1 1 Section 1. Section 97B.52A, subsection 1, paragraph c,
1 2 Code 2001, is amended to read as follows:
1 3 c. For a member whose first month of entitlement is July
1 4 2000 or later, the member does not return to any employment
1 5 with a covered employer until the member has qualified for at
1 6 least one calendar month of retirement benefits, and the
1 7 member does not return to covered employment until the member
1 8 has qualified for no fewer than four calendar months of
1 9 retirement benefits. For purposes of this paragraph,
1 10 effective July 1, 2000, any employment with a covered employer
1 11 does not include employment as an elective official or member
1 12 of the general assembly if the member is not covered under
1 13 this chapter for that employment. In addition, for purposes
1 14 of this paragraph, effective July 1, 2002, covered employment
1 15 does not include employment as a registered nurse or a
1 16 licensed practical nurse.
1 17 EXPLANATION
1 18 This bill provides that an Iowa public employees'
1 19 retirement system (IPERS) member can retire and return to
1 20 employment as a registered nurse or a licensed practical nurse
1 21 for an employer covered under IPERS after receiving retirement
1 22 benefits for one month and still remain eligible to receive a
1 23 retirement allowance. Under current law, a member of IPERS
1 24 cannot return to any IPERS covered employment, including
1 25 nursing, for four months following retirement and still
1 26 receive a retirement allowance.
