  1  1    Section 1.  NEW SECTION.  15.296  BROWNFIELD SITE
  1  2 DETERMINATION – RISE FUNDS ELIGIBILITY.
  1  3    The department, in consultation with the brownfield
  1  4 redevelopment advisory council, at the request of an applicant
  1  5 for revitalize Iowa's sound economy fund financing, shall
  1  6 determine whether the site for which the applicant has applied
  1  7 for revitalize Iowa's sound economy fund financing under
  1  8 chapter 315 meets the definition of a brownfield site in
  1  9 section 15.291.  The department shall notify the state
  1 10 transportation commission of its determination under this
  1 11 section.  The department, in consultation with the state
  1 12 department of transportation, shall adopt rules for the
  1 13 administration of this section.
  1 14    Sec. 2.  Section 315.1, Code 2001, is amended by adding the
  1 15 following new subsections:
  1 16    NEW SUBSECTION.  0A.  "Brownfield site" means a site for
  1 17 which brownfield redevelopment program assistance has been
  1 18 awarded under section 15.292 or that meets the definition of a
  1 19 brownfield site in section 15.291, as determined by the
  1 20 department of economic development under section 15.296.
  1 21    NEW SUBSECTION.  3.  "Improving or maintaining highway
  1 22 access" includes new highway construction as well as the
  1 23 paving, resurfacing, or reconstruction of an existing highway
  1 24 when the project being developed is a brownfield site.
  1 25    Sec. 3.  Section 315.11, subsection 2, Code 2001, is
  1 26 amended by adding the following new paragraph:
  1 27    NEW PARAGRAPH.  h.  A project that would result in the
  1 28 development and use of a parcel of land that is a brownfield
  1 29 site.
  1 30    Sec. 4.  Section 315.11, Code 2001, is amended by adding
  1 31 the following new subsection:
  1 32    NEW SUBSECTION.  8.  In assessing applications for local
  1 33 development projects, the department shall do all of the
  1 34 following:
  1 35    a.  Evaluate the development potential of a proposed
  2  1 project involving a parcel of land that is a brownfield site
  2  2 in such a manner that considers the long-range potential for
  2  3 future job growth.
  2  4    b.  Establish an additional rating factor for proposed
  2  5 projects that involve the development of parcels of land that
  2  6 are brownfield sites.  
  2  7                           EXPLANATION
  2  8    This bill amends several provisions in Code chapter 315
  2  9 relating to the revitalize Iowa's sound economy (RISE) fund.
  2 10 The bill defines "improving or maintaining highway access", as
  2 11 used in the Code chapter for purposes of determining
  2 12 appropriate uses of the fund, as including new highway
  2 13 construction as well as the paving, resurfacing, or
  2 14 reconstruction of an existing highway when the project being
  2 15 developed is a brownfield site.
  2 16    The bill adds a factor to the list of factors to be given
  2 17 special consideration by the state department of
  2 18 transportation in ranking applications for RISE funds.  The
  2 19 factor added by the bill is a project's proposed development
  2 20 and use of a parcel of land that is a brownfield site.  The
  2 21 bill also provides that, in the consideration of applications
  2 22 for local development project RISE funds, applications for
  2 23 projects involving the development of parcels of land that
  2 24 meet the definition of a brownfield site under Code section
  2 25 15.291 shall have the development potential of the project
  2 26 evaluated in such a manner that considers the long-range
  2 27 potential for future job growth and shall be awarded points
  2 28 for an additional rating factor.
  2 29    The bill also creates new Code section 15.296 directing the
  2 30 department of economic development, in consultation with the
  2 31 brownfield redevelopment advisory council, to determine
  2 32 whether the site for which an applicant has applied for RISE
  2 33 financing meets the definition of a brownfield site in Code
  2 34 section 15.291.  The department of economic development is to
  2 35 make the determination at the request of the applicant for
  3  1 RISE financing and is to notify the state transportation
  3  2 commission of its determination.
  3  3    Code section 15.291 currently defines a "brownfield site"
  3  4 as an abandoned, idled, or underutilized industrial or
  3  5 commercial facility where expansion or redevelopment is
  3  6 complicated by real or perceived environmental contamination.
  3  7 A brownfield site includes property contiguous with the
  3  8 property on which the individual or commercial facility is
  3  9 located.  A brownfield site does not include property which
  3 10 has been placed or is proposed to be included on the national
  3 11 priorities list established pursuant to the federal
  3 12 Comprehensive Environmental Response, Compensation, and
  3 13 Liability Act.
