  1  4 APPROPRIATING FUNDS TO THE DEPARTMENT OF ECONOMIC DEVELOPMENT,
  1  5    CERTAIN BOARD OF REGENTS INSTITUTIONS, THE DEPARTMENT OF
  1  6    WORKFORCE DEVELOPMENT, AND THE PUBLIC EMPLOYMENT RELATIONS
  1  7    BOARD, MAKING RELATED STATUTORY CHANGES, AND PROVIDING
  1  8    EFFECTIVE DATES.  
  1  9 
  1 10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 11 
  1 12    Section 1.  DEPARTMENT OF ECONOMIC DEVELOPMENT.  There is
  1 13 appropriated from the general fund of the state and other
  1 14 designated funds to the department of economic development for
  1 15 the fiscal year beginning July 1, 2001, and ending June 30,
  1 16 2002, the following amounts, or so much thereof as is
  1 17 necessary, to be used for the purposes designated:
  1 18    1.  ADMINISTRATIVE SERVICES DIVISION
  1 19    a.  General administration
  1 20    For salaries, support, maintenance, miscellaneous purposes,
  1 21 for allocating $285,000 to the world food prize, and for
  1 22 providing that a business receiving moneys from the department
  1 23 for the purpose of job creation shall make available ten
  1 24 percent of the new jobs created for promise jobs program
  1 25 participants who are qualified for the jobs created, and for
  1 26 not more than the following full-time equivalent positions:

  1 29    Of the moneys allocated for the world food prize, $50,000
  1 30 shall be allocated for purposes of the world food prize youth
  1 31 institute.  
  1 32    b.  Film office

  1 34 and for not more than the following full-time equivalent
  1 35 positions:

  2 10    2.  BUSINESS DEVELOPMENT DIVISION
  2 11    a.  Business development operations
  2 12    For salaries, support, maintenance, miscellaneous purposes,
  2 13 and for not more than the following full-time equivalent
  2 14 positions:

  2 16 ................................................FTEs      27.75
  2 17    Of the amount appropriated in this paragraph "a", $400,000
  2 18 shall be allocated to support activities in conjunction with
  2 19 the Iowa manufacturing technology center, and $94,000 shall be
  2 20 allocated to the graphic arts center.
  2 21    The department shall consult and work with the small
  2 22 business development centers in an effort to eliminate any
  2 23 duplication of services provided by the department and the
  2 24 small business development centers and to determine how to
  2 25 deliver services to small businesses in the state in the most
  2 26 efficient manner.
  2 27    For the fiscal year beginning July 1, 2001, and ending June
  2 28 30, 2002, the department shall allocate $94,000 from the
  2 29 moneys appropriated under this subsection for the federal
  2 30 procurement office.
  2 31    b.  Workforce recruitment initiative
  2 32    For workforce recruitment initiative purposes, including
  2 33 salaries, support, maintenance, miscellaneous purposes, and
  2 34 for not more than the following full-time equivalent
  2 35 positions:

  3  3    c.  Strategic investment fund
  3  4    For deposit in the Iowa strategic investment fund for
  3  5 salaries, support, and for not more than the following full-

  3  9    The department may allocate from the Iowa strategic
  3 10 investment fund up to $90,240 for the microbusiness rural
  3 11 enterprise assistance program under section 15.114.
  3 12    By January 14, 2002, the department shall submit a written
  3 13 report to the members of the joint appropriations subcommittee
  3 14 on economic development and the legislative fiscal bureau on
  3 15 the progress made by the department in making the community
  3 16 economic betterment program a self-sustaining, revolving loan
  3 17 program.  The report shall include information regarding the
  3 18 department's progress in making the community economic
  3 19 betterment program self-sufficient and projections and plans
  3 20 for continuing to make the program self-sufficient over the
  3 21 subsequent five years.
  3 22    d.  Insurance economic development
  3 23    There is appropriated from moneys collected by the division
  3 24 of insurance in excess of the anticipated gross revenues under
  3 25 section 505.7, subsection 3, to the department for the fiscal
  3 26 year beginning July 1, 2001, and ending June 30, 2002, the
  3 27 following amount, or so much thereof as is necessary, for
  3 28 insurance economic development and international insurance
  3 29 economic development:  
  3 30 .................................................. $    100,000
  3 31    e.  Value-added agriculture
  3 32    For deposit in the value-added agricultural products and
  3 33 processes financial assistance fund:  
  3 34 .................................................. $  2,850,000
  3 35    There is appropriated from the moneys available to support
  4  1 value-added agricultural products and processes, 6 percent, or
  4  2 so much thereof as is necessary, for administration of the
  4  3 value-added agricultural products and processes financial
  4  4 assistance program as provided in section 15E.111, including
  4  5 salaries, support, maintenance, miscellaneous purposes, and
  4  6 for not more than 3.00 FTEs.
  4  7    The department shall collaborate with the university of
  4  8 northern Iowa on a strategic initiative to develop ag-based
  4  9 industrial lubrication technology and to create projects to
  4 10 deploy the technology in commercial applications.
  4 11 Notwithstanding the requirements of section 15E.111 and the
  4 12 administrative rules for value-added agricultural products and
  4 13 processes, the department shall allocate $258,500 for this
  4 14 initiative.
  4 15    3.  COMMUNITY DEVELOPMENT DIVISION
  4 16    a.  Community assistance
  4 17    For salaries, support, maintenance, miscellaneous purposes,
  4 18 and for not more than the following full-time equivalent
  4 19 positions for administration of the community economic
  4 20 preparedness program, the Iowa community betterment program,
  4 21 and the city development board:  
  4 22 .................................................. $    772,516

