  1  4 RELATING TO THE REIMBURSEMENT OF ADMINISTRATIVE COSTS OF
  1  5    AN AREA EDUCATION AGENCY FOR SERVICES PROVIDED BY THE AGENCY
  1  6    UNDER PART C OF THE FEDERAL INDIVIDUALS WITH DISABILITIES
  1  7    EDUCATION ACT, AND PROVIDING AN EFFECTIVE DATE.

  1  9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 10 
  1 11    Section 1.  Section 256B.15, subsection 7, paragraph b,
  1 12 Code 2001, is amended to read as follows:
  1 13    b.  The area education agencies shall, after determining
  1 14 the administrative costs associated with the implementation of
  1 15 medical assistance reimbursement for the eligible services, be
  1 16 permitted to retain up to twenty-five percent of the federal
  1 17 portion of the total amount reimbursed to pay for the
  1 18 administrative costs.  This limitation does not apply to
  1 19 medical assistance reimbursement for services provided by an
  1 20 area education agency under part C of the federal Individuals
  1 21 With Disabilities Education Act.  Funds received under this
  1 22 section shall not be considered or included as part of the
  1 23 area education agencies' budgets when calculating funds that
  1 24 are to be received by area education agencies during a fiscal
  1 25 year.
  1 26    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  1 27 immediate importance, takes effect upon enactment.
