  1  4 ELIMINATING TEACHER LICENSURE OF COMMUNITY COLLEGE FACULTY;
  1  5    REQUIRING COMMUNITY COLLEGES TO DEVELOP, APPROVE, AND
  1  6    IMPLEMENT A QUALITY FACULTY PLAN; AND PROVIDING FOR RELATED
  1  7    MATTERS AND EFFECTIVE DATES.

  1  9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 10 
  1 11    Section 1.  Section 20.21, unnumbered paragraph 3, Code
  1 12 2001, is amended to read as follows:
  1 13    However, the board shall not appoint a fact-finder
  1 14 representative of the public if the public employees
  1 15 represented by a certified employee organization are teachers
  1 16 licensed under chapter 272 and the public employer is a school
  1 17 district, community college, or area education agency, or are
  1 18 professional employees and the public employer is a community
  1 19 college.  The board shall adopt rules regarding the time
  1 20 period after mediation when binding arbitration procedures
  1 21 must begin for teachers or professional employees exempt from
  1 22 this section.
  1 23    Sec. 2.  Section 232.69, subsection 1, paragraph b,
  1 24 subparagraph (4), Code Supplement 2001, is amended to read as
  1 25 follows:
  1 26    (4)  A licensed school employee, certified para-educator,
  1 27 or holder of a coaching authorization issued under section
  1 28 272.31, or an instructor employed by a community college.
  1 29    Sec. 3.  Section 257.11, subsection 3, paragraph b,
  1 30 unnumbered paragraph 1, Code Supplement 2001, is amended to
  1 31 read as follows:
  1 32    If the school budget review committee certifies to the
  1 33 department of management that the class would not otherwise be
  1 34 implemented without the assignment of additional weighting,
  1 35 pupils attending a community college-offered class or
  2  1 attending a class taught by a community college-employed
  2  2 teacher instructor are assigned a weighting of forty-eight
  2  3 hundredths of the percentage of the pupil's school day during
  2  4 which the pupil attends class in the community college or
  2  5 attends a class taught by a community college-employed teacher
  2  6 instructor.  The following requirements shall be met for the
  2  7 purposes of assigning an additional weighting for classes
  2  8 offered through a sharing agreement between a school district
  2  9 and community college.  The class must be:
  2 10    Sec. 4.  Section 257.11, subsection 3, paragraph b,
  2 11 subparagraph (5), Code Supplement 2001, is amended to read as
  2 12 follows:
  2 13    (5)  Taught by a teacher meeting community college
  2 14 licensing requirements college-employed instructor.
  2 15    Sec. 5.  Section 260C.36, Code 2001, is amended to read as
  2 16 follows:
  2 17    260C.36  QUALITY FACULTY DEVELOPMENT PLAN.
  2 18    1.  By October 1, 2002, the college administration shall
  2 19 establish a committee consisting of instructors and
  2 20 administrators, equally representative of the arts and
  2 21 sciences faculty and the vocational-technical faculty, which
  2 22 has no more than a simple majority of members of the same
  2 23 gender.  The faculty members shall be appointed by the
  2 24 certified employee organization if one exists and if not, by
  2 25 the college administration.  The administrators shall be
  2 26 appointed by the college administration.  The committee shall
  2 27 develop a plan for hiring and developing quality faculty that
  2 28 includes all of the following:
  2 29    a.  An implementation schedule for the plan.
  2 30    b.  Orientation for new faculty.
  2 31    c.  Continuing professional development for faculty.
  2 32    d.  Procedures for accurate recordkeeping and documentation
  2 33 for plan monitoring.
  2 34    e.  Consortium arrangements when appropriate, cost-
  2 35 effective and mutually beneficial.
  3  1    f.  Specific activities that ensure faculty attain and
  3  2 demonstrate instructional competencies and knowledge in their
  3  3 subject or technical areas.
  3  4    g.  Procedures for collection and maintenance of records
  3  5 demonstrating that each faculty member has attained or
  3  6 documented progress toward attaining minimal competencies.
  3  7    h.  Compliance with the faculty accreditation standards of
  3  8 the north central association of colleges and schools and with
  3  9 faculty standards required under specific programs offered by
  3 10 the community college that are accredited by other accrediting
  3 11 agencies.
  3 12    2.  The committee shall submit the plan to the board of
  3 13 directors, which shall consider the plan and, once approved,
  3 14 submit the plan to the department of education and implement
  3 15 the plan not later than July 1, 2003.
  3 16    3.  Between July 1, 2003, and June 30, 2006, the department
  3 17 of education shall conduct on-site visits to ensure each
  3 18 community college's compliance and progress in implementing
  3 19 its plan.  At minimum, the department shall visit five
  3 20 colleges each year until the department has conducted on-site
  3 21 visits at each community college.  By July 1, 2006, the
  3 22 department shall submit a report summarizing the department's
  3 23 findings to each community college and to the state
  3 24 accreditation team appointed pursuant to section 260C.47.