  4 24    b.  Main street/rural main street program
  4 25    For salaries and support, and for not more than the
  4 26 following full-time equivalent positions:

  4 29    Notwithstanding section 8.33, moneys committed to grantees
  4 30 under contract from the general fund of the state that remain
  4 31 unexpended on June 30, 2002, shall not revert to any fund but
  4 32 shall remain available for expenditure for purposes of the
  4 33 contract during the fiscal year beginning July 1, 2002.
  4 34    c.  Community development program
  4 35    For salaries, support, maintenance, miscellaneous purposes,
  5  1 and for not more than the following full-time equivalent
  5  2 positions, for rural resource coordination, rural community
  5  3 leadership, rural innovations grant program, and the rural
  5  4 enterprise fund:

  5  7    There is appropriated from the rural community 2000 program
  5  8 revolving fund established in section 15.287 to provide to
  5  9 Iowa's councils of governments funds for planning and
  5 10 technical assistance to local governments:

  5 12    There is appropriated from the rural community 2000 program
  5 13 revolving fund established in section 15.287 to the rural
  5 14 development program for the purposes of the program including
  5 15 the rural enterprise fund and collaborative skills development
  5 16 training:

  5 18    Notwithstanding section 8.33, moneys committed to grantees
  5 19 under contract from the general fund of the state or through
  5 20 transfers from the Iowa community development loan fund or
  5 21 from the rural community 2000 program revolving fund that
  5 22 remain unexpended on June 30, 2002, shall not revert but shall
  5 23 be available for expenditure for purposes of the contract
  5 24 during the fiscal year beginning July 1, 2002.
  5 25    d.  Community development block grant and HOME
  5 26    For administration and related federal housing and urban
  5 27 development grant administration for salaries, support,
  5 28 maintenance, miscellaneous purposes, and for not more than the
  5 29 following full-time equivalent positions:

  5 32    4.  INTERNATIONAL DIVISION
  5 33    a.  International trade operations
  5 34    For salaries, support, maintenance, miscellaneous purposes,
  5 35 for support of foreign representation and trade offices, and
  6  1 the agricultural product advisory council, and for not more
  6  2 than the following full-time equivalent positions:  
  6  3 .................................................. $  2,190,893
  6  4 ............................................... FTEs      14.25
  6  5    Of the moneys appropriated in this lettered paragraph,
  6  6 $235,000 shall be allocated to support the taste of Iowa
  6  7 program.
  6  8    From among the full-time equivalent positions authorized by
  6  9 this lettered paragraph, one position shall concentrate on the
  6 10 export sale of grain, one on the export sale of livestock, and
  6 11 one on the export sale of value-added agricultural products.
  6 12    b.  Export trade assistance program
  6 13    For export trade activities, including a program to
  6 14 encourage and increase participation in trade shows and trade
  6 15 missions by providing financial assistance to businesses for a
  6 16 percentage of their costs of participating in trade shows and
  6 17 trade missions, by providing for the lease/sublease of
  6 18 showcase space in existing world trade centers, by providing
  6 19 temporary office space for foreign buyers, international
  6 20 prospects, and potential reverse investors, and by providing
  6 21 other promotional and assistance activities, including
  6 22 salaries and support:  
  6 23 .................................................. $    308,000
  6 24    Notwithstanding section 8.33, moneys appropriated in this
  6 25 lettered paragraph that remain unencumbered or unobligated at
  6 26 the close of the fiscal year shall not revert but shall remain
  6 27 available for expenditure for the purposes designated until
  6 28 the close of the succeeding fiscal year.
  6 29    c.  For the partner state program to contract with private
  6 30 groups or organizations which are the most appropriate to
  6 31 administer this program and the groups and organizations
  6 32 participating in the program shall, to the fullest extent
  6 33 possible, provide the funds to match the appropriation made in
  6 34 this paragraph:

