Section 85.39, unnumbered paragraph 2, 1 6 Code 2001, is amended to read as follows: 1 7 If anevaluation of permanent disability1 8 examination has been made by a physician retained by 1 9 the employer and the employee believesthis evaluation1 10to be too lowthat any opinion rendered as the result 1 11 of the examination and affecting benefits entitlement 1 12 is incorrect, the employee shall, upon application to 1 13 the commissioner and upon delivery of a copy of the 1 14 application to the employer and its insurance carrier, 1 15 be reimbursed by the employer the reasonable fee for a 1 16 subsequent examination by a physician of the 1 17 employee's own choice, and reasonably necessary 1 18 transportation expenses incurred for the examination. 1 19 The physician chosen by the employee has the right to 1 20 confer with and obtain from the employer-retained 1 21 physician sufficient history of the injury to make a 1 22 proper examination. This paragraph applies regardless 1 23 of whether or not the employer denies or accepts 1 24 liability for benefits." 1 25 #2.
