  1  4 RELATING TO DIVERTING TOWNSHIP TAXES TO A MUNICIPALITY
  1  5    PROVIDING EMERGENCY SERVICES TO THE TOWNSHIP.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 359.49, Code 2001, is amended by adding
  1 10 the following new subsection:
  1 11    NEW SUBSECTION.  7A.  A township that has entered into an
  1 12 agreement with a municipality to receive fire protection
  1 13 service or emergency medical service from the municipality may
  1 14 request that a portion of its taxes be paid directly to the
  1 15 municipality providing the fire protection service.  Each
  1 16 year, the township must note its request on the budget and
  1 17 must attach a copy of the emergency services agreement to each
  1 18 copy of the budget transmitted to the county auditor.  The
  1 19 auditor shall direct the county treasurer as to what portion
  1 20 of the township taxes to disburse to the municipality
  1 21 providing the fire protection service or emergency medical
  1 22 service.
  1 23    For purposes of this subsection, "municipality" means a
  1 24 city, county, township, benefited fire district, or agency
  1 25 formed under chapter 28E and authorized by law to provide
  1 26 emergency services.
