PAG LIN 1 1 Section 1. Section 249A.3, Code 2001, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 4A. The department shall establish 1 4 presumptive eligibility under the medical assistance program 1 5 for a child who is under nineteen years of age. A 1 6 determination of presumptive eligibility shall be made only 1 7 once in a twelve-month period. 1 8 Sec. 2. NEW SECTION. 280.7A HEALTHY AND WELL KIDS IN 1 9 IOWA (HAWK-I) INFORMATION. 1 10 The board of directors of each school district shall 1 11 require the school district to provide healthy and well kids 1 12 in Iowa program information and application forms to all 1 13 students at the time of school registration. The application 1 14 forms shall be provided by the healthy and well kids in Iowa 1 15 program pursuant to section 514I.7, subsection 2, paragraph 1 16 "h". 1 17 Sec. 3. Section 514I.4, subsection 4, paragraph a, Code 1 18 2001, is amended to read as follows: 1 19 a. Develop a program application form not to exceed two 1 20 pages in length, which is consistent with the rules of the 1 21 board, which is easy to understand, complete, and concise, and 1 22 which, to the greatest extent possible, coordinates with the 1 23 medical assistance program. The program application form 1 24 shall provide a space in which the applicant may provide the 1 25 name and contact information of any person who assisted the 1 26 applicant in applying for the program and may authorize the 1 27 administrative contractor to notify the person regarding the 1 28 outcome of the application with the sole purpose of the 1 29 notification being that the person will continue to assist the 1 30 applicant in obtaining and retaining health insurance 1 31 coverage. 1 32 Sec. 4. Section 514I.8, subsection 2, paragraph c, Code 1 33 2001, is amended to read as follows: 1 34 c. Is a member of a family whose income does not exceed 1 35 two hundred percent of the federal poverty level, as defined 2 1 in 42 U.S.C. } 9902(2), including any revision required by 2 2 such section. Determination of an applicant's income shall be 2 3 made on the basis of the applicant's self-declaration of 2 4 income. 2 5 Sec. 5. Section 514I.8, subsection 3, Code 2001, is 2 6 amended to read as follows: 2 7 3. In accordance with the rules adopted by the board, a 2 8 childmayshall be determined to be presumptively eligible for 2 9 the program pending a final eligibility determination. 2 10 Following final determination of eligibility by the 2 11 administrative contractor, a child shall be eligible for a 2 12 twelve-month period. At the end of the twelve-month period, 2 13 the administrative contractor shall conduct a review of the 2 14 circumstances of the eligible child's family to establish 2 15 eligibility and cost sharing for the subsequent twelve-month 2 16 period. 2 17 EXPLANATION 2 18 This bill relates to the provision of health care coverage 2 19 to children under the medical assistance and healthy and well 2 20 kids in Iowa (HAWK-I) programs. 2 21 The bill provides for presumptive eligibility of children 2 22 under the age of 19 in the medical assistance program and 2 23 provides that a determination of presumptive eligibility of a 2 24 child is to be made only once in a 12-month period. 2 25 The bill directs the boards of directors of school 2 26 districts to require that HAWK-I program information and 2 27 application forms be provided at the time of school 2 28 registration. 2 29 The bill provides that the HAWK-I application form is to 2 30 provide a space for an applicant to provide information 2 31 regarding any person who assisted the applicant in applying 2 32 for the program and for the applicant to authorize the 2 33 administrative contractor of the HAWK-I program to notify the 2 34 person, the sole purpose of the notification being that the 2 35 person will continue to assist the applicant in obtaining and 3 1 retaining health insurance coverage. 3 2 The bill provides that the determination of an applicant's 3 3 family income under the HAWK-I program is to be based upon the 3 4 applicant's self-declaration of income. 3 5 The bill provides for presumptive eligibility of a child in 3 6 the HAWK-I program which, following a final eligibility 3 7 determination, would continue for a 12-month period. 3 8 LSB 2356HH 79 3 9 pf/pj/5.1
