PAG LIN 1 1 HOUSE FILE 670 1 2 1 3 AN ACT 1 4 RELATING TO PRACTITIONER PREPARATION PROGRAMS BY PROVIDING FOR 1 5 THE ESTABLISHMENT OF NONTRADITIONAL PRACTITIONER PREPARATION 1 6 AND LICENSURE AND BY PROVIDING FOR A STUDY OF PRACTITIONER 1 7 PREPARATION PROGRAMS. 1 8 1 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 10 1 11 Section 1. Section 256.7, Code 2001, is amended by adding 1 12 the following new subsection: 1 13 NEW SUBSECTION. 25. Prescribe standards and procedures 1 14 for the approval by the state board of nontraditional 1 15 practitioner and administrator preparation internship programs 1 16 to be offered by practitioner preparation institutions. 1 17 Sec. 2. Section 256.16, Code 2001, is amended by adding 1 18 the following new subsections: 1 19 NEW SUBSECTION. 3. a. The state board shall adopt rules 1 20 requiring that practitioner preparation institutions, which 1 21 provide a nontraditional practitioner preparation internship 1 22 program, at a minimum, meet the standards and comply with the 1 23 standards established pursuant to section 256.7, subsection 1 24 25. A nontraditional practitioner preparation internship 1 25 program is exempt from the student teaching or field 1 26 experience requirements of section 272.25. A nontraditional 1 27 practitioner preparation internship program shall include 1 28 coursework in education theory, instructional methods, and 1 29 classroom management. The program shall consist of two 1 30 twelve-semester-hour, or the trimester or quarter equivalent, 1 31 courses of study. 1 32 b. The institution providing the nontraditional 1 33 practitioner preparation internship program shall enter into a 1 34 written agreement with a school district, under terms and 1 35 conditions as agreed upon by the contracting parties, 2 1 providing that the school district will provide interns 2 2 seeking a nontraditional conditional teaching license with a 2 3 one-year classroom teaching experience. The intern must 2 4 successfully complete the first twelve-semester-hour, or the 2 5 trimester or quarter equivalent, course of study prior to 2 6 beginning the one-year classroom teaching experience. Interns 2 7 teaching in a school district under the terms of such a 2 8 contract are entitled to the same protection under section 2 9 670.8, as is afforded by that section to officers and other 2 10 employees of the school district, during the time they are so 2 11 assigned. 2 12 c. Upon completion of the first twelve-semester-hour, or 2 13 the trimester or quarter equivalent, course of study, the 2 14 institution providing the approved nontraditional practitioner 2 15 preparation internship program shall submit to the board of 2 16 educational examiners a recommendation for licensure of the 2 17 intern pursuant to section 272.2, subsection 13, paragraph 2 18 "b". If the institution recommends licensure, the intern 2 19 shall be issued a nontraditional conditional teaching license 2 20 by the board of educational examiners. However, the 2 21 provisions of section 272.6 shall apply. 2 22 d. Prior to licensure as a provisional teacher, unless the 2 23 requirement is waived in accordance with this subsection for 2 24 interns seeking licensure under section 272.2, subsection 13, 2 25 paragraph "b", an individual shall successfully complete the 2 26 second twelve-semester-hour, or the trimester or quarter 2 27 equivalent, course of study. The institution providing the 2 28 approved nontraditional practitioner preparation internship 2 29 program may waive all or part of the second course of an 2 30 intern's study based upon the institution's comprehensive 2 31 evaluation of the intern. 2 32 e. During the first nine weeks of employment, the 2 33 practitioner preparation institution shall monitor the 2 34 performance of the intern. The institution that delivers the 2 35 coursework to a practitioner pursuant to this subsection 3 1 shall, along with the school district that employs the 3 2 conditional practitioner, supervise the conditional 3 3 practitioner during the practitioner's year of employment 3 4 under a nontraditional conditional license, and shall, in 3 5 consultation with the practitioner's evaluator at the school 3 6 district of employment, submit to the board of educational 3 7 examiners a comprehensive evaluation of the practitioner's 3 8 performance sixty days prior to the expiration of the 3 9 nontraditional conditional license. If the comprehensive 3 10 evaluation establishes that the conditional practitioner's 3 11 performance fails to meet the standards of the approved 3 12 nontraditional practitioner preparation internship program, 3 13 the individual shall not be admitted to a second course of 3 14 study offered by an approved nontraditional practitioner 3 15 preparation internship program. 3 16 NEW SUBSECTION. 