1 1 Section 1. NEW SECTION. 904.117 COUNTY JAIL OVERCROWDING
1 2 GRANT PROGRAM – FUND.
1 3 1. A county jail overcrowding grant program is established
1 4 within the department in accordance with this section. The
1 5 department shall establish requirements for the grant program
1 6 and shall award grants to counties that suffer from jail
1 7 overcrowding. The department shall adopt rules regarding
1 8 eligibility requirements and criteria for awarding county jail
1 9 overcrowding grants.
1 10 2. A county jail overcrowding fund is created in the state
1 11 treasury under the control of the department. The fund shall
1 12 consist of appropriations made to the fund and transfers of
1 13 interest, earnings, and moneys from other funds as provided by
1 14 law. The fund shall be separate from the general fund of the
1 15 state and the balance in the fund shall not be considered part
1 16 of the balance of the general fund of the state. However, the
1 17 fund shall be considered a special account for the purposes of
1 18 section 8.53, relating to generally accepted accounting
1 19 principles.
1 20 3. Notwithstanding section 12C.7, subsection 2, interest
1 21 or earnings on moneys in the county jail overcrowding fund
1 22 shall be credited to the rebuild Iowa infrastructure fund
1 23 created in section 8.57.
1 24 4. Moneys in the fund are appropriated to the department
1 25 for county jail overcrowding grants as provided in this
1 26 section.
1 27 5. There is appropriated from the rebuild Iowa
1 28 infrastructure fund for the fiscal year beginning July 1,
1 29 2002, and for each fiscal year thereafter through the fiscal
1 30 year ending June 30, 2007, the sum of five million dollars to
1 31 the county jail overcrowding fund, notwithstanding section
1 32 8.57, subsection 5, paragraph "c".
1 33 EXPLANATION
1 34 This bill creates a county jail overcrowding grant program
1 35 and fund. The bill establishes the program within the
2 1 department of corrections for the purpose of awarding grants
2 2 to counties that suffer from jail overcrowding. The
2 3 department is directed to adopt rules regarding the
2 4 eligibility requirements and criteria for awarding the grants.
2 5 The bill appropriates $5 million a year to the county jail
2 6 overcrowding fund from the rebuild Iowa infrastructure fund
2 7 for five fiscal years beginning with fiscal year 2002-2003 and
2 8 ending with fiscal year 2006-2007. Moneys in the fund are
2 9 appropriated to the department of corrections for county jail
2 10 overcrowding grants.