  3 25    4.  The administration of the college shall encourage the
  3 26 continued development of faculty potential by doing all of the
  3 27 following:
  3 28    (1) a.  Regularly stimulating department chairpersons or
  3 29 heads to meet their responsibilities in this regard; (2)
  3 30 lightening for the continued development of faculty potential.
  3 31    b.  Reducing the teaching instructional loads of first-year
  3 32 instructors whose course preparation and in-service training
  3 33 demand it; (3) stimulating a reduction.
  3 34    c.  Stimulating curricular evaluation; and (4) encouraging.
  3 35    d.  Encouraging the development of an atmosphere in which
  4  1 the faculty brings a wide range of ideas and experiences to
  4  2 the students, each other, and the community.
  4  3    Sec. 6.  Section 260C.47, subsection 1, unnumbered
  4  4 paragraph 1, Code 2001, is amended to read as follows:
  4  5    The state board of education shall establish an
  4  6 accreditation process for community college programs by July
  4  7 1, 1997.  The process shall be jointly developed and agreed
  4  8 upon by the department of education and the community
  4  9 colleges.  The state accreditation process shall be integrated
  4 10 with the accreditation process of the north central
  4 11 association of colleges and schools, including the evaluation
  4 12 cycle, the self-study process, and the criteria for
  4 13 evaluation, which shall incorporate the standards for
  4 14 community colleges developed under section 260C.48; and shall
  4 15 identify and make provision for the needs of the state that
  4 16 are not met by the association's accreditation process.  For
  4 17 the academic year commencing July 1, 1998, and in succeeding
  4 18 school years, the department of education shall use a two-
  4 19 component process for the continued accreditation of community
  4 20 college programs.  Beginning July 1, 2006, the state
  4 21 accreditation process shall incorporate the standards
  4 22 developed pursuant to section 260C.48, subsection 4.
  4 23    Sec. 7.  Section 260C.47, subsection 1, paragraph b, Code
  4 24 2001, is amended to read as follows:
  4 25    b.  The second component consists of the use of an
  4 26 accreditation team appointed by the director of the department
  4 27 of education, to conduct an evaluation, including an on-site
  4 28 visit of each community college, with a comprehensive
  4 29 evaluation to occur during the same year as the evaluation by
  4 30 the north central association of colleges and schools, and an
  4 31 interim evaluation midway between comprehensive evaluations.
  4 32 The number and composition of the accreditation team shall be
  4 33 determined by the director, but the team shall include members
  4 34 of the department of education staff and community college
  4 35 staff members from community colleges other than the community
  5  1 college that conducts the programs being evaluated for
  5  2 accreditation.  Beginning July 1, 2006, the accreditation team
  5  3 shall monitor the quality faculty plan implemented by each
  5  4 community college pursuant to section 260C.36.
  5  5    Sec. 8.  Section 260C.48, subsection 1, Code 2001, is
  5  6 amended to read as follows:
  5  7    1.  The state board shall develop standards and rules for
  5  8 the accreditation of community college programs.  Standards
  5  9 Except as provided in this subsection and subsection 4,
  5 10 standards developed shall be general in nature so as to apply
  5 11 to more than one specific program of instruction.  With regard
  5 12 to community college-employed instructors, the standards
  5 13 adopted shall at a minimum require that full-time community
  5 14 college instructors meet the following requirements:
  5 15    a.  Instructors in the subject area of career and technical
  5 16 education shall be registered, certified, or licensed in the
  5 17 occupational area in which the state requires registration,
  5 18 certification, or licensure, and shall hold the appropriate
  5 19 registration, certificate, or license for the occupational
  5 20 area in which the instructor is teaching, and shall meet
  5 21 either of the following qualifications:
  5 22    (1)  A baccalaureate or graduate degree in the area or a
  5 23 related area of study or occupational area in which the
  5 24 instructor is teaching classes.
  5 25    (2)  Special training and at least six thousand hours of
  5 26 recent and relevant work experience in the occupational area
  5 27 or related occupational area in which the instructor teaches
  5 28 classes if the instructor possesses less than a baccalaureate
  5 29 degree.
  5 30    b.  Instructors in the subject area of arts and sciences
  5 31 shall meet either of the following qualifications:
  5 32    (1)  Possess a master's degree from a regionally accredited
  5 33 graduate school, and has successfully completed a minimum of
  5 34 twelve credit hours of graduate level courses in each field of
  5 35 instruction in which the instructor is teaching classes.
  6  1    (2)  Has two or more years of successful experience in a
  6  2 professional field or area in which the instructor is teaching
  6  3 classes and in which postbaccalaureate recognition or
  6  4 professional licensure is necessary for practice, including
  6  5 but not limited to the fields or areas of accounting,
  6  6 engineering, law, law enforcement, and medicine.