  7  1    5.  TOURISM DIVISION
  7  2    Tourism operations and advertising
  7  3    For salaries, support, maintenance, miscellaneous purposes,
  7  4 and for not more than the following full-time equivalent
  7  5 positions:

  7  7 ............................................... FTEs      19.52
  7  8    The department shall not use the moneys appropriated in
  7  9 this subsection, unless the department develops public-private
  7 10 partnerships with Iowa businesses in the tourism industry,
  7 11 Iowa tour groups, Iowa tourism organizations, and political
  7 12 subdivisions in this state to assist in the development of
  7 13 advertising efforts.  The department shall, to the fullest
  7 14 extent possible, develop cooperative efforts for advertising
  7 15 with contributions from other sources.
  7 16    Sec. 2.  COMMUNITY DEVELOPMENT LOAN FUND.  Notwithstanding
  7 17 section 15E.120, subsections 5, 6, and 7, and section 15.287,
  7 18 there is appropriated from the Iowa community development loan
  7 19 fund all the moneys available during the fiscal year beginning
  7 20 July 1, 2001, and ending June 30, 2002, to the department of
  7 21 economic development for the community development program to
  7 22 be used by the department for the purposes of the program.
  7 23    Sec. 3.  JOB TRAINING FUND.  Notwithstanding section
  7 24 15.251, subsection 2, there is appropriated from the job
  7 25 training fund to the department of workforce development for
  7 26 the fiscal year beginning July 1, 2001, and ending June 30,
  7 27 2002, the following amount, or so much thereof as is
  7 28 necessary, to be used for the purpose designated:
  7 29    1.  To provide final phase-out funding for existing labor
  7 30 management projects:  
  7 31 .................................................. $     30,000
  7 32    2.  After the appropriation in subsection 1 relating to
  7 33 labor management projects, all remaining moneys in the job
  7 34 training fund, including any moneys appropriated or credited
  7 35 to the fund during the fiscal year, shall be transferred to
  8  1 the workforce development fund established pursuant to section
  8  2 15.343.
  8  3    Sec. 4.  WORKFORCE DEVELOPMENT FUND.  There is appropriated
  8  4 from the workforce development fund account created in section
  8  5 15.342A, to the workforce development fund created in section
  8  6 15.343, for the fiscal year beginning July 1, 2001, and ending
  8  7 June 30, 2002, the following amount, for the purposes of the
  8  8 workforce development fund, and for not more than the
  8  9 following full-time equivalent positions:

  8 12    Sec. 5.  From funds appropriated or transferred to or
  8 13 receipts credited to the workforce development fund created in
  8 14 section 15.343, up to $400,000 for the fiscal year beginning
  8 15 July 1, 2001, and ending June 30, 2002, may be used for the
  8 16 administration of workforce development activities including
  8 17 salaries, support, maintenance, and miscellaneous purposes and
  8 18 for not more than 4.00 FTEs.
  8 19    Sec. 6.  IOWA STATE UNIVERSITY.  There is appropriated from
  8 20 the general fund of the state to the Iowa state university of
  8 21 science and technology for the fiscal year beginning July 1,
  8 22 2001, and ending June 30, 2002, the following amounts, or so
  8 23 much thereof as is necessary, to be used for the purposes
  8 24 designated:
  8 25    1.  For funding and maintaining in their current locations
  8 26 the existing small business development centers, and for not
  8 27 more than the following full-time equivalent positions:  
  8 28 .................................................. $  1,147,192
  8 29 ............................................... FTEs       5.80
  8 30    2.  For the Iowa state university of science and technology
  8 31 research park, including salaries, support, maintenance,
  8 32 miscellaneous purposes, and for not more than the following
  8 33 full-time equivalent positions:

  9  1    3.  For funding the institute for physical research and
  9  2 technology, provided that $287,640 shall be allocated to the
  9  3 industrial incentive program, and for not more than the
  9  4 following full-time equivalent positions:

