chapter 17A.
  6 25    2.  An amount not exceeding 10 percent of the funds
  6 26 appropriated in subsection 1 shall be used by the drug policy
  6 27 coordinator for administrative expenses.  From the funds set
  6 28 aside by this subsection for administrative expenses, the drug
  6 29 policy coordinator shall pay to the auditor of state an amount
  6 30 sufficient to pay the cost of auditing the use and
  6 31 administration of the state's portion of the funds
  6 32 appropriated in subsection 1.
  6 33    Sec. 6.  STOP VIOLENCE AGAINST WOMEN GRANT PROGRAM
  6 34 APPROPRIATION.
  6 35    1.  There is appropriated from the fund created by section
  7  1 8.41 to the office of the governor for the drug policy
  7  2 coordinator for the federal fiscal year beginning October 1,
  7  3 2002, and ending September 30, 2003, the following amount:  
  7  4 .................................................. $  1,811,502
  7  5    Funds appropriated in this subsection are the anticipated
  7  6 funds to be received from the federal government for the
  7  7 designated fiscal year under 42 U.S.C., chapter 46, subchapter
  7  8 XII-H, which provides for grants to combat violent crimes
  7  9 against women.  The drug policy coordinator shall expend the
  7 10 funds appropriated in this subsection as provided in the
  7 11 federal law making the funds available and in conformance with
  7 12 chapter 17A.
  7 13    2.  An amount not exceeding 5 percent of the funds
  7 14 appropriated in subsection 1 shall be used by the drug policy
  7 15 coordinator for administrative expenses.  From the funds set
  7 16 aside by this subsection for administrative expenses, the drug
  7 17 policy coordinator shall pay to the auditor of the state an
  7 18 amount sufficient to pay the cost of auditing the use and
  7 19 administration of the state's portion of the funds
  7 20 appropriated in subsection 1.
  7 21    3.  If an enactment of the Seventy-ninth General Assembly,
  7 22 2002 Session, transfers responsibility for the stop violence
  7 23 against women grant program to the department of justice, the
  7 24 appropriation made in this section shall be made to the
  7 25 department of justice in lieu of the office of the governor.
  7 26    Sec. 7.  LOCAL LAW ENFORCEMENT BLOCK GRANT APPROPRIATION.
  7 27    1.  There is appropriated from the fund created by section
  7 28 8.41 to the office of the governor for the drug policy
  7 29 coordinator for the federal fiscal year beginning October 1,
  7 30 2002, and ending September 30, 2003, the following amount:  
  7 31 .................................................. $    341,733
  7 32    Funds appropriated in this subsection are the funds
  7 33 anticipated to be received from the federal government for the
  7 34 designated federal fiscal year under annual federal
  7 35 appropriations which provide for grants to reduce crime and
  8  1 improve public safety.  The drug policy coordinator shall
  8  2 expend the funds appropriated in this subsection as provided
  8  3 in the federal law making the funds available and in
  8  4 conformance with chapter 17A.
  8  5    2.  An amount not exceeding 3 percent of the funds
  8  6 appropriated in subsection 1 shall be used by the drug policy
  8  7 coordinator for administrative expenses.  From the funds set
  8  8 aside by this subsection for administrative expenses, the drug
  8  9 policy coordinator shall pay to the auditor of state an amount
  8 10 sufficient to pay the cost of auditing the use and
  8 11 administration of the state's portion of the funds
  8 12 appropriated in subsection 1.
  8 13    Sec. 8.  RESIDENTIAL SUBSTANCE ABUSE TREATMENT FOR STATE
  8 14 PRISONERS FORMULA GRANT PROGRAM.  There is appropriated from
  8 15 the fund created by section 8.41 to the office of the governor
  8 16 for the drug policy coordinator for the federal fiscal year
  8 17 beginning October 1, 2002, and ending September 30, 2003, the
  8 18 following amount:  
  8 19 .................................................. $    838,162
  8 20    Funds appropriated in this section are the funds
  8 21 anticipated to be received from the federal government for the
  8 22 designated federal fiscal year under 42 U.S.C., chapter 136,
  8 23 which provides grants for substance abuse treatment programs
  8 24 in state and local correctional facilities.  The drug policy
  8 25 coordinator shall expend the funds appropriated in this
  8 26 section as provided in the federal law making the funds
  8 27 available and in conformance with chapter 17A.
