1 4 RELATING TO THE SCHOOL-TO-CAREER PROGRAM.

1 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 8 Section 1. Section 15.362, Code 2001, is amended by adding
1 9 the following new subsection:
1 10 NEW SUBSECTION. 1A. "Employer" means an employer or a
1 11 consortium of two or more employers.
1 12 Sec. 2. Section 15.364, subsection 6, Code 2001, is
1 13 amended to read as follows:
1 14 6. That in addition to the base wage paid to the
1 15 participant, the employer shall pay an additional sum to be
1 16 held in trust to be applied toward the participant's
1 17 postsecondary education required for completion of the
1 18 certified program. The additional amount must be not less
1 19 than an amount determined by the department of economic
1 20 development to be sufficient to provide payment of tuition
1 21 expenses toward completion of not more than two academic years
1 22 of the required postsecondary education component of the
1 23 certified program at an Iowa community college or an Iowa
1 24 public or private college or university. This amount shall be
1 25 held in trust for the benefit of the participant pursuant to
1 26 rules adopted by the department of economic development.
1 27 Payment into an ERISA-approved fund for the benefit of the
1 28 participant shall satisfy this requirement. The specific fund
1 29 shall be specified in the agreement. An employer that is a
1 30 consortium of two or more employers shall not be subject to
1 31 the requirements of this subsection if tuition is included as
1 32 part of a stipend paid by the employer to a participant and
1 33 can be identified as such.
1 34 Sec. 3. Section 15.364, subsections 7 and 8, Code 2001,
1 35 are amended by striking the subsections.
2 1 Sec. 4. Section 15.365, subsection 1, Code 2001, is
2 2 amended to read as follows:
2 3 1. An employer who employs a participant in a certified
2 4 school-to-career program may claim a refund of twenty percent
2 5 of the employer's payroll expenditures for each participant in
2 6 the certified program or twenty percent of the employer's
2 7 expenditures for participant experience expenses provided for
2 8 in the certified program agreement which may include
2 9 instructor expenses, instructional materials, up to one
2 10 hundred fifty thousand dollars of training facility costs per
2 11 program, and project coordination. The refund is limited to
2 12 the first four hundred hours of payroll or participant
2 13 experience expenditures per participant for each calendar year
2 14 the participant is in the certified program, not to exceed
2 15 three years per participant.
