1 1 Section 1. Section 507B.4, subsection 7, paragraph c, Code
1 2 2001, is amended to read as follows:
1 3 c. Making or permitting any discrimination in the sale of
1 4 insurance solely or partially on the basis of domestic abuse
1 5 as defined in section 236.2.
1 6 Sec. 2. Section 507B.4, subsection 9, Code 2001, is
1 7 amended by adding the following new paragraph:
1 8 NEW PARAGRAPH. o. Delaying or refusing to pay a claim,
1 9 which would otherwise be paid, solely or partially on the
1 10 basis that such claim resulted from domestic abuse as defined
1 11 in section 236.2.
1 12 EXPLANATION
1 13 This bill provides that it is an unfair insurance trade
1 14 practice for a person engaged in the business of insurance to:
1 15 (1) discriminate solely or partially on the basis of domestic
1 16 abuse in the sale of insurance; and (2) delay or refuse to pay
1 17 a claim, which would otherwise be paid, solely or partially on
1 18 the basis that such claim resulted from domestic abuse. The
1 19 law previously prohibited only against discrimination in the
1 20 sale of insurance solely on the basis of domestic abuse.