  8 28    Sec. 9.  COMMUNITY SERVICES APPROPRIATIONS.
  8 29    1.  a.  There is appropriated from the fund created by
  8 30 section 8.41 to the division of community action agencies of
  8 31 the department of human rights for the federal fiscal year
  8 32 beginning October 1, 2002, and ending September 30, 2003, the
  8 33 following amount:  
  8 34 .................................................. $  7,001,652
  8 35    Funds appropriated in this subsection are the funds
  9  1 anticipated to be received from the federal government for the
  9  2 designated federal fiscal year under 42 U.S.C., chapter 106,
  9  3 which provides for the community services block grant.  The
  9  4 division of community action agencies of the department of
  9  5 human rights shall expend the funds appropriated in this
  9  6 subsection as provided in the federal law making the funds
  9  7 available and in conformance with chapter 17A.
  9  8    b.  The administrator of the division of community action
  9  9 agencies of the department of human rights shall allocate not
  9 10 less than 96 percent of the amount of the block grant to
  9 11 eligible community action agencies for programs benefiting
  9 12 low-income persons.  Each eligible agency shall receive a
  9 13 minimum allocation of not less than $100,000.  The minimum
  9 14 allocation shall be achieved by redistributing increased funds
  9 15 from agencies experiencing a greater share of available funds.
  9 16 The funds shall be distributed on the basis of the poverty-
  9 17 level population in the area represented by the community
  9 18 action areas compared to the size of the poverty-level
  9 19 population in the state.
  9 20    2.  An amount not exceeding 4 percent of the funds
  9 21 appropriated in subsection 1 shall be used by the division of
  9 22 community action agencies of the department of human rights
  9 23 for administrative expenses.  From the funds set aside by this
  9 24 subsection for administrative expenses, the division of
  9 25 community action agencies of the department of human rights
  9 26 shall pay to the auditor of state an amount sufficient to pay
  9 27 the cost of auditing the use and administration of the state's
  9 28 portion of the funds appropriated in subsection 1.  The
  9 29 auditor of state shall bill the division of community action
  9 30 agencies for the costs of the audits.
  9 31    Sec. 10.  COMMUNITY DEVELOPMENT APPROPRIATIONS.
  9 32    1.  There is appropriated from the fund created by section
  9 33 8.41 to the Iowa department of economic development for the
  9 34 federal fiscal year beginning October 1, 2002, and ending
  9 35 September 30, 2003, the following amount:  
 10  1 .................................................. $ 31,843,420
 10  2    Funds appropriated in this subsection are the funds
 10  3 anticipated to be received from the federal government for the
 10  4 designated federal fiscal year under 42 U.S.C., chapter 69,
 10  5 which provides for community development block grants.  The
 10  6 Iowa department of economic development shall expend the funds
 10  7 appropriated in this subsection as provided in the federal law
 10  8 making the funds available and in conformance with chapter
 10  9 17A.
 10 10    2.  An amount not exceeding $1,444,840 for the federal
 10 11 fiscal year beginning October 1, 2002, shall be used by the
 10 12 Iowa department of economic development for administrative
 10 13 expenses for the community development block grant.  The total
 10 14 amount used for administrative expenses includes $722,420 for
 10 15 the federal fiscal year beginning October 1, 2002, of funds
 10 16 appropriated in subsection 1 and a matching contribution from
 10 17 the state equal to $722,420 from the appropriation of state
 10 18 funds for the community development block grant and state
 10 19 appropriations for related activities of the Iowa department
 10 20 of economic development.  From the funds set aside for
 10 21 administrative expenses by this subsection, the Iowa
 10 22 department of economic development shall pay to the auditor of
 10 23 state an amount sufficient to pay the cost of auditing the use
 10 24 and administration of the state's portion of the funds
 10 25 appropriated in subsection 1.  The auditor of state shall bill
 10 26 the department for the costs of the audit.
 10 27    Sec. 11.  LOW-INCOME HOME ENERGY ASSISTANCE APPROPRIATIONS.
