PAG LIN 1 1 Section 1. Section 85A.12, unnumbered paragraph 1, Code 1 2 2001, is amended to read as follows: 1 3 An employer shall not be liable for any compensation for an 1 4 occupational disease unless such disease shall be due to the 1 5 nature of an employment in which the hazards of such disease 1 6 actually exist, and which hazards are characteristic thereof 1 7 and peculiar to the trade, occupation, process, or employment, 1 8 and such disease actually arises out of the employment, and1 9unless disablement or death results within three years in case1 10of pneumoconiosis, or within one year in case of any other1 11occupational disease, after the last injurious exposure to1 12such disease in such employment, or in case of death, unless1 13death follows continuous disability from such disease1 14commencing within the period above limited for which1 15compensation has been paid or awarded or timely claim made as1 16provided by this chapter and results within seven years after1 17such exposure. 1 18 EXPLANATION 1 19 This bill eliminates the requirement that compensation for 1 20 occupational disease is payable only if compensable 1 21 disablement or death occurs within a certain period of time 1 22 after the last workplace exposure to the cause of the disease. 1 23 LSB 6367HH 79 1 24 ec/cls/14
