1 3 Section 1. NEW SECTION. 135.121 USE OF GENERAL FUND OF
1 4 THE STATE – IMPLANTATION OF PRODUCT OF HUMAN SOMATIC CELL
1 5 NUCLEAR TRANSFER IN WOMAN'S UTERUS – PROHIBITION – CIVIL
1 6 PENALTY.
1 7 1. A person shall not use moneys from the general fund of
1 8 the state to implant or attempt to implant the product of
1 9 human somatic cell nuclear transfer into a woman's uterus.
1 10 2. This section does not prohibit the use of moneys from
1 11 the general fund of the state for scientific research or cell-
1 12 based therapies not specifically prohibited.
1 13 3. For the purposes of this section:
1 14 a. "Human somatic cell" means a cell of a developing or
1 15 fully developed human that is not and will not become a sperm
1 16 or egg cell.
1 17 b. "Human somatic cell nuclear transfer" means
1 18 transferring the nucleus of a human somatic cell into an egg
1 19 cell from which the nucleus has been removed or rendered
1 20 inert.
1 21 4. A person who violates this section is subject to a
1 22 civil penalty in the amount of the expenditure of moneys from
1 23 the general fund of the state used in violation of this
1 24 section.
1 25 EXPLANATION
1 26 This bill prohibits the use of moneys from the general fund
1 27 of the state to implant or attempt to implant the product of
1 28 human somatic cell nuclear transfer into a woman's uterus.
1 29 The bill defines "human somatic cell nuclear transfer" and
1 30 exempts from the prohibited use of state general funds,
1 31 scientific research or cell-based therapies not specifically
1 32 prohibited under the bill. A person who violates the bill is
1 33 subject to a civil penalty in the amount of the expenditure of
1 34 moneys from the general fund of the state used in violation of
1 35 the bill.