 10 28    1.  There is appropriated from the fund created by section
 10 29 8.41 to the division of community action agencies of the
 10 30 department of human rights for the federal fiscal year
 10 31 beginning October 1, 2002, and ending September 30, 2003, the
 10 32 following amount:  
 10 33 .................................................. $ 31,126,126
 10 34    The funds appropriated in this subsection are the funds
 10 35 anticipated to be received from the federal government for the
 11  1 designated federal fiscal year under 42 U.S.C., chapter 94,
 11  2 subchapter II, which provides for the low-income home energy
 11  3 assistance block grants.  The division of community action
 11  4 agencies of the department of human rights shall expend the
 11  5 funds appropriated in this subsection as provided in the
 11  6 federal law making the funds available and in conformance with
 11  7 chapter 17A.
 11  8    2.  Up to 15 percent of the amount appropriated in this
 11  9 section that is actually received shall be used for
 11 10 residential weatherization or other related home repairs for
 11 11 low-income households.  Of this allocation amount, not more
 11 12 than 10 percent may be used for administrative expenses.  In
 11 13 order to receive low-income home energy assistance program
 11 14 funding, the head of an eligible household must be willing to
 11 15 allow residential weatherization or other related home
 11 16 repairs.  However, if the eligible household is located in
 11 17 rental property, the unwillingness of the property owner to
 11 18 allow residential weatherization or other related home repairs
 11 19 shall not prevent the eligible household from receiving low-
 11 20 income home energy assistance program funding.
 11 21    3.  After subtracting the allocation in subsection 2, up to
 11 22 $2,645,721 is allocated for administrative expenses of the
 11 23 low-income home energy assistance program of which $290,000 is
 11 24 allocated for administrative expenses of the division.  The
 11 25 costs of auditing the use and administration of the portion of
 11 26 the appropriation in this section that is retained by the
 11 27 state shall be paid from the amount allocated in this
 11 28 subsection to the division.  The auditor of state shall bill
 11 29 the division for the audit costs.
 11 30    4.  The remainder of the appropriation in this section
 11 31 following the allocations made in subsections 2 and 3, shall
 11 32 be used to help eligible households as defined in 42 U.S.C.,
 11 33 chapter 94, subchapter II, to meet home energy costs.
 11 34    5.  Not more than 10 percent of the amount appropriated in
 11 35 this section that is actually received, may be carried forward
 12  1 for use in the succeeding federal fiscal year.
 12  2    6.  Expenditures for assessment and resolution of energy
 12  3 problems shall be limited to 5 percent of the amount
 12  4 appropriated in this section that is actually received.
 12  5    Sec. 12.  SOCIAL SERVICES APPROPRIATIONS.
 12  6    1.  There is appropriated from the fund created by section
 12  7 8.41 to the department of human services for the federal
 12  8 fiscal year beginning October 1, 2002, and ending September
 12  9 30, 2003, the following amount:  
 12 10 .................................................. $ 17,578,482
 12 11    Funds appropriated in this subsection are the funds
 12 12 anticipated to be received from the federal government for the
 12 13 designated federal fiscal year under 42 U.S.C., chapter 7,
 12 14 subchapter XX, which provides for the social services block
 12 15 grant.  The department of human services shall expend the
 12 16 funds appropriated in this subsection as provided in the
 12 17 federal law making the funds available and in conformance with
 12 18 chapter 17A.
 12 19    2.  Not more than $1,117,773 of the funds appropriated in
 12 20 subsection 1 shall be used by the department of human services
 12 21 for general administration.  From the funds set aside in this
 12 22 subsection for general administration, the department of human
 12 23 services shall pay to the auditor of state an amount
 12 24 sufficient to pay the cost of auditing the use and
 12 25 administration of the state's portion of the funds
 12 26 appropriated in subsection 1.
 12 27    3.  In addition to the allocation for general
 12 28 administration in subsection 2, the remaining funds
 12 29 appropriated in subsection 1 shall be allocated in the
 12 30 following amounts to supplement appropriations for the federal
 12 31 fiscal year beginning October 1, 2002, for the following
 12 32 programs within the department of human services:
 12 33    a.  Field operations:  
 12 34 .................................................. $  6,685,525
 12 35    b.  Child and family services:  
 13  1 .................................................. $    999,969
 13  2    c.  Local administrative costs and other local services:  
 13  3 .................................................. $    709,019
 13  4    d.  Volunteers:

 13  6    e.  Community-based services:  
 13  7 .................................................. $     89,111
 13  8    f.  MH/MR/DD/BI community service (local purchase):  
 13  9 .................................................. $  7,899,595
 13 10    Sec. 13.  SOCIAL SERVICES BLOCK GRANT PLAN.  The department
 13 11 of human services during each state fiscal year shall develop
 13 12 a plan for the use of federal social services block grant
 13 13 funds for the subsequent state fiscal year.