4. a. The state board shall adopt rules 3 17 requiring that practitioner preparation institutions which 3 18 provide a nontraditional administrator preparation internship 3 19 program, at a minimum, meet the standards and comply with the 3 20 standards established pursuant to section 256.7, subsection 3 21 25. A nontraditional administrator preparation internship 3 22 program shall include coursework in education management, 3 23 governance organization, and planning. The program shall 3 24 consist of two twelve-semester-hour, or the trimester or 3 25 quarter equivalent, courses of study. 3 26 b. The institution providing the nontraditional 3 27 administrator preparation internship program shall enter into 3 28 a written agreement with the board of directors of a school 3 29 district, under terms and conditions as agreed upon by the 3 30 contracting parties, providing that the school district will 3 31 provide interns seeking a nontraditional conditional 3 32 administrator license with one year of administrative 3 33 experience. Interns employed under the written agreement are 3 34 entitled to the same protection under section 670.8, as is 3 35 afforded by that section to officers and other employees of 4 1 the school district, during the time they are so assigned. 4 2 c. Upon completion of the first twelve-semester-hour, or 4 3 the trimester or quarter equivalent, course of study, the 4 4 institution providing the approved nontraditional 4 5 administrator preparation internship program shall submit to 4 6 the board of educational examiners a recommendation for 4 7 licensure of the intern pursuant to section 272.2, subsection 4 8 13, paragraph "a". If the institution recommends licensure, 4 9 the intern shall be issued a nontraditional conditional 4 10 license by the board of educational examiners. However, 4 11 section 272.6 shall apply. 4 12 d. Prior to licensure as an administrator, unless the 4 13 requirement is waived in accordance with this subsection for 4 14 interns seeking licensure under section 272.2, subsection 13, 4 15 paragraph "a", an individual shall successfully complete the 4 16 second twelve-semester-hour, or the trimester or quarter 4 17 equivalent, course of study. The institution providing the 4 18 approved nontraditional administrator preparation internship 4 19 program may waive all or part of the second course of an 4 20 intern's study based upon the institution's comprehensive 4 21 evaluation of the intern. 4 22 e. The institution that delivers the coursework to an 4 23 intern pursuant to this subsection shall supervise the 4 24 conditional administrator during the intern's year of 4 25 employment under a nontraditional conditional license, and 4 26 shall, in consultation with the board of directors of the 4 27 school district of employment, submit to the board of 4 28 educational examiners a comprehensive evaluation of the 4 29 intern's performance sixty days prior to the expiration of the 4 30 nontraditional conditional license. If the comprehensive 4 31 evaluation establishes that the intern's performance fails to 4 32 meet the standards of the approved nontraditional 4 33 administrator preparation internship program, the individual 4 34 shall not be admitted to a second course of study offered by 4 35 an approved nontraditional administrator preparation 5 1 internship program. 5 2 Sec. 3. Section 272.1, Code 2001, is amended by adding the 5 3 following new subsection: 5 4 NEW SUBSECTION. 5A. "Nontraditional conditional license" 5 5 means the authority that is given to allow a person to legally 5 6 serve as a teacher or administrator on a temporary basis while 5 7 the person completes a nontraditional practitioner preparation 5 8 internship program. 5 9 Sec. 4. Section 272.2, subsection 13, Code 2001, is 5 10 amended to read as follows: 5 11 13. Adopt rules to provide for nontraditionalpreparation5 12 licensing options for licensing persons who hold, at a 5 13 minimum, a bachelor's degree from an accredited college or 5 14 university, but who do not meet other requirements for 5 15 licensure. At a minimum, the rules shall provide for the 5 16 following: 5 17 a. An individual who possesses at least a master's degree 5 18 in business administration, public administration, or a 5 19 comparable degree, or who possesses at least a bachelor's 5 20 degree from an accredited postsecondary institution and life 5 21 experience equivalent to a master's degree in a management 5 22 field as determined by rule, and who has been employed for at 5 23 least ten of the last fifteen years in a management position, 5 24 may be issued a one-year, nonrenewable, nontraditional 5 25 conditional administrator's license if the individual 5 26 successfully completes a nontraditional administrator 5 27 preparation internship program in accordance with section 5 28 256.16, subsection 3. An individual may be issued an 5 29 administrator's license if the individual successfully 5 30 completes one year of employment as an administrator under a 5 31 nontraditional conditional license and successfully completes 5 32 the second course of study set forth in section 256.16, 5 33 subsection 3. However, an individual licensed pursuant to 5 34 this paragraph shall be licensed only to serve as a 5 35 superintendent in a school district with an actual enrollment 6 1 of five thousand five hundred or more pupils, at the time of 6 2 signing the initial contract for employment as a 6 3 superintendent. 