  1  4 RELATING TO THE OPERATION AND REGULATION OF PERSONAL 
  1  5    WATERCRAFT, AND TO WATERCRAFT SAFETY COURSES AND 
  1  6    CERTIFICATES, AND SUBJECTING VIOLATORS TO A PENALTY.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 462A.2, Code 2001, is amended by adding
  1 11 the following new subsection:
  1 12    NEW SUBSECTION.  27A.  "Personal watercraft" means a
  1 13 vessel, less than sixteen feet in length, which is propelled
  1 14 by a water jet pump or similar machinery as its primary source
  1 15 of motor propulsion and is designed to be operated by a person
  1 16 sitting, standing, or kneeling on the vessel rather than being
  1 17 operated by a person sitting, standing, or kneeling inside the
  1 18 vessel.
  1 19    Sec. 2.  Section 462A.12, subsection 6, Code Supplement
  1 20 2001, is amended by striking the subsection and inserting in
  1 21 lieu thereof the following:
  1 22    6.  An owner or operator shall not permit any person under
  1 23 twelve years of age to operate the personal watercraft unless
  1 24 accompanied in or on the same personal watercraft by a
  1 25 responsible person of at least eighteen years of age.
  1 26 However, commencing January 1, 2003, a person who is twelve
  1 27 years of age or older but less than eighteen years of age
  1 28 shall not operate any personal watercraft unless the person
  1 29 has successfully completed a department-approved watercraft
  1 30 safety course.  A person required to have a watercraft safety
  1 31 certificate shall carry and shall exhibit or make available
  1 32 the certificate upon request of an officer of the department.
  1 33 A violation of this subsection is a simple misdemeanor as
  1 34 provided in section 462A.13.  However, a person charged with
  1 35 violating this subsection shall not be convicted if the person
  2  1 produces in court, within a reasonable time, a department-
  2  2 approved certificate.  The cost of a department certificate,
  2  3 or any duplicate, shall not exceed five dollars.
  2  4    Sec. 3.  Section 462A.12, Code Supplement 2001, is amended
  2  5 by adding the following new subsections:
  2  6    NEW SUBSECTION.  12.  A person shall not operate a personal
  2  7 watercraft at any time between sundown and sunup.
  2  8    NEW SUBSECTION.  13.  A person shall not chase or harass
  2  9 animals while operating a personal watercraft or motorboat.