 13 14    The proposed plan shall include all programs and services
 13 15 at the state level which the department proposes to fund with
 13 16 federal social services block grant funds, and shall identify
 13 17 state and other funds which the department proposes to use to
 13 18 fund the state programs and services.
 13 19    The proposed plan shall also include all local programs and
 13 20 services which are eligible to be funded with federal social
 13 21 services block grant funds, the total amount of federal social
 13 22 services block grant funds available for the local programs
 13 23 and services, and the manner of distribution of the federal
 13 24 social services block grant funds to the counties.  The
 13 25 proposed plan shall identify state and local funds which will
 13 26 be used to fund the local programs and services.
 13 27    The proposed plan shall be submitted with the department's
 13 28 budget requests to the governor and the general assembly.
 13 29    Sec. 14.  PROJECTS FOR ASSISTANCE IN TRANSITION FROM
 13 30 HOMELESSNESS.  Upon receipt of the minimum formula grant from
 13 31 the federal alcohol, drug abuse, and mental health
 13 32 administration to provide mental health services for the
 13 33 homeless, for the federal fiscal year beginning October 1,
 13 34 2002, and ending September 30, 2003, the division of mental
 13 35 health and developmental disabilities of the department of
 14  1 human services shall assure that a project which receives
 14  2 funds under the formula grant from either the federal or local
 14  3 match share of 25 percent in order to provide outreach
 14  4 services to persons who are chronically mentally ill and
 14  5 homeless or who are subject to a significant probability of
 14  6 becoming homeless shall do all of the following:
 14  7    1.  Provide community mental health services, diagnostic
 14  8 services, crisis intervention services, and habilitation and
 14  9 rehabilitation services.
 14 10    2.  Refer clients to medical facilities for necessary
 14 11 hospital services, and to entities that provide primary health
 14 12 services and substance abuse services.
 14 13    3.  Provide appropriate training to persons who provide
 14 14 services to persons targeted by the grant.
 14 15    4.  Provide case management to homeless persons.
 14 16    5.  Provide supportive and supervisory services to certain
 14 17 homeless persons living in residential settings which are not
 14 18 otherwise supported.
 14 19    6.  Projects may expend funds for housing services
 14 20 including minor renovation, expansion and repair of housing,
 14 21 security deposits, planning of housing, technical assistance
 14 22 in applying for housing, improving the coordination of housing
 14 23 services, the costs associated with matching eligible homeless
 14 24 individuals with appropriate housing, and one-time rental
 14 25 payments to prevent eviction.
 14 26    7.  If the department has data indicating that a geographic
 14 27 area has a substantial number of persons with mental illness
 14 28 who are homeless and are not being served by an existing
 14 29 grantee for that area under the formula grant and the existing
 14 30 grantee has expressed a desire to no longer provide services
 14 31 or the grantee's contract was terminated by the department for
 14 32 nonperformance, the department shall issue a request for
 14 33 proposals to replace the grantee.  Otherwise, the department
 14 34 shall maximize available funding by continuing to contract to
 14 35 the extent possible with those persons who are grantees as of
 15  1 the effective date of this subsection.  The department shall
 15  2 issue a request for proposals if additional funding becomes
 15  3 available for expansion to persons who are not being served
 15  4 and it is not possible to utilize existing grantees.
 15  5    Sec. 15.  CHILD CARE AND DEVELOPMENT APPROPRIATION.  There
 15  6 is appropriated from the fund created by section 8.41 to the
 15  7 department of human services for the federal fiscal year
 15  8 beginning October 1, 2002, and ending September 30, 2003, the
 15  9 following amount:  
 15 10 .................................................. $ 40,975,932
 15 11    Funds appropriated in this section are the funds
 15 12 anticipated to be received from the federal government under
 15 13 42 U.S.C., chapter 105, subchapter II-B, which provides for
 15 14 the child care and development block grant.  The department
 15 15 shall expend the funds appropriated in this section as
 15 16 provided in the federal law making the funds available and in
 15 17 conformance with chapter 17A.
 15 18    Sec. 16.  PROCEDURE FOR REDUCED FEDERAL FUNDS.
