  1  1    Section 1.  NEW SECTION.  73A.22  RESPONSIBLE BIDDER
  1  2 REQUIREMENTS.
  1  3    For purposes of this chapter, chapter 331, and chapter 384,
  1  4 a "responsible bidder" means a bidder that possesses the
  1  5 ability, including the financial ability, to adequately comply
  1  6 with and perform the requirements of the contract and that has
  1  7 a satisfactory record of integrity, business ethics, and
  1  8 performance.  In order to determine if a bidder possesses the
  1  9 ability to comply with the requirements of the contract, the
  1 10 bidder shall state, in writing, in the bid that the bidder has
  1 11 examined and reviewed all relevant plans or designs developed
  1 12 for purposes of the contract and that the bidder has
  1 13 established a process by which the compliance with the
  1 14 requirements of the bid can be monitored during construction.  
  1 15                           EXPLANATION
  1 16    This bill concerns what constitutes a responsible bidder
  1 17 for purposes of sealed bid procedures used by cities,
  1 18 counties, townships, schools, state fair board, and the board
  1 19 of regents to award contracts for public improvements.  The
  1 20 bill provides that a responsible bidder is one that
  1 21 demonstrates the ability to perform the contract subject to
  1 22 the sealed bid procedures and that the bidder shall indicate
  1 23 in writing in the bid that the bidder has examined all
  1 24 necessary plans and specifications for the contract and has
  1 25 established a procedure for ensuring ongoing compliance with
  1 26 the bid requirements during construction.