  6  7    Sec. 9.  Section 260C.48, Code 2001, is amended by adding
  6  8 the following new subsection:
  6  9    NEW SUBSECTION.  4.  Commencing July 1, 2006, standards
  6 10 relating to quality assurance of faculty and ongoing quality
  6 11 professional development shall be the accreditation standards
  6 12 of the north central association of colleges and schools and
  6 13 the faculty standards required under specific programs offered
  6 14 by the community college that are accredited by other
  6 15 accrediting agencies.
  6 16    Sec. 10.  Section 272.1, subsection 11, Code 2001, is
  6 17 amended to read as follows:
  6 18    11.  "School" means a school under section 280.2, a
  6 19 community college, an area education agency, and a school
  6 20 operated by a state agency for special purposes.
  6 21    Sec. 11.  Section 272.3, subsection 5, Code 2001, is
  6 22 amended by striking the subsection.
  6 23    Sec. 12.  Section 272.33, unnumbered paragraph 1, Code
  6 24 2001, is amended to read as follows:
  6 25    In addition to licenses required under rules adopted
  6 26 pursuant to this chapter, an individual employed as an
  6 27 administrator, supervisor, school service person, or teacher
  6 28 by a school district, or area education agency, or community
  6 29 college, who conducts evaluations of the performance of
  6 30 individuals holding licenses under this chapter, shall possess
  6 31 an evaluator license or an evaluator endorsement appearing on
  6 32 a teaching or administrative license.  Individuals employed in
  6 33 community colleges who do not directly supervise licensed
  6 34 teaching faculty are exempt from this section.
  6 35    Sec. 13.  Section 279.12, unnumbered paragraph 3, Code
  7  1 2001, is amended to read as follows:
  7  2    The board may approve a policy for educational leave for
  7  3 licensed school employees and for reimbursement for tuition
  7  4 paid by licensed school employees for courses approved by the
  7  5 board.  The board of directors of a community college may
  7  6 approve a policy for educational leave for its instructors and
  7  7 for reimbursement for tuition paid by its instructors for
  7  8 courses approved by the board.  For the purpose of this
  7  9 section, "educational leave" means a leave granted to an
  7 10 employee for the purpose of study including study in areas
  7 11 outside of a teacher's area of specialization, travel, or
  7 12 other reasons deemed by the board to be of value to the school
  7 13 system.
  7 14    Sec. 14.  Section 279.13, Code Supplement 2001, is amended
  7 15 by adding the following new subsection:
  7 16    NEW SUBSECTION.  4.  For purposes of this section, sections
  7 17 279.14, 279.15 through 279.17, and 279.27, unless the context
  7 18 otherwise requires, "teacher" includes an instructor employed
  7 19 by a community college.
  7 20    Sec. 15.  Section 279.18, Code 2001, is amended by adding
  7 21 the following new unnumbered paragraph:
  7 22    NEW UNNUMBERED PARAGRAPH.  For purposes of this section,
  7 23 unless the context otherwise requires, "rejecting party" shall
  7 24 include, but not be limited to, an instructor employed by a
  7 25 community college.
  7 26    Sec. 16.  Section 279.19A, Code 2001, is amended by adding
  7 27 the following new subsection:
  7 28    NEW SUBSECTION.  10.  The licensure requirements of
  7 29 subsections 3, 4, and 9 shall not apply to community colleges.
  7 30    Sec. 17.  Section 279.19B, Code 2001, is amended by adding
  7 31 the following new unnumbered paragraph:
  7 32    NEW UNNUMBERED PARAGRAPH.  This section shall not apply to
  7 33 community colleges.
  7 34    Sec. 18.  Section 279.55, Code 2001, is amended to read as
  7 35 follows:
  8  1    279.55  TEACHER EXCHANGE PROGRAM.
  8  2    If funds are appropriated by the general assembly, an Iowa
  8  3 teacher exchange program is established to permit school
  8  4 districts to exchange licensed instructional personnel with
  8  5 other districts in order to promote the exchange and
  8  6 enhancement of instructional methods and materials and
  8  7 encourage the educational development of Iowa's teachers.
  8  8 Community colleges may exchange their instructional personnel
  8  9 only with other community colleges under this program.
  8 10    Sec. 19.  VALIDITY OF LICENSE.  Notwithstanding section
  8 11 272.7, a license issued by the board of educational examiners
  8 12 to an instructor employed by a community college, which is due
  8 13 to expire at any time between the effective date of this
  8 14 section of this Act and July 1, 2003, shall remain valid until
  8 15 July 1, 2003.
  8 16    Sec. 20.  EFFECTIVE DATE.  Sections 1 through 4 and
  8 17 sections 6 through 18 of this Act take effect July 1, 2003.
  8 18    Sec. 21.  Section 19 of this Act, relating to the validity
  8 19 of a license, being deemed of immediate importance, takes
  8 20 effect upon enactment.