 15 19    1.  If the funds received from the federal government for
 15 20 the block grants specified in this Act are less than the
 15 21 amounts appropriated, the funds actually received shall be
 15 22 prorated by the governor for the various programs, other than
 15 23 for the services to victims of sex offenses and for rape
 15 24 prevention education under section 4, subsection 2, of this
 15 25 Act, for which each block grant is available according to the
 15 26 percentages that each program is to receive as specified in
 15 27 this Act.  However, if the governor determines that the funds
 15 28 allocated by the percentages will not be sufficient to effect
 15 29 the purposes of a particular program, or if the appropriation
 15 30 is not allocated by percentage, the governor may allocate the
 15 31 funds in a manner which will effect to the greatest extent
 15 32 possible the purposes of the various programs for which the
 15 33 block grants are available.
 15 34    2.  Before the governor implements the actions provided for
 15 35 in subsection 1, the following procedures shall be taken:
 16  1    a.  The chairpersons and ranking members of the senate and
 16  2 house standing committees on appropriations, the appropriate
 16  3 chairpersons and ranking members of subcommittees of those
 16  4 committees, the director of the legislative service bureau,
 16  5 and the director of the legislative fiscal bureau shall be
 16  6 notified of the proposed action.
 16  7    b.  The notice shall include the proposed allocations, and
 16  8 information on the reasons why particular percentages or
 16  9 amounts of funds are allocated to the individual programs, the
 16 10 departments and programs affected, and other information
 16 11 deemed useful.  Chairpersons notified shall be allowed at
 16 12 least two weeks to review and comment on the proposed action
 16 13 before the action is taken.
 16 14    3.  If the amount of moneys received from the federal
 16 15 government for a specific grant number specified in this Act
 16 16 is less than the amount appropriated, the amount appropriated
 16 17 shall be reduced accordingly.  An annual report listing any
 16 18 such appropriation reduction shall be submitted to the fiscal
 16 19 committee of the legislative council.
 16 20    Sec. 17.  PROCEDURE FOR INCREASED FEDERAL FUNDS.
 16 21    1.  If funds received from the federal government in the
 16 22 form of block grants exceed the amounts appropriated in
 16 23 sections 1, 2, 3, 4, 5, 7, 10, and 12 of this Act, the excess
 16 24 shall be prorated to the appropriate programs according to the
 16 25 percentages specified in those sections, except additional
 16 26 funds shall not be prorated for administrative expenses.
 16 27    2.  If actual funds received from the federal government
 16 28 from block grants exceed the amount appropriated in section 11
 16 29 of this Act for the low-income home energy assistance program,
 16 30 not more than 15 percent of the excess may be allocated to the
 16 31 low-income residential weatherization program and not more
 16 32 than 5 percent of the excess may be used for administrative
 16 33 costs.
 16 34    3.  If funds received from the federal government from
 16 35 community services block grants exceed the amount appropriated
 17  1 in section 9 of this Act, 100 percent of the excess is
 17  2 allocated to the community services block grant program.
 17  3    4.  If the amount of moneys received from the federal
 17  4 government for a specific grant number specified in this Act
 17  5 exceeds the amount appropriated, the excess amount is
 17  6 appropriated for the purpose designated in the specific
 17  7 grant's appropriation.  An annual report listing any such
 17  8 excess appropriations shall be submitted to the fiscal
 17  9 committee of the legislative council.
 17 10    Sec. 18.  PROCEDURE FOR EXPENDITURE OF ADDITIONAL FEDERAL
 17 11 FUNDS.  If other federal grants, receipts, and funds and other
 17 12 nonstate grants, receipts, and funds become available or are
 17 13 awarded which are not available or awarded during the period
 17 14 in which the general assembly is in session, but which require
 17 15 expenditure by the applicable department or agency prior to
 17 16 March 15 of the fiscal year beginning July 1, 2002, and ending
 17 17 June 30, 2003, these grants, receipts, and funds are
 17 18 appropriated to the extent necessary, provided that the fiscal
 17 19 committee of the legislative council is notified within thirty
 17 20 days of receipt of the grants, receipts, or funds and the
 17 21 fiscal committee of the legislative council has an opportunity
 17 22 to comment on the expenditure of the grants, receipts, or
 17 23 funds.
 17 24    Sec. 19.  DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP.
