PAG LIN 1 1 Section 1. Section 712.7, Code 2001, is amended to read as 1 2 follows: 1 3 712.7 FALSE REPORTS. 1 4 1. A person who, knowing the information to be false, 1 5 conveys or causes to be conveyed to any person any false 1 6 information concerning the placement of any incendiary or 1 7 explosive device or material or other destructive substance or 1 8 device in any place where persons or property would be 1 9 endangered commits a class "D" felony. 1 10 2. If a person commits a violation of subsection 1, and 1 11 the place where persons or property would be endangered is on 1 12 school grounds, the person commits a class "C" felony. For 1 13 the purposes of this section, "school" means a public or 1 14 nonpublic school as defined in section 280.2. 1 15 EXPLANATION 1 16 This bill relates to the criminal offense of making a false 1 17 report. 1 18 The bill provides that a person who knowingly provides 1 19 false information concerning the placement of an incendiary or 1 20 explosive device or material of other destructive substance on 1 21 school grounds commits a class "C" felony. Current law 1 22 provides that the offense is a class "D" felony. Under the 1 23 bill the term "school" means any school directly supported in 1 24 whole or in part by taxation and any nonpublic school which is 1 25 accredited or which uses licensed practitioners as 1 26 instructors. 1 27 A class "D" felony is punishable by confinement for no more 1 28 than five years and a fine of at least $750 but not more than 1 29 $7,500. A class "C" felony is punishable by confinement for 1 30 no more than 10 years and a fine of at least $1,000 but not 1 31 more than $10,000. 1 32 LSB 5517HH 79 1 33 jm/cls/14
