  1  1    Section 1.  Section 321.178, subsection 1, unnumbered
  1  2 paragraph 3, Code 2001, is amended to read as follows:
  1  3    Every public school district in Iowa shall offer or make
  1  4 available to all students residing in the school district or
  1  5 Iowa students attending a nonpublic school in the district an
  1  6 approved course in driver education.  A student shall not be
  1  7 enrolled in an approved course unless the student has
  1  8 completed with passing grades the equivalent of at least four
  1  9 semesters of coursework, since beginning the seventh grade, in
  1 10 English language arts, social studies, mathematics, or
  1 11 science.
  1 12    PARAGRAPH DIVIDED.  The approved courses may be offered at
  1 13 sites other than at the public school, including nonpublic
  1 14 school facilities within the public school districts.  An
  1 15 approved course offered during the summer months, on
  1 16 Saturdays, after regular school hours during the regular terms
  1 17 or partly in one term or summer vacation period and partly in
  1 18 the succeeding term or summer vacation period, as the case may
  1 19 be, shall satisfy the requirements of this section to the same
  1 20 extent as an approved course offered during the regular school
  1 21 hours of the school term.  A student who successfully
  1 22 completes and obtains certification in an approved course in
  1 23 driver education or an approved course in motorcycle education
  1 24 may, upon proof of such fact, be excused from any field test
  1 25 which the student would otherwise be required to take in
  1 26 demonstrating the student's ability to operate a motor
  1 27 vehicle.  A student shall not be excused from any field test
  1 28 if a parent, guardian, or instructor requests that a test be
  1 29 administered.  Street or highway driving instruction may be
  1 30 provided by a person qualified as a classroom driver education
  1 31 instructor or a person certified by the department of
  1 32 transportation and authorized by the board of educational
  1 33 examiners.  A person shall not be required to hold a current
  1 34 Iowa teacher or administrator license at the elementary or
  1 35 secondary level or to have satisfied the educational
  2  1 requirements for an Iowa teacher license at the elementary or
  2  2 secondary level in order to be certified by the department of
  2  3 transportation or authorized by the board of educational
  2  4 examiners to provide street or highway driving instruction.  A
  2  5 final field test prior to a student's completion of an
  2  6 approved course shall be administered by a person qualified as
  2  7 a classroom driver education instructor.  The department of
  2  8 transportation shall adopt rules pursuant to chapter 17A to
  2  9 provide for certification of persons qualified to provide
  2 10 street or highway driving instruction.  The board of
  2 11 educational examiners shall adopt rules pursuant to chapter
  2 12 17A to provide for authorization of persons certified by the
  2 13 department of transportation to provide street or highway
  2 14 driving instruction.  
  2 15                           EXPLANATION
  2 16    This bill requires a student to complete with passing
  2 17 grades the equivalent of at least four semesters of
  2 18 coursework, since beginning the seventh grade, in English
  2 19 language arts, social studies, mathematics, or science before
  2 20 the student may enroll in an approved course in driver
  2 21 education offered by a public school district.
