PAG LIN 1 1 Section 1. Section 99D.11, subsection 7, Code 2001, is 1 2 amended to read as follows: 1 3 7. A person under the age of twenty-one years shall not 1 4 make or attempt to make a pari-mutuel wager. A person who 1 5 violates this subsection commits a scheduled violation under 1 6 section 805.8C, subsection 4. 1 7 Sec. 2. Section 99E.18, Code 2001, is amended by adding 1 8 the following new subsection: 1 9 NEW SUBSECTION. 5. A person under the age of twenty-one 1 10 years shall not purchase or attempt to purchase a ticket or 1 11 share. A person who violates this subsection commits a 1 12 scheduled violation under section 805.8C, subsection 4. 1 13 Sec. 3. Section 99F.9, subsection 5, Code 2001, is amended 1 14 to read as follows: 1 15 5. A person under the age of twenty-one years shall not 1 16 make or attempt to make a wager on an excursion gambling boat 1 17 or in a racetrack enclosure and shall notbe allowed inenter 1 18 the area of the excursion gambling boat or racetrack enclosure 1 19 where gambling is being conducted except for employment 1 20 purposes. However, a person under eighteen years of ageor1 21oldermay be employed to work ina gambling areanongambling 1 22 areas only on an excursion gambling boat or in a racetrack 1 23 enclosure. A person who violates this subsection with respect 1 24 to making or attempting to make a wager commits a scheduled 1 25 violation under section 805.8C, subsection 4. 1 26 Sec. 4. Section 805.8C, Code Supplement 2001, is amended 1 27 by adding the following new subsection: 1 28 NEW SUBSECTION. 4. GAMBLING VIOLATIONS. For violations 1 29 of legal age for gambling or pari-mutuel wagering under 1 30 section 99D.11, subsection 7, section 99E.18, subsection 5, or 1 31 section 99F.9, subsection 5, the scheduled fine is one hundred 1 32 dollars. Failure to pay the fine by a person under the age of 1 33 eighteen shall not result in the person being detained in a 1 34 secure facility. 1 35 EXPLANATION 2 1 This bill imposes a scheduled fine of $100 on persons under 2 2 21 years of age who wager or attempt to wager at pari-mutuel 2 3 horse or dog races or on gambling games in a racetrack 2 4 enclosure or on an excursion gambling boat or who purchase a 2 5 lottery ticket. 2 6 LSB 5833YH 79 2 7 tj/pj/5