  9  7    It is the intent of the general assembly that the
  9  8 industrial incentive program focus on Iowa industrial sectors
  9  9 and seek contributions and in-kind donations from businesses,
  9 10 industrial foundations, and trade associations and that moneys
  9 11 for the institute for physical research and technology
  9 12 industrial incentive program shall only be allocated for
  9 13 projects which are matched by private sector moneys for
  9 14 directed contract research or for nondirected research.  The
  9 15 match required of small businesses as defined in section
  9 16 15.102, subsection 4, for directed contract research or for
  9 17 nondirected research shall be $1 for each $3 of state funds.
  9 18 The match required for other businesses for directed contract
  9 19 research or for nondirected research shall be $1 for each $1
  9 20 of state funds.  The match required of industrial foundations
  9 21 or trade associations shall be $1 for each $1 of state funds.
  9 22    Iowa state university of science and technology shall
  9 23 report annually to the joint appropriations subcommittee on
  9 24 economic development and the legislative fiscal bureau the
  9 25 total amounts of private contributions, the proportion of
  9 26 contributions from small businesses and other businesses, and
  9 27 the proportion for directed contract research and nondirected
  9 28 research of benefit to Iowa businesses and industrial sectors.
  9 29    Notwithstanding section 8.33, moneys appropriated in this
  9 30 section that remain unencumbered or unobligated at the close
  9 31 of the fiscal year shall not revert but shall remain available
  9 32 for expenditure for the purposes designated until the close of
  9 33 the succeeding fiscal year.
  9 34    Sec. 7.  UNIVERSITY OF IOWA.  There is appropriated from
  9 35 the general fund of the state to the state university of Iowa
 10  1 for the fiscal year beginning July 1, 2001, and ending June
 10  2 30, 2002, the following amounts, or so much thereof as is
 10  3 necessary, to be used for the purposes designated:
 10  4    1.  For the university of Iowa research park, including
 10  5 salaries, support, maintenance, equipment, miscellaneous
 10  6 purposes, and for not more than the following full-time
 10  7 equivalent positions:  
 10  8 .................................................. $    320,560
 10  9 ............................................... FTEs       2.70
 10 10    2.  For funding the advanced drug development program at
 10 11 the Oakdale research park, and for not more than the following
 10 12 full-time equivalent positions:

 10 15    The board of regents shall submit a report on the progress
 10 16 of regents institutions in meeting the strategic plan for
 10 17 technology transfer and economic development to the secretary
 10 18 of the senate, the chief clerk of the house of
 10 19 representatives, and the legislative fiscal bureau by January
 10 20 15, 2002.
 10 21    Sec. 8.  UNIVERSITY OF NORTHERN IOWA.  There is
 10 22 appropriated from the general fund of the state to the
 10 23 university of northern Iowa for the fiscal year beginning July
 10 24 1, 2001, and ending June 30, 2002, the following amounts, or
 10 25 so much thereof as is necessary, to be used for the purposes
 10 26 designated:
 10 27    1.  For the metal casting institute, including salaries,
 10 28 support, maintenance, miscellaneous purposes, and for not more
 10 29 than the following full-time equivalent positions:

 10 32    2.  For the institute of decision making, including
 10 33 salaries, support, maintenance, miscellaneous purposes, and

 11  3    Sec. 9.  DEPARTMENT OF WORKFORCE DEVELOPMENT.  There is
 11  4 appropriated from the general fund of the state, to the
 11  5 department of workforce development for the fiscal year
 11  6 beginning July 1, 2001, and ending June 30, 2002, the
 11  7 following amounts, or so much thereof as is necessary, for the
 11  8 purposes designated:
 11  9    1.  DIVISION OF LABOR SERVICES
 11 10    For the division of labor services, including salaries,
 11 11 support, maintenance, miscellaneous purposes, and for not more
 11 12 than the following full-time equivalent positions:  
 11 13 .................................................. $  3,290,446
 11 14 ............................................... FTEs      92.00
 11 15    From the contractor registration fees, the division of
 11 16 labor services shall reimburse the department of inspections
 11 17 and appeals for all costs associated with hearings under
 11 18 chapter 91C, relating to contractor registration.
 11 19    2.  DIVISION OF WORKERS' COMPENSATION
 11 20    For salaries, support, maintenance, miscellaneous purposes,
 11 21 and for not more than the following full-time equivalent
 11 22 positions:

 11 25    The division of workers' compensation shall continue
 11 26 charging a $65 filing fee for workers' compensation cases.
 11 27 The filing fee shall be paid by the petitioner of a claim.
 11 28 However, the fee can be taxed as a cost and paid by the losing
 11 29 party, except in cases where it would impose an undue hardship
 11 30 or be unjust under the circumstances.
 11 31    3.  WORKFORCE DEVELOPMENT STATE AND REGIONAL BOARDS
 11 32    For salaries, support, maintenance, miscellaneous purposes,
 11 33 and for not more than the following full-time equivalent
 11 34 positions for the workforce development state and regional
 11 35 boards:

 12  3    4.  NEW EMPLOYMENT OPPORTUNITY FUND
 12  4    For salaries, support, maintenance, and miscellaneous
 12  5 purposes, and for not more than the following full-time

 12  7 program established in section 84A.10:

 12 10    Notwithstanding section 8.33, moneys appropriated in this
 12 11 subsection which remain unexpended or unobligated on June 30,
 12 12 2002, shall not revert to the general fund of the state but
 12 13 shall remain available for expenditure for the same purpose
 12 14 during the fiscal year beginning July 1, 2002.
 12 15    Sec. 10.  ADMINISTRATIVE CONTRIBUTION SURCHARGE FUND.
 12 16 Notwithstanding section 96.7, subsection 12, paragraph "c",
 12 17 there is appropriated from the administrative contribution
 12 18 surcharge fund of the state to the department of workforce
 12 19 development for the fiscal year beginning July 1, 2001, and
 12 20 ending June 30, 2002, any moneys remaining in the
 12 21 administrative contribution surcharge fund on June 30, 2001,
 12 22 and the entire amount collected during the fiscal year
 12 23 beginning July 1, 2001, and ending June 30, 2002, or so much
 12 24 thereof as is necessary, for salaries, support, maintenance,
 12 25 conducting labor market surveys, miscellaneous purposes, and
 12 26 for workforce development regional advisory board member
 12 27 expenses.
 12 28    Sec. 11.  EMPLOYMENT SECURITY CONTINGENCY FUND.  There is
 12 29 appropriated from the special employment security contingency
 12 30 fund to the department of workforce development for the fiscal
 12 31 year beginning July 1, 2001, and ending June 30, 2002, the
 12 32 following amounts, or so much thereof as is necessary, for the
 12 33 purposes designated:
 12 34    1.  DIVISION OF WORKERS' COMPENSATION
 12 35    For salaries, support, maintenance, and miscellaneous
 13  1 purposes:  
 13  2 .................................................. $    471,000
 13  3    2.  IMMIGRATION SERVICE CENTERS
 13  4    For salaries, support, maintenance, and miscellaneous
 13  5 purposes for the establishment of pilot immigration service
 13  6 centers:  
 13  7 .................................................. $    160,000
 13  8    3.  LABOR MARKET INFORMATION
 13  9    For salaries, support, maintenance, miscellaneous purposes
 13 10 for collection of labor market information, and for not more
 13 11 than the following full-time equivalent positions:  
 13 12 .................................................. $     67,078
 13 13 ............................................... FTEs       1.20
 13 14    The department of workforce development shall maintain
 13 15 pilot immigration service centers that offer one-stop services
 13 16 to deal with the multiple issues related to immigration and
 13 17 employment.  The pilot centers shall be designed to support
 13 18 workers, businesses, and communities with information,
 13 19 referrals, job placement assistance, translation, language
 13 20 training, resettlement, as well as technical and legal
 13 21 assistance on such issues as forms and documentation.  Through
 13 22 the coordination of local, state, and federal service
 13 23 providers, and through the development of partnerships with
 13 24 public, private, and nonprofit entities with established
 13 25 records of international service, these pilot centers shall
 13 26 seek to provide a seamless service delivery system for new
 13 27 Iowans.
 13 28    Any additional penalty and interest revenue may be used to
 13 29 accomplish the mission of the department upon notification of
 13 30 the use to the chairpersons and ranking members of the joint
 13 31 appropriations subcommittee on economic development, the
 13 32 department of management, and the legislative fiscal bureau.
 13 33 However, the department shall not allocate any additional
 13 34 penalty and interest revenue prior to January 30, 2002.
 13 35    Sec. 12.  PUBLIC EMPLOYMENT RELATIONS BOARD.  There is
 14  1 appropriated from the general fund of the state to the public
 14  2 employment relations board for the fiscal year beginning July
 14  3 1, 2001, and ending June 30, 2002, the following amount, or so
 14  4 much thereof as is necessary, for the purposes designated:
 14  5    For salaries, support, maintenance, miscellaneous purposes,
 14  6 and for not more than the following full-time equivalent
 14  7 positions:

 14 10    Sec. 13.  TOURISM OPERATIONS.  There is appropriated from
 14 11 the community attraction and tourism fund created in section
 14 12 15F.204 to the department of economic development for the
 14 13 fiscal year beginning July 1, 2001, and ending June 30, 2002,
 14 14 the following amount, or so much thereof as is necessary, to
 14 15 be used for the purposes designated:
 14 16    For tourism operations, including salaries, support,
 14 17 maintenance, and miscellaneous purposes:  
 14 18 .................................................. $  1,200,000
 14 19    Sec. 14.  HOUSING AND SHELTER ASSISTANCE.  There is
 14 20 appropriated from the Iowa finance authority to the department
 14 21 of economic development for the fiscal year beginning July 1,
 14 22 2001, and ending June 30, 2002, the following amount, or so
 14 23 much thereof as is necessary, to be used for the purposes
 14 24 designated:
 14 25    For providing technical assistance to communities of all
 14 26 sizes and local financial institutions to help meet local
 14 27 housing needs and for the shelter assistance fund, and for not
 14 28 more than the following full-time equivalent positions:  
 14 29 .................................................. $    500,000
 14 30 ............................................... FTEs       2.00
 14 31    Sec. 15.  Notwithstanding the requirements of section
 14 32 16.10, subsections 1 and 2, the Iowa finance authority shall,
 14 33 for the fiscal year beginning July 1, 2001, transfer
 14 34 $1,200,000 to the department of economic development for
 14 35 deposit in the community development block grant account to be
 15  1 used as state matching funds for the federal HOME program.
 15  2    Sec. 16.  1998 Iowa Acts, chapter 1225, section 27,
 15  3 unnumbered paragraph 6, is amended to read as follows:
 15  4    Following the complete liquidation and dissolution of the
 15  5 corporation or the sale of the corporation, all remaining
 15  6 moneys shall be transferred to the strategic investment fund.
 15  7 The liquidation, dissolution, or sale of the corporation shall
 15  8 be completed by December 31, 2001.  Upon transfer of the
 15  9 remaining moneys to the strategic investment fund, the ISCC
 15 10 liquidation corporation board shall be dissolved.
 15 11    Sec. 17.  1999 Iowa Acts, chapter 197, section 9,
 15 12 subsection 7, unnumbered paragraph 2, is amended to read as
 15 13 follows:
 15 14    Notwithstanding section 8.33, moneys appropriated in this
 15 15 subsection which remain unexpended or unobligated on June 30,
 15 16 2000, shall not revert to the general fund of the state but
 15 17 shall remain available for expenditure for the same purpose
 15 18 during the fiscal year years beginning July 1, 2000, and July
 15 19 1, 2001.
 15 20    Sec. 18.  2000 Iowa Acts, chapter 1230, section 10,
 15 21 subsection 7, is amended to read as follows:
 15 22    7.  NEW EMPLOYMENT OPPORTUNITY FUND
 15 23    For salaries, support, maintenance, and miscellaneous
 15 24 purposes, and for not more than the following full-time
 15 25 equivalent positions for the new employment opportunity
 15 26 program established in section 84A.10:  
 15 27 .................................................. $    500,000
 15 28 ............................................... FTEs       1.79
 15 29    Notwithstanding section 8.33, moneys appropriated in this
 15 30 subsection which remain unexpended or unobligated on June 30,
 15 31 2001, shall not revert to the general fund but shall remain
 15 32 available for expenditure for the same purpose during the
 15 33 fiscal year beginning July 1, 2001.
 15 34    Sec. 19.  2000 Iowa Acts, chapter 1230, section 11,
 15 35 unnumbered paragraph 3, is amended to read as follows:
 16  1    In addition to moneys appropriated by this section,
 16  2 notwithstanding section 96.7, subsection 12, paragraph "c",
 16  3 for the fiscal year beginning July 1, 2000, there is
 16  4 appropriated from the administrative contribution surcharge
 16  5 fund of the state to the department of workforce development
 16  6 $700,000, or so much thereof as is necessary, for matching
 16  7 funds for welfare-to-work grants authorized through the United
 16  8 States department of labor.  Notwithstanding section 8.33,
 16  9 moneys appropriated in this unnumbered paragraph that remain
 16 10 unencumbered or unobligated on June 30, 2001, shall not revert
 16 11 but shall remain available for expenditure for the purposes
 16 12 designated for the fiscal year beginning July 1, 2001.
 16 13    Sec. 20.  2000 Iowa Acts, chapter 1230, section 12,
 16 14 subsection 2, is amended to read as follows:
 16 15    2.  IMMIGRATION SERVICE CENTERS
 16 16    For salaries, support, maintenance, and miscellaneous
 16 17 purposes for the establishment of pilot immigration service
 16 18 centers:  
 16 19 .................................................. $    160,000
 16 20    The department of workforce development shall establish
 16 21 pilot immigration service centers that offer one-stop services
 16 22 to deal with the multiple issues related to immigration and
 16 23 employment.  The pilot centers shall be designed to support
 16 24 workers, businesses, and communities with information,
 16 25 referrals, job placement assistance, translation, language
 16 26 training, resettlement, as well as technical and legal
 16 27 assistance on such issues as forms and documentation.  Through
 16 28 the coordination of local, state, and federal service
 16 29 providers, and through the development of partnerships with
 16 30 public, private, and nonprofit entities with established
 16 31 records of international service, these pilot centers shall
 16 32 seek to provide a seamless service delivery system for new
 16 33 Iowans.
 16 34    Notwithstanding section 8.33, moneys appropriated in this
 16 35 subsection which remain unexpended or unobligated on June 30,
 17  1 2001, shall not revert but shall remain available for
 17  2 expenditure for the same purpose during the fiscal year
 17  3 beginning July 1, 2001.
 17  4    Sec. 21.  Section 15.342A, Code 2001, is amended to read as
 17  5 follows:
 17  6    15.342A  WORKFORCE DEVELOPMENT FUND ACCOUNT.
 17  7    A workforce development fund account is established in the
 17  8 office of the treasurer of state under the control of the
 17  9 department.  The account shall receive funds pursuant to
 17 10 section 422.16A up to a maximum of eight four million dollars
 17 11 per year.  The account shall also receive funds pursuant to
 17 12 section 15.251 with no dollar limitation.
 17 13    Sec. 22.  Section 15.343, subsection 3, paragraph b, Code
 17 14 2001, is amended by striking the paragraph and inserting in
 17 15 lieu thereof the following:
 17 16    b.  Moneys in the workforce development fund shall be
 17 17 allocated as follows:
 17 18    (1)  Three million dollars shall be used for purposes
 17 19 provided in section 260F.6.
 17 20    (2)  One million dollars shall be used for purposes
 17 21 provided in section 260F.6B.
 17 22    Sec. 23.  Section 90A.12, subsection 1, Code 2001, is
 17 23 amended to read as follows:
 17 24    1.  A person age thirty-three years or older shall not
 17 25 participate as a contestant in an organized amateur boxing
 17 26 contest unless each contestant participating in the contest is
 17 27 age thirty-three years or older meets the age requirements of
 17 28 USA boxing incorporated, or its successor organization.  A
 17 29 birth certificate, or similar document validating the
 17 30 contestant's date of birth, must be submitted at the time of
 17 31 the prefight physical examination in order to determine
 17 32 eligibility.
 17 33    Sec. 24.  Section 260F.6, Code 2001, is amended by adding
 17 34 the following new subsection:
 17 35    NEW SUBSECTION.  3.  Notwithstanding the requirements of
 18  1 this section, moneys in the job training fund may be used by a
 18  2 community college to conduct entrepreneur development and
 18  3 support activities.
 18  4    Sec. 25.  Section 321.52A, subsection 2, Code 2001, is
 18  5 amended to read as follows:
 18  6    2.  For the fiscal year beginning July 1, 1996, the
 18  7 treasurer of state shall deposit one million five hundred
 18  8 thousand dollars of moneys received under subsection 1 in the
 18  9 waste tire management fund created in section 455D.11C, and
 18 10 deposit the remainder in the general fund of the state.  For
 18 11 the fiscal year beginning July 1, 1997, the treasurer of state
 18 12 shall deposit two million five hundred thousand dollars of
 18 13 moneys received under subsection 1 in the waste tire
 18 14 management fund, and deposit the remainder in the general fund
 18 15 of the state.  For the fiscal year beginning July 1, 1998, and
 18 16 the fiscal year beginning July 1, 1999, the treasurer of state
 18 17 shall deposit three million five hundred thousand dollars of
 18 18 moneys received under subsection 1 in the waste tire
 18 19 management fund, and deposit the remainder in the general fund
 18 20 of the state.  For the fiscal year beginning July 1, 2000, the
 18 21 treasurer of state shall deposit two million five hundred
 18 22 thousand dollars of the moneys received under subsection 1 in
 18 23 the waste tire management fund, and one million dollars in the