6 4 b. An individual who possesses at least a bachelor's 6 5 degree from an accredited postsecondary institution, who has 6 6 been employed for at least five consecutive years in an area 6 7 requiring knowledge and practical application of the 6 8 individual's postsecondary academic background, who can 6 9 document, to the satisfaction of the board of educational 6 10 examiners, successful experience working with children, may be 6 11 issued a one-year, nonrenewable nontraditional conditional 6 12 license to teach students in grades nine through twelve in the 6 13 area of the individual's academic background and employment 6 14 experience, in the vocational education field or subject area 6 15 or in a shortage area as determined by the department, if the 6 16 individual meets the requirements of section 256.16, 6 17 subsection 3. In addition to these requirements, an 6 18 individual seeking a nontraditional conditional license to 6 19 teach special education students in grades nine through twelve 6 20 shall document, to the satisfaction of the board of 6 21 educational examiners, five years of successful experience 6 22 working with children requiring special education. An 6 23 individual may be issued a provisional license to teach 6 24 students in grades nine through twelve in the area of the 6 25 individual's academic background and employment experience if 6 26 the individual successfully completes one year of teaching 6 27 under a nontraditional conditional license and successfully 6 28 completes the second course of study set forth in section 6 29 256.16, subsection 3. 6 30 c. A person issued a provisional teaching license pursuant 6 31 to paragraph "b" shall successfully complete, at a minimum, a 6 32 two-year beginning teacher mentoring and induction program. 6 33 d. An approved nontraditional practitioner or 6 34 administrator preparation internship program, and the school 6 35 district with which the institution administering the program 7 1 has a written agreement in accordance with section 256.16, 7 2 subsection 3, shall provide information to the board and any 7 3 documentation regarding the intern's participation in the 7 4 program that the board may reasonably request. 7 5 Sec. 5. Section 272.2, Code 2001, is amended by adding the 7 6 following new subsection: 7 7 NEW SUBSECTION. 16. a. Administer the Praxis II 7 8 examination for knowledge of pedagogies and for not more than 7 9 one content area to each individual who is applying for a 7 10 nontraditional conditional license in accordance with 7 11 subsection 13, paragraph "b". 7 12 b. Examination fees for the examination required under 7 13 this subsection shall be paid by the board. Costs incurred 7 14 for additional content area examinations shall be paid by the 7 15 applicant. 7 16 c. The results of the examinations administered pursuant 7 17 to paragraph "a" shall be separately maintained from the 7 18 results of any examinations administered to traditionally 7 19 prepared students. 7 20 d. This subsection is repealed effective June 30, 2003. 7 21 Sec. 6. DEPARTMENTAL STUDIES. The department of education 7 22 shall do the following: 7 23 1. Compile and report, in consultation with the board of 7 24 educational examiners, information relating to nontraditional 7 25 practitioner preparation internship programs, including the 7 26 number of programs available and geographic areas in which 7 27 they are available, the number of individuals who apply for a 7 28 nontraditional conditional license, the number of individuals 7 29 possessing a nontraditional conditional license who apply for 7 30 a provisional license, the subject areas in which persons who 7 31 possess nontraditional conditional licenses are teaching and 7 32 where they are teaching. The department shall submit its 7 33 findings and recommendations in a report to the senate and 7 34 house of representatives standing committees on education by 7 35 December 1, 2002. 8 1 2. Analyze and compare, in consultation with the board of 8 2 educational examiners, the requirements for practitioner 8 3 licensure or endorsement that require a master's degree and 8 4 the master's degree requirements established by approved 8 5 practitioner preparation graduate programs. The institutions 8 6 offering approved practitioner preparation programs shall 8 7 submit information to the department as requested by the 8 8 department.
