PAG LIN 1 1 HOUSE FILE 694 1 2 1 3 AN ACT 1 4 RELATING TO HOUSING BY CREATING A HOUSING TRUST FUND AND A 1 5 HOUSING TRUST COMMISSION. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. NEW SECTION. 16.181 HOUSING TRUST FUND. 1 10 A housing trust fund is created in the state treasury. The 1 11 fund shall be administered jointly by the Iowa finance 1 12 authority and the department of economic development. Moneys 1 13 in the fund are annually appropriated to the Iowa finance 1 14 authority and the department of economic development. Moneys 1 15 in the fund shall be used for any housing-related program 1 16 administered by the Iowa finance authority and the department 1 17 of economic development. Payments of interest, repayments of 1 18 moneys loaned pursuant to this chapter, and recaptures of 1 19 grants or loans shall be deposited in the fund. Moneys in the 1 20 fund are not subject to section 8.33. Notwithstanding section 1 21 12C.7, subsection 2, interest or earnings on moneys in the 1 22 fund shall be credited to the fund. 1 23 Sec. 2. NEW SECTION. 16.182 HOUSING TRUST COMMISSION. 1 24 1. A housing trust commission is established consisting of 1 25 nine members. The Iowa finance authority shall provide office 1 26 space, staff assistance, and necessary supplies and equipment 1 27 for the commission. In performing its functions, the 1 28 commission is performing a public function on behalf of the 1 29 state and is a public instrumentality of the state. 1 30 2. The membership of the commission shall be appointed as 1 31 follows: 1 32 a. One representative of a city with a population of less 1 33 than five thousand. 1 34 b. One representative of a city with a population of 1 35 seventy-five thousand or more. 2 1 c. One representative of a county with a population of 2 2 less than twenty-five thousand. 2 3 d. One representative of a county with a population of one 2 4 hundred thousand or more. 2 5 e. One person with expertise in the area of mortgages and 2 6 lending. 2 7 f. One person with expertise as a housing developer. 2 8 g. One person with expertise in working with low-income 2 9 housing issues with a nonprofit organization. 2 10 h. One person with expertise in economic development 2 11 issues. 2 12 i. One member of the general public. 2 13 3. All appointments shall be made by the governor, shall 2 14 comply with sections 69.16 and 69.16A, and shall be subject to 2 15 confirmation by the senate pursuant to section 2.32. All 2 16 appointed members of the commission shall have demonstrable 2 17 expertise or expertise in housing-related issues. 2 18 4. The members of the commission shall select a 2 19 chairperson and vice chairperson from their membership. 2 20 5. Commission members shall be appointed to three-year 2 21 staggered terms and the terms shall commence and end as 2 22 provided by section 69.19. A member shall not serve more than 2 23 two terms. If a vacancy occurs, a successor shall be 2 24 appointed to serve the unexpired term. A successor shall be 2 25 appointed in the same manner and subject to the same 2 26 qualifications as the original appointment to serve the 2 27 unexpired term. Commission members shall be eligible to 2 28 receive compensation as provided in section 7E.6. 2 29 6. A majority of the commission constitutes a quorum. 2 30 7. By January 1 of each year, the commission shall submit 2 31 an annual written report to the general assembly and the 2 32 governor regarding, at a minimum, the activities of the 2 33 commission and any recommendations regarding legislation. 2 34 Sec. 3. NEW SECTION. 16.183 REPEAL. 2 35 Section 16.182 is repealed on June 30, 2004. 3 1 Sec. 4. RECOMMENDATIONS AND IMPLEMENTATION. By January 1, 3 2 2002, the housing trust commission, in cooperation with the 3 3 Iowa finance authority, the department of economic 3 4 development, the attorney general, and the department of 3 5 public health, shall submit an interim progress report to the 3 6 general assembly and the governor which shall include 3 7 preliminary findings regarding the implementation of the 3 8 consolidation of all housing programs under one agency. By 3 9 January 1, 2003, the housing trust commission, in cooperation 3 10 with the Iowa finance authority, the department of economic 3 11 development, the attorney general, and the department of 3 12 public health, shall submit a final report to the general 3 13 assembly and the governor which shall include the final 3 14 findings and recommendations for the implementation of the 3 15 consolidation of all housing programs under one agency. 3 16 3 17 3 18 3 19 BRENT SIEGRIST 3 20 Speaker of the House 3 21 3 22 3 23 3 24 MARY E.