 18 24 road use tax fund, with the remainder deposited in the general
 18 25 fund of the state.  For the fiscal year beginning July 1,
 18 26 2001, the treasurer of state shall deposit one million five
 18 27 hundred thousand dollars of moneys received under subsection 1
 18 28 in the waste tire management fund, and three million dollars
 18 29 in the road use tax fund, with the remainder deposited in the
 18 30 general fund of the state.  For the fiscal year beginning July
 18 31 1, 2002, and each subsequent fiscal year, the treasurer of
 18 32 state shall deposit the entire amount of moneys received under
 18 33 subsection 1 in the road use tax fund.
 18 34    Sec. 26.  Section 422.16A, Code 2001, is amended to read as
 18 35 follows:
 19  1    422.16A  JOB TRAINING WITHHOLDING – CERTIFICATION AND
 19  2 TRANSFER.
 19  3    Upon the completion by a business of its repayment
 19  4 obligation for a training project funded under chapter 260E,
 19  5 including a job training project funded under section 15A.8 or
 19  6 repaid in whole or in part by the supplemental new jobs credit
 19  7 from withholding under section 15A.7 or section 15.331, the
 19  8 sponsoring community college shall report to the department of
 19  9 economic development the amount of withholding paid by the
 19 10 business to the community college during the final twelve
 19 11 months of withholding payments.  The department of economic
 19 12 development shall notify the department of revenue and finance
 19 13 of that amount.  The department shall credit to the workforce
 19 14 development fund account established in section 15.342A
 19 15 twenty-five percent of that amount each quarter for a period
 19 16 of ten years.  If the amount of withholding from the business
 19 17 or employer is insufficient, the department shall prorate the
 19 18 quarterly amount credited to the workforce development fund
 19 19 account.  The maximum amount from all employers which shall be
 19 20 transferred to the workforce development fund account in any
 19 21 year is eight four million dollars.
 19 22    Sec. 27.  SHELTER ASSISTANCE FUND.  In providing moneys
 19 23 from the shelter assistance fund to homeless shelter programs
 19 24 in the fiscal year beginning July 1, 2001, and ending June 30,
 19 25 2002, the department of economic development shall explore the
 19 26 potential of allocating moneys to homeless shelter programs
 19 27 based in part on their ability to move their clients toward
 19 28 self-sufficiency.
 19 29    Sec. 28.  BUDGET PROPOSALS.  The department of economic
 19 30 development and the department of workforce development shall
 19 31 submit all budget proposals in the traditional format as well
 19 32 as in the budgeting for results format for the fiscal year
 19 33 beginning July 1, 2002.
 19 34    Sec. 29.  By December 31 of each year, the ISCC liquidation
 19 35 corporation shall submit an annual written report to the
 20  1 chairpersons and the ranking members of the joint
 20  2 appropriations subcommittee on economic development.  The
 20  3 report shall include an update on the financial condition of
 20  4 the corporation relating to the status of any moneys, assets,
 20  5 or contracts currently being held by the corporation or
 20  6 transferred by the corporation during the prior year.
 20  7    Sec. 30.  FEDERAL GRANTS.  All federal grants to and the
 20  8 federal receipts of agencies appropriated funds under this
 20  9 Act, not otherwise appropriated, are appropriated for the
 20 10 purposes set forth in the federal grants or receipts unless
 20 11 otherwise provided by the general assembly.
 20 12    Sec. 31.  Notwithstanding section 96.9, subsection 4,
 20 13 paragraph "a", moneys credited to the state by the secretary
 20 14 of the treasury of the United States pursuant to section 903
 20 15 of the Social Security Act shall be appropriated to the
 20 16 department of workforce development and shall be used by the
 20 17 department for the administration of the unemployment
 20 18 compensation program only.  This appropriation shall not apply
 20 19 to any fiscal year after December 31, 2002.
 20 20    Sec. 32.  In lieu of the appropriation made in section
 20 21 15.365, subsection 3, there is appropriated for the fiscal
 20 22 year beginning July 1, 2001, and ending June 30, 2002,
 20 23 $35,000, or so much thereof as is necessary, from the general
 20 24 fund of the state to the department of economic development to
 20 25 pay refunds as provided under section 15.365.
 20 26    Sec. 33.  EFFECTIVE DATE.  Sections 17, 18, 19, and 20 of
 20 27 this Act, being deemed of immediate importance, take effect
 20 28 upon enactment.
