1 1 Section 1. NEW SECTION. 321.363A CELLULAR TELEPHONE USE
1 2 BY MINORS WHILE DRIVING.
1 3 1. Except as provided in this section, a person operating
1 4 a motor vehicle pursuant to an instruction permit or
1 5 intermediate driver's license issued under section 321.180B
1 6 shall not use a cellular telephone while the motor vehicle is
1 7 in operation.
1 8 2. The use of a cellular telephone by an operator of a
1 9 motor vehicle is not a violation of this section if the
1 10 operator uses the cellular telephone to call a 911 or other
1 11 emergency number.
1 12 3. For purposes of this section, "cellular telephone"
1 13 means a radio-link telephone that provides dial tone access to
1 14 a portable, mobile, or fixed location for which a charge is
1 15 levied.
1 16 EXPLANATION
1 17 This bill creates a new criminal offense for the use of a
1 18 cellular telephone by a minor operating a motor vehicle
1 19 pursuant to an instruction permit or intermediate driver's
1 20 license, unless the call is for emergency purposes.
1 21 A person who violates this bill commits a simple
1 22 misdemeanor under Code chapter 321 punishable by confinement
1 23 for no more than 30 days or a fine of at least $50 but not
1 24 more than $500 or by both.
