  1  4 MODIFYING PROHIBITIONS RELATING TO THE OPERATION OF AN
  1  5    ALL-TERRAIN VEHICLE OR SNOWMOBILE.  
  1  6 
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 321.234A, Code 2001, is amended by
  1 10 striking the section and inserting in lieu thereof the
  1 11 following:
  1 12    321.234A  ALL-TERRAIN VEHICLES – BICYCLE SAFETY FLAG
  1 13 REQUIRED.
  1 14    1.  All-terrain vehicles shall be operated on a highway
  1 15 only between sunrise and sunset and only when the operation on
  1 16 the highway is incidental to the vehicle's use for
  1 17 agricultural purposes.  A person operating an all-terrain
  1 18 vehicle on a highway shall have a valid driver's license and
  1 19 the vehicle shall be operated at speeds of thirty-five miles
  1 20 per hour or less.
  1 21    2.  A person convicted of a violation of this section is
  1 22 guilty of a simple misdemeanor punishable as a scheduled
  1 23 violation under section 805.8, subsection 4, paragraph "b".
  1 24    Sec. 2.  Section 321G.13, subsection 9, Code 2001, is
  1 25 amended by striking the subsection.
  1 26    Sec. 3.  Section 321G.13, subsection 12, Code 2001, is
  1 27 amended by striking the subsection.
  1 28    Sec. 4.  Section 805.8, subsection 4, paragraph b, Code
  1 29 2001, is amended to read as follows:
  1 30    b.  For operating violations under section 321G.9,
  1 31 subsections 1, 2, 3, 4, 5, and 7, sections 321G.11, and
  1 32 321G.13, subsections 4 and 9 subsection 4, the scheduled fine
  1 33 is twenty dollars.  For violations of section 321.234A, the
  1 34 scheduled fine is one hundred dollars.
